must be drawnThe invocation of sedition (Section 124A of the Indian Penal Code) against Hardik Patel, and his colleagues leading the Patidar movement, by the Gujarat government is a sign of the increasing in-tolerance of any political movement venting out people’s grievances. The offence of sedition in-volves the question of the relationship between a government and the people. In the past, when the government was the absolute ruler and people were the subjects, any opposition, however peaceful, was considered a challenge to political authority and, as such, was punishable as sedition. But with the ar-rival of democratic governments, recognition of se-dition became controversial. The difficult question is: Where to draw line between permissible speech and justifiable limits in the interest of safeguarding the political authority of a democratic state? The In-dian Penal Code, in chapter VI, titled “Of offences against the state” defines sedition in section 124A. It reads as: “Whoever by words, either spoken or written or by signs or visible representation, or oth-erwise, brings or attempts to bring into hatred or contempt or attempts to excite disaffection towards government established by law in India, shall be punished with imprisonment for life to which fee may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.” It includes disloyalty and all feelings of enmity. It excludes comments expressing disap-probation of the measures of a government with a view to obtain their alteration by lawful means, or comments expressing disapprobation of the admin-istrative or other action of the government without exciting or attempting to excite hatred, contempt or disaffection. Before Independence, many, including Lokmanya Tilak, were punished under this section. Even after Independence, the Supreme Court used the section in several cases in spite of the warning. An almost similar definition of sedition exists in the English common law. If strictly interpreted, it would cover almost all political speeches and oratory. But the common law definition has been liberalised in a number of ways by the judiciary. Mere speech, however inflammatory or inciting, is not sufficient; the speaker must intend to cause violence. The true test is, “was the language used calculated, or was it not, to promote public disorder or physical force or violence in a matter of state?” As a result of these dilutions, its use has become rare.

Major banking transactions took a hit on Thursday as over 17,000 employees of RBI went on ‘one-day mass casual leave’, protesting against reform mea-sures of the central government and seeking better retirement benefits. Among the services that were affected were cheque clearances, payments and settlements, and forex transactions. The protest -- the first at the apex bank in six years -- was called by the United Forum of Reserve Bank Officers and Employees, the umbrella organisation of four recognised unions of officers and other employees at the central bank. The unions are opposing the government’s move to take away the public debt management from the Reserve Bank and curtail its powers on monetary policy. “The government, by various mechanisms, is taking away functions of RBI. They have proposed to form Public Debt Management Agency (PDMA).

The government today kick-started the process of online auction for eight blocks in the fourth round for sectors like steel, cement and iron. The govern-ment has already mobilised over Rs 3 lakh crore in the first three rounds of coal auction and allotment. “It has been decided to auction eight Schedule III coal mines earmarked for non-regulated sectors like, iron and steel, cement and captive power plants in the fourth tranche. The e-auction for these mines will be held from January 18 to January 22, 2016,” Coal Secretary Anil Swarup said address-ing the media here. Directions have been issued to the nominated authority for auctions, Joint Sec-retary, Coal, Vivek Bhardwaj, to conduct the auc-tion, and the notice inviting tenders will be issued tomorrow, Swarup said. “Commencement of sale of tender document will start from December 31 while the vesting order by the nominated authority to successful bidders will be issued by March 10,” the Secretary said. These mines together have re-serves totaling 1,143.42 million tonnes (MT) and their peak rated capacity stands at 12.86 mt.

The Delhi high court on Thursday asked the state government not to with-hold the ‘no objection certificate (NOC)’ for the upcoming India-South Africa Test match, say-ing that the Delhi and District Cricket Associa-tion (DDCA) has agreed to deposit Rs one crore in connection with the administration’s exter-tainment tax demand. A bench of justices Badar Durrez Ahmed and San-jeev Sachdeva also direct-ed the AAP government not to take any coercive measures against DDCA in connection with Rs 24-crore entertainment tax demand raised on the cricketing body by the administration’s Excise, Entertainment and Lux-

ury Tax department. The court asked DDCA to deposit Rs one crore in two instalments of Rs 50 lakh each with the depart-ment whose clearance is also required to host the India-South Africa Test match at Feroz Shah Kotla stadium from De-cember 3 to December 7. The first instalment is to be paid within two weeks from Thursday and the remaining in two weeks thereafter, the bench said. “No coercive steps will be taken till further orders,” it said and list-ed the matter for further hearing on November 27. DDCA vice-president Chetan Chauhan said the state association is ready to put up a good show at the Feroz Shah Kotla. “We are thankful to the

judiciary for taking a pos-itive step for the cricket lovers of the capital. We will now put all our en-ergies towards hosting a successful game,” a jubi-lant Chauhan. “We have already started the work of the match. Today, Manjula heads a cleaners’ cooperative with 400 members that provide cleaning and housekeeping services to 45 institutions and societies in Ahmedabad raking in a turnover of Rs 1 crore per annum! Manjula recalls how Shri Saundarya Safai Utkarsh Mahila Sewa Sahkari Mandali Ltd (SSSUMS-SML) consisting of 40 women offering com-mercial cleaning services was born after coming in contact with Elaben Bhatt-founded Self-Em-ployed Women’s Asso-ciation (Sewa). “Nation-al Institute of Design was the first institution to give business to us. Next, Physical Research Laboratory (PRL) hired our 15 women,” says Manjula, who was then the chief supervisor.

She recalls how it took five years to convince authorities to register their cooperative as they were not selling any product but a service. Over the years, Saund-arya Mandali has gone from strength to strength through several levels of training. From provid-ing cleaning services in institutions of national repute to residential so-cieties, they also offered services during Vibrant Gujarat summits in the past. The majority of the cleaning women are for-mer paper pickers. Their gunny collection bags now replaced with mod-ern equipment including road cleaners, vacuum cleaners, high-jet pres-sure, micro-fibre mops, floor cleaners, carpet shampooing machines, scrubbers and extractors, these women claim to do a mean cleaning job.
