QUOTE OF THE

DAYNational Herald Case: Why Sonia And Rahul Gandhi Need To Be Afraid

The Rs 5,000-crore scam involving Sonia and Rahul Gandhi looks like an open-and-shut case, if Subra-manian Swamy’s allegations are true. So why has the BJP-led government been dithering over it? Such inaction could cost the party dearly. With senior ad-vocates Kapil Sibal, Abhishek Manu Singhvi and P. Chidambaram on one side, you would think there is little else that could catch the judge’s attention. But it is no ordinary courtroom where you have Subra-manian Swamy—politician, professor, and serial liti-gant—asking the judge for a mere hour to make a pre-sentation to prove his case. “The stalwarts can argue all day—I just need an hour to make my point,” he politely tells the judge. A few hearings later, the judge is convinced and quashes an appeal against trial court summonses issued to Congress party president Sonia Gandhi and vice president Rahul Gandhi to appear before the court. This means that on 19 December Sonia and Rahul Gandhi are required to be personally present at 3pm at Patiala House courts. Swamy is a man who turns a courtroom into a carnival. It isn’t just another day in the court for a reporter when he is spot-ted in the corridors. His Supreme Court lawyer wife, Roxna Swamy, is present in most hearings involving her husband along with a junior lawyer. Dressed in his trademark white kurta-pyjama, flashing an Apple watch, he engages young lawyers for a chat before the proceedings begin. Journalists get a tete-à-tete after-wards. When he begins to talk, one cannot miss the composure and certainty in his voice and the frank-ness in his words. The lawyers on the other side and Swamy take turns to accuse each other of malice. Ev-ery Swamy session is replete with inside jokes, innuen-dos and friendly jibes. One of the first hearings in the high court was a lesson on Nehru’s legacy, with Sibal and Swamy nitpicking with each other over the edito-rial values of the National Herald. The retelling of the newspaper’s story—its debt and subsequent corporate transactions—has been done without fail to recall rele-vant anecdotes (including how and why Satyanarayan Gangaram Pitroda turned Sam Pitroda). Apart from the Gandhis, four others—Motilal Vora, the chairman of the board of directors of National Herald and Congress treasurer, Oscar Fernandes, Congress general secretary, journalist Suman Dubey and former National Knowl-edge Commission chairperson Sam Pitroda—have to appear before a court. Based on a first information re-port (FIR) filed in Tilak Nagar police station in New Delhi, a trial court began hearing the case in 2013 and issued summonses to all the accused, notably the Con-gress President and the vice President.

“No political vendetta. A private complaint was lodged. Government had nothing to do with it. The High Court has dismissed their case and asked them to go and face trial. Nobody in this country has immunity from law. They can challenge the orders in a higher court or face proceedings,”

The legisla-tion in this regard was introduced by Senators Bill Nelson of the Democratic Party and Jeff Sessions of the Republican Party. “By cutting the number of visas available each year and requiring those visas be given to the highest wage- earners first, this bill directly targets outsourcing companies that rely on lower-wage foreign workers to replace equal-

As Apple Watch enters the critical holiday shopping season, it looks likely to get a sales boost from happy customers, almost two-thirds of whom are planning to give one as a gift, a Reuters/Ipsos poll showed on Tuesday. The poll found that about 7 percent of US adults plan to give the Watch as a gift this holiday season, including current owners. That could trans-late to sales of up to 16 million watches over the holidays, based on 2014 US Census projections and excluding younger teens. If even a fraction of con-sumers follow through, Apple would be well-po-sitioned to meet or beat Wall Street’s 2015 sales forecasts, which generally range from 10 million to 12 million watches, said FBR Capital Markets analyst Daniel Ives, who expects about 12 million sold worldwide. Cupertino, California-based Apple appears to be benefiting from its loyal fan base with its first new device since the iPad. Sixty-two percent of US adults who already have an Apple Watch plan to give the gadget as a holiday gift, according to the Reuters/Ipsos poll.Holiday sales of the product will be scrutinized as a barometer of how much promise

it holds for the company.

Short circuit, poor maintenance and lack of aware-ness are major reasons of fire in trains, according to the findings of the Comptroller and Auditor Gen-eral of India. Besides the audit report found that the automatic smoke/fire detection device in the running trains are not successfully implemented. Though recommendations are made by high level safety review committee and 12th Five Year Plan for introduction of fire alarm system in coaches for early detection of fire, it has not been successfully implemented, CAG noted in its latest report tabled in Parliament today. A joint survey conducted by CAG and railway officials found that fire prone activities like cigarette smoking, cooking by ven-dors at stations, carrying of inflammable articles by unauthorised persons, accumulation of empty cardboard boxes and other waste materials were unchecked aggravating the risk of fire. The report observed that Corporate safety Plan (CSP) envis-aged bringing down the number of accidents by 80 per cent from 2001-02 to 2013 but number of ac-cidents went up by 160 per cent during the period. The loss of human lives in fire accidents in passen-ger coaches steeply increased from 3 in 2001-02 to 9 in 2011-12, 32 in 2012-13 and 35 in 2013-14.

Roger Federer has re-jigged his coaching team for next year by part-ing company with Ste-fan Edberg and bringing Ivan Ljubicic on board, the 17-times grand slam champion said on Wednesday. Former world number one Ed-berg had worked as part of a team led by Federer’s long-term coach Sever-in Luthi since January 2014, a period in which the 34-year-old revived his career without adding to his tally of grand slam titles. “After two very successful years, I would like to thank Stefan Ed-berg, my childhood idol, for agreeing to join my team,” Federer said in Facebook post. “It was

On Tuesday, Pune and Ra-jkot were declared as ven-ues of two new franchises for the next two seasons of the Indian Premier League (IPL.) The move came after the RM Lodha-led panel suspended Chennai Super Kings (CSK) and Rajasthan Royals (RR) for two years in relation to the 2013 IPL corruption scandal. Pune has earli-er been a part of the IPL, with Sahara group’s Pune Warriors India playing in three seasons from 2011 to 2013 before being ter-minated from the league.

Rajkot, on the other hand, will have its first tryst with the cash-rich tourna-ment when the franchise turns out in IPL-9. The new franchises will now take part in a player draft on December 15, where both teams will pick five players each from a pool of CSK and RR play-ers. Though all eyes will be on where MS Dhoni lands up after the auction, a certain Ravindra Jadeja will have fair share of the media spotlight. Fans will be keen to see whether or not Jadeja is bought by the Rajkot franchise — a team representing his

New Zealand captain Brendon McCullum fi-nally broke his silence on Wednesday when he stated that he will stand by the testimony he gave against Chris Cairns even after his former teammate was acquitted in the per-jury case. Cairns, who was last month cleared of match-fixing related perjury charges, has de-manded an explanation from Mccullum about why he chose to appear as a prosecution witness. Speaking for the first time

since the verdict 10 days ago, McCullum said he was “very comfortable” with the evidence he gave and it was time to move on. “For me, it wasn’t about whether someone was guilty or not guilty. My role was to go and give the evidence in the trial and I remained pret-ty unemotional about it, to be honest,” he said in Dunedin as he prepared to lead New Zealand into a Test series against Sri Lanka. “I don’t think my reputation has been on the line during the whole thing. I was one

of a number of witness-es who gave evidence.” While journalists wanted answers about the Cairns trial, McCullum wanted to talk about the first Test against Sri Lanka start-ing on Thursday. “People have their own opinions on what unfolded but I am comfortable with it and it’s time to focus on a bit of cricket now,” he said, adding that he would not be responding to Cairns’ “please explain” demand in a newspaper column last weekend. “I don’t think I have to do that,” he said.

Indian cricketer Shikhar Dhawan, who was used in the fourth innings of the fourth and final Test against South Africa which ended on Monday in Delhi as a part-time bowler, has been report-ed for suspect bowling action. The Internation-al Cricket Council (ICC) informed in a release on Wednesday morning that a report by the match of-ficials for the fourth and final Test at the Feroz Shah Kotla Stadium in the country’s capital was handed over to the Indian cricket team management. The report from the match officials highlighted con-cerns about the legality of the bowling action of

the dashing opening bats-man, who is seldom used as a bowler by the Indian cricket team in interna-tional cricket. After being set an improbable target of 481 runs to win, the South African team finally found their confidence as they went on stonewalling the Indian bowlers for a major-ity of the fourth day at Del-hi and also in the first ses-sion on the fifth day. Indian team was seen getting a little restless as South Afri-can batsmen Temba Bavu-ma, Hashim Amla, Faf du Plessis and AB de Villiers dropped anchor in their second innings and fought really hard to force a draw. The South Africans even-tually lost the game by 337 runs. On the evening of the

fourth day, a desperate In-dian cricket team used the services of their part-time bowlers Dhawan, Mura-li Vijay, Virat Kohli and even Cheteshwar Pujara, but could not break the stubborn stand between Amla and de Villiers. Dha-wan bowled three overs in his spell, which had one maiden and gave away nine runs without any success. Dhawan was not used by India on the fifth and final day of the Test. The International Cricket Council (ICC) informed in a release, “India’s Shikhar Dhawan has been report-ed with a suspect bowling action during the fourth Test against South Africa, which the host won in New Delhi on Monday.

He will al-ways be a part of my team. “Severin Luthi, who I have been working with since 2008, will con-tinue to be my main coach and he will be joined by

Ivan Ljubicic,” Federer added. Croatian Ljubicic, who retired in 2012 after a long career which peak-ed when he reached num-ber three in the world, coached Canadian Milos Raonic for two years un-til last month. “It became very clear from the start that this was going to be a special partnership, work-ing with the greatest am-bassador tennis has ever seen,” the six-times grand slam champion said.

homeland. The man with the golden arm, Jadeja was the second highest wicket taker during the recently concluded Test series between India and South Africa. Inciden-tally, he was making his comeback to the team in the series. The 27-year Saurashtra all-rounder has been an integral part of all the IPL franchises he has played for so far. He made his IPL debut in the inau-gural edition, where he was a part of the RR team under spin-wizard Shane Warne. Then a 20-year old, Jadeja left an indeli-ble impression on Warne, who gave him the title of ‘Rockstar’! The Austra-lian legend even predict-ed that Jadeja would go on to play for India in the time to come, a prophecy that indeed came true. His negotiations with other franchises without Board of Control for Cricket in India’s (BCCI’s) approv-al resulted in a one year ban in 2010. But he made a stunning comeback next year to play for the now defunct Kochi Tuskers Kerala (KTK) franchise, where again he proved to be a mainstay.

The National Investiga-tion Agency is probing if there was a ‘bigger con-spiracy’ behind the mur-ders of two BJP leaders in Gujarat’s Bharuch dis-trict last month, alleged-ly at the behest of 1993 Mumbai serial blasts ac-cused and underworld don Javed Patel, known as Javed Chikna. Sourc-es said NIA is looking at whether the murders were committed with a possible plan to trigger communal unrest across the coun-try. They are not ruling out the possible involve-ment of Pak agencies and Dawood Ibrahim behind this design to eliminate BJP leaders with a known “communal” image. NIA dispatched an inspector general (IG) rank officer

An NIA team is already questioning two contract killers - Abid Dawood Patel (Javed Chikna’s brother) and Salim Gan-chi-- who were allegedly paid Rs 50 lakh for the killings. Former president of party’s Bharuch district and senior RSS member Shirish Bangali and gen-eral secretary of Bharati-ya Janta Yuva Morcha of the district Pragnesh Mis-try were shot dead on No-vember 2. The depart-ment’s move comes in the wake of declining state board results. The Class X results of the Gujarat Sec-ondary and Higher Sec-ondary Education Board (GSHSEB), recorded since 2004, plummeted to the lowest pass percentage of 54.42 per cent in the academic session 2014-2015. In this petition, Hardik has made state government, Additional Chief Secretary, Home, P K Taneja, Director Gen-eral of Police P C Thakur, among others, parties in the case. The matter will be heard on December 17. During arguments, Hardik’s lawyer, B M Mangukiya, asked the government to share all orders given by Home Department permitting

city Crime Branch to in-tercept calls of many Pa-tel quota agitation leaders between August and Oc-tober. Mangukiya alleged that phone tapping was done without any prior permission from author-ities such as Additional Chief Secretary (Home). He termed the act as a ‘breach of privacy’ of cit-izens. However, Public Prosecutor Mitesh Amin maintained due process was followed in getting

permission. He said calls were intercepted after obtaining consent from authorities at regular in-tervals and objected to demand to share the or-ders. After hearing the arguments, Justice J B Pardiwala ruled that gov-ernment is not required to share these orders. Sources revealed that the idea to include private schools under the evalu-ation drive has come up after analysing the poor performance of students in the state board exam-
