The brave fight put up by Muslim women against the practice of triple talaq has once again brought into fo-cus the lack of a uniform civil code in India. The Nar-endra Modi government has now asked the Law Com-mission to examine the issue. This is hopefully the first step towards the implementation of something that has been delayed for far too long. India needs a uniform civil code for two principal reasons. First, a secular re-public needs a common law for all citizens rather than differentiated rules based on religious practices. This was a key issue debated during the writing of the Con-stitution, with passionate arguments on both sides. The Indian Constitution was eventually stuck with a com-promise solution, a directive principle that says: “The state shall endeavour to secure for citizens a uniform civil code throughout the territory of India.” Several members of the Constituent Assembly disagreed vehe-mently with the compromise. Among them were the trio of Minoo Masani, Hansa Mehta and Rajkumari Amrit Kaur. As Kaur argued: “One of the factors that have kept India back from advancing to nationhood has been the existence of personal laws based on religion which keep the nation divided into watertight compart-ments in many aspects of life.” Later, in the first decade after independence, the opposition from Hindu conser-vatives to the Hindu Code Bill was eventually over-come. Nothing similar was tried when it came to Mus-lim conservatives. The political leadership of the day mistakenly decided to not take on conservative Muslim opinion just after the trauma of partition. There is a sec-ond reason why a uniform civil code is needed: gender justice. The rights of women are usually limited under religious law, be it Hindu or Muslim. The practice of triple talaq is a classic example. It is important to note that B.R. Ambedkar fought hard for the passage of the Hindu Code Bill because he saw it as an opportunity to empower women. The great Muslim social reformer Hamid Dalwai also made the rights of women a cen-tral part of his campaign for a uniform civil code. It is unfortunate that the demand for a uniform civil code has been framed in the context of communal politics. Too many well-meaning people see it as majoritarian-ism under the garb of social reform. They should un-derstand why even the courts have often said in their judgements that the government should move towards a uniform civil code. The judgement in the Shah Bano case is well known, but the courts have made the same point in several other major judgements. The move towards a common civil code cannot be a hasty one. There is the obvious political challenge on assuaging the fears of the Muslim community. The government will have to work hard to build trust, but more impor-tantly, make common cause with social reformers rath-er than religious conservatives, as has been the wont of previous governments. One strategic option is to follow the path taken after the fiery debates over the reform of Hindu civil law in the 1950s. Rather than an omnibus approach, the Modi government could bring separate aspects such as marriage, adoption, succession and maintenance into a uniform civil code in stages. The civil law in Goa—derived from the Portuguese Civil Procedure Code of 1939—could be a useful starting point for a national debate.

A Chennai-based Flipkart delivery agent has been arrested for stealing a number of iPhones from his employer, in a scheme he carried out for over a month before being caught. B Naveen (21), acquired a number of iPhone fakes, and set his plan into ac-tion. According to the New Indian Express, his idea was to place fake orders for iPhones in the Wash-ermenpet area, where he was the foremost delivery agent. Upon receiving the iPhones, Naveen would swap them for the fakes in his possession and re-turn them to the company, claiming the non-existent customers had returned them seeing as they were being cheated. Naveen managed to get a hold of 12 iPhones this way, before he slipped up. Naveen’s employer eventually noticed a disconcerting pat-tern, with an unusually high number of dissatisfied customers returning fake products in the Naveen’s area. Flipkart carried out an internal investigation into the matter and discovered that the phones dis-

patched were not the same ones being returned.

Air India to launch Ahmedabad-London-Newark flight, expand

With an aim to connect more global destina-tions, leading state-run airline Air India will launch Ahmedabad-Lon-don-Newark flight from August 15 and Del-hi-Madrid in December, and also plans to ex-pand its fleet size in next four years, a top official said today. “We will be launching the Ahmed-abad-London-Newark flight from August 15 and Delhi-Madrid from December as part of our growth plan,” Air India Chairman and Manag-ing Director, Ashwini Lohani, told reporters here. Lohani arrived here for taking part in a pro-gramme on the occasion of opening of AI area manager’s office, which was inaugurated by Mad-hya Pradesh Chief Secre-tary Antony DeSa. “We have launched a number of new flights. We have already launched flights from Delhi for San Fran-

cisco and Vienna. Next year we are planning to launch five-six more flights, including Wash-ington, Scandinavian countries and Africa. We are heading towards growth,” Lohani said, replying to a question on the issue of profitability.To a query on the cur-rent fleet size, he said at present there were 133 aircraft in the AirIndia group.“In next four years we will have 232 planes,” he said.On relaxation in 5/20 rule (five years op-eration in domestic sec-tor and 20 aircraft) for launching international operations, the CMD, while welcoming it, said ultimately it will benefit the passengers as compe-tition will increase. “It is a good decision as it will enhance competition and will ultimately benefit air passengers.
