Agency : New DelhiA sessions court is all set to deliver its verdict on Wednesday in the hit-and-run case involving Bolly-wood actor Salman Khan, who is charged with kill-ing one person and injur-ing four by ramming his SUV into a bakery shop in suburban Bandra 13 years ago. Police have geared up to provide tight securi-ty in the court to restrain the actor’s fans from en-tering the premises with a view to avoiding over-crowding, sessions court sources said. Only me-diapersons, lawyers and the court staff would be allowed inside the court, the sources said.Judge DW Deshpande

had declared last month that he would pronounce the verdict on 6 May. He also summoned the actor to remain present in the court at 11.15 AM on the day. The prosecution and

defence concluded argu-ments on 21 April in the trial which was conducted afresh after a Magistrate added the charge of culpa-ble homicide not amount-ing to murder and referred

the case to the sessions court. The culpable ho-micide offence, which provides for punishment upto 10 years, can be tried only by a sessions court and not by a magistrate. Earlier, the magistrate was trying Khan for rash and negligent driving, an

two years. Khan, 49, pleaded he was not driv-ing the car at the time of mishap and that his driver Ashok Singh was behind the wheel. The actor, on the other hand, argued he was hav-ing a glass of water and

A court had in 2013 framed charges in a fresh trial against Khan for culpable homicide not amounting to murder.The prosecution examined 27 witnesses to prove its case.

With several Opposition parties raising serious concerns on a number of clauses, chances of the Constitution (122nd Amendment) Bill for introduction of Goods and Services Tax (GST) clearing Parliament in the current session dimmed on Tuesday. Union Finance Minis-ter Arun Jaitley “be-seeched” the Opposition in the Lok Sabha to “rise above partisan” consid-erations as they “serve no purpose” but the Con-gress, the AIADMK and the BJD mounted stiff resistance which could effectively stall the pas-sage in the current ses-sion as the government does not have a major-

ity in the Upper House — even if it manages to push the Bill through the Lower House on Wednesday. The Opposi-tion’s strategy in the Ra-jya Sabha will be to force the government to accept the referring of the Bill to a Select Committee on the ground that there are substantial chang-es which have not been scrutinised. In the Lok Sabha however, Speak-er Sumitra Mahajan on Tuesday rejected such a demand. Mr. Jaitley argued that if the GST Bill was sent back to the Standing Committee on Finance, it would delay the benefits to the States by another financial year as yet another deadline of April 1, 2016 would

Appeals and the travesty of justiceAfter 13 years, actor Salman Khan has finally been convicted in the Mumbai hit-and-run case. In 2002, he ran his car over a group of homeless men sleeping on the platform, killing one and injuring several others. Khan, who has been sentenced to five years in prison by a Sessions court in Mumbai, is likely to appeal in the Bombay High Court. And in this way, some more years will pass. Consider another case, far from the glare of cameras and press attention, one where con-viction was delayed not by 13 years, but a mind-bog-gling 41 years. This was the obscure case of Parsuram Satpathy, a student leader, who was murdered by a former member of the legislative assembly and eight others in 1974 in Balangir, Odisha. On Monday, the Orissa high court awarded life imprisonment to three of the nine accused. The other six died over the course of 40 years. Quite naturally for Satpathy’s family, the punishment that has been handed out is a far cry from any understanding of the word justice. These very dif-ferent cases are among a huge number of civil and criminal proceedings that display one feature: delays caused by strict adherence to procedural justice. Once meant to safeguard the poor against the mighty, pro-cedural aspects of law now pose a danger to the de-livery of justice itself. The number of cases pending in the judicial pipeline is a case in point. A data-based Mint report on the overburdened judicial system re-vealed that, “The average percentage of cases pend-ing trial in state high courts and lower courts has in-creased to 84.81% in 2013 compared with 82.8% a decade earlier…The completion rate for cases has fallen to 13.19% in 2013 from 14.61% in 2003…the outstanding number of criminal cases before the judiciary was 9.71 million in 2013.” (The slow moving wheels of Indian judiciary, 5 August 2014) Compare this with the number of pending criminal cases in US district courts in 2013: 75,578. In the US, the number of pending cases has actually fallen 1% from 2012. Speed is the essence of justice. Very often, delays in the delivery of justice take the sting out of the crime. This provides sufficient room for the accused to device mitigation strategies that soon translate into grounds for leniency. This is evident in Khan’s case. The arguments that started surfac-ing before and after the verdict was announced are partly explained by this sort of strategizing. How to reconcile a verdict convicting him of killing a man, with the fact that through his charity Being Human he has helped in the betterment of several lives? To put it bluntly, for the purposes of justice it doesn’t matter. Khan committed his crime in 2002. He start-ed his charity in 2007. He could spend his life doing charity but that doesn’t diminish the gravity of the crime itself. The trouble with delaying justice is just this: it lends credence to such arguments for clem-ency.

The state gov-ernment had last month

appointed custodians in Mehsana District Central Co-operative bank and Dudhsagar Dairy in Me-hsana, which were among 100-odd co-operative institutions that had not conducted elections of respective management committees in the stipulat-ed five-year term. These appointments were made as per the new provisions of Gujarat Cooperative Societies (Amendment) Bill 2015, which was re-cently passed in the As-sembly and approved by

Governor O P Kohli. Un-der the Act, the govern-ment is now empowered to appoint custodians in such societies to initi-ate the process of elec-tion. However, managing committees of both the institutions approached the Gujarat High Court against the appointment of custodians. Gujarat government spokesperson Nitin Patel today said the Court recently revoked the appointment of custo-dian in Mehsana District bank. The state govern-ment then approached Su-preme Court to challenge the order of High Court. “Supreme Court today gave an interim order in our favour and approved the appointment of cus-todian and set aside the High Court order. Further hearing will be held in July by the apex court,” said Patel.
