DAYPeople of Bihar like Nitish Kumar but not his politicsThirty five-year-old Shankar Prasad Shah, a shop-keeper in Bihar’s Munger district, believes that his state has never had a more able administrator than Nitish Kumar; in fact, Shah would ideally like him to serve another term as chief minister. Yet he will vote for the Bharatiya Janata Party (BJP) in the up-coming Bihar assembly polls, which kicks off with the first phase on Monday. The reason: caste pol-itics. “I am a baniya (caste) and if Lalu comes to power he will never protect me. So I have to vote for Modi to keep myself safe from the Yadavs,” said Shah, who lives in an area dominated by Yadavs. The dilemma faced by Shah captures the count-er-intuitive politics playing out in this year’s elec-tion. People of Bihar, as a survey by the Centre for the Study of Developing Societies (CSDS), a Delhi based think-tank, showed, like Kumar but dislike his politics. It is exactly this contradiction that the BJP, once again led by Prime Minister Narendra Modi, is looking to exploit to rewrite the history of Bihar politics—by installing a BJP-led coalition for the first time ever. Though only an election for the state assembly, the results will reverberate be-yond its borders—it has consequences both for the incumbent, three-term chief minister Kumar of the Janata Dal (United), or JD(U), and the challeng-er, a BJP led by Modi. Victory for Kumar would mean vindication of his ability to overcome com-plex electoral challenges through the use of tactical alliances (this time with former political foe, Lalu Prasad of the Rashtriya Janata Dal ,or RJD), while defeat may see him consigned to the political wil-derness. Similarly, a win for the BJP alliance would reaffirm Modi’s grip on national politics, help the party overcome its humiliation earlier this year at the hands of the Aam Aadmi Party in the Delhi as-sembly polls and help the BJP-led National Dem-ocratic Alliance wrest the political initiative away from the opposition inspired by a feisty Congress. In the first phase, 49 constituencies spread across 10 districts including Bhagalpur, Munger, Begusa-rai and Jamui, will go to the polls. Of these, in the existing assembly, 13 MLAs belong to the BJP, 29 to the JDU and four to the RJD. Interviews with a cross-section of voters in this region reveal that aspirations, like in the last general election, are a key factor influencing voter choice; that is, over and above the traditional divisions along caste and religious lines.

In a major relief to British telecom major Voda-fone in the transfer pricing case, the Bombay High Court on Thursday ruled in its favour, setting aside a tax demand of Rs. 3,700 crore imposed on Voda-fone India by the income tax authorities. This is likely to benefit multinational companies such as IBM, Royal Dutch Shell and Nokia that face sim-ilar tax demands. The case dates back to financial year 2007-8 involving the sale of Vodafone India Services Private Ltd., the call centre business of Vodafone, to Hutchison, and the tax authorities demanded capital gain tax for this transaction. The Income Tax department had demanded that Rs.8,500 crore be added to the company’s taxable income. Transfer pricing is referred to the setting of the price for goods and services sold between related legal entities within an enterprise. This is to ensure fair pricing of the asset transferred. For example, if a subsidiary company sells goods to a parent company, the cost of those goods is the transfer price.

Gujarat high court (HC) on Thursday directed the state government to appoint an HC judge, ei-ther sitting or retired, as the chairman of Gujarat Electricity Regulatory Commission (GERC), a quasi-judicial body which has a three-mem-ber panel to adjudicate disputes related to tariff.
