The no- tices state that the ap- pointments were made “without using public advertisement” and “no selection procedure was undertaken.” The affect- ed employees have been given 11 days time to respond back to the ad- ministration of the court, failing which the ad- ministration would take “appropriate decision”. These employees were hired during the time of Acting Chief Justice V M Sahai, who retired last month, provoking sev- eral questions in his last days in office during a hearing on a public in- terest litigation (PIL) related to land allotment of 27 sitting and retired judges of the high court. The current Acting Chief Justice Jayant Patel was also among the 27 judg- es who served notice on the basis of this PIL. Ad- vocate General Kamal Trivedi in open court had then mentioned about the alleged irregularities in the manner in which recruitment for class-III and class-IV categories took place. DAYThe good word ‘development’It is hard to deny the importance of something that goes by the name “development”. But we are begin-ning to resort to “development” as a rhetorical nar-cotic: An all-purpose solution to all problems. Lack of development is a diagnosis that can explain every problem, from agitating Patels to rampaging males. And the coming of development will solve most problems. The prime minister sees development as a solution to problems; intellectuals will generally point to failure of development as a root cause for nearly everything. Development has become the theodicy of contemporary politics. Development and the things associated with it — overcoming pov-erty, jobs, education, infrastructure — are undeni-ably important. They are forces for social churning. And we feel safer with a politics focused on these, rather than bloodlusts of identity politics. But our re-sort to development as a catch-all hope has become a symptom of our lack of imagination, our refusal to see the inner conflicts that development itself generates. Two kinds of conflicts regarding devel-opment are well recognised. First, there are conflicts over how the process of development is imagined, and we still cannot seem to get adequate consensus on where we want to head. Second, that develop-ment has victims: For all its potential as a liberator, the process can impose horrendous costs on some groups and individuals. But more subtle tensions, in-ternal to our imagination of development, also need to be recognised. If one were forced to define the morals of contemporary India in a phrase, then “hy-per-instrumentalism” is as good a candidate as any. Any activity that produces material advancement is good, untethered to any sense of piety. For a soci-ety that was rigid and ritual-oriented, a prisoner of form and absolutism, this instrumental attitude can itself have overtones of rebellion, elevated to a new cultural form. Ekta Kapoor’s serials or their real-life correlate saga of the Mukerjeas, with their ultimate instrumentalisation of that last bastion of piety, the family, are more acute sociological barometers of hy-per-instrumentalism than most sociology tomes. But we should also remind ourselves of the joke about pragmatism — that it does not work in practice. For this hyper-instrumentalism has also corroded all the fixed points. Institutions and norms have also be-come transactional. The economist’s language of incentives has not just narrowed our understanding of human motivation; its institutionalisation as a common sense of development discourse can often corrode other forms of intrinsic motivations our so-ciety needs.

Hausfeld has coordinated various high-profile class action cases, including for companies affected by an air cargo pricing cartel, investors impacted by curren-cy-rigging by banks and firms fighting fees levied by MasterCard and Visa Europe. The law firm said the Google Redress & Integrity Platform (GRIP) is aimed at those affected by alleged anti-competi-tive behavior by Google in Europe. It said the plat-form would build on the European Commission’s April charge sheet, which accuses Google of un-fairly promoting its own shopping service to the disadvantage of rivals. “GRIP offers corporations, consumers and other entities harmed by Google’s anti-competitive business practices in Europe a mechanism to evaluate their potential claims,” Michael Hausfeld, chairman of Hausfeld, said in a statement. Bhikhabhai Papat, 55, a resident of Mangrol in Ju-nagadh district, has sown groundnut this year, but plans to also sow wheat on his five-acre field this winter too. Papat earlier grew only one crop a year, but for the past two years has been harvesting two. This was possible because of the well sealing project he took up on in his field. “Rainwater earlier flowed out on to the street, but with the help of the Coast-al Salinity Prevention Cell and Agakhan Foundation, I constructed a small 1.5 foot boundary wall along the field in such a way that the water gets channelized into the well,” says Papat. To ensure that rainwater doesn’t mix with brackish water, Papat has sealed the bottom of his 70-foot well with cement concrete and also lined the well. Rainwater in the field is collected in the well and is used to water the khar-if groundnut crop. In Oc-tober, when the water is

exhausted, farmers use the brackish groundwater for sowing wheat. “Wheat is grown with the brackish water,” says Papat. Gov-indbhai Lakhabhai, 60, says because of the water harvesting, he has been able to take two crops annually for the last two years and this increased his income. “I borrowed money from the local moneylenders, but have already repaid the loan.” He says that because of the sealing the bottom, the stored water doesn’t seep into the ground from the well. “The ground water here is very brackish and if the rain water is allowed to seep in, it also be-comes saline.” Lakhabhai doesn’t reveal his total in-come but says that he has bought two heads of cat-tle, worth Rs 50,000, also from the additional in-come. Ahmedabad With 10 new cases being registered in August and with the death of a five-year-old boy on Sunday, the city health department is bracing it-self for a fresh onslaught of the deadly H1N1 virus. This season, cases of both swine flu (caused by a strain of the H1N1 virus), and dengue have been ris-ing. In just four months since January, Ahmed-abad city alone saw 2,156 being affected by swine flu; 129 citizens lost their lives to the virus. The swine flu virus spread to 1,500 individuals in February and claimed 73

lives within the Ahmed-abad municipal limits. In March, nearly 600 peo-ple in the city were in-fected and 42 individuals succumbed to the viral disease. “Our aware-ness activities regarding swine flu will begin in the coming days in the city,” says a senior health of-ficial of the AMC. “The weather right now is one of the main reasons for the spike in the swine flu cases.” The swine flu outbreak has exposed the hollowness of the public health system in the state, especially in the matter of preparedness, and mon-itoring of drug stocks.

For the first time in Guja-rat’s epidemic history, the state had - on March 18 - registered the maximum number of swine flu cases and deaths in the country. Gujarat had overtaken Rajasthan, with swine flu cases reported from Jan-uary 1 touching 6,226. Rajasthan had 6,209 cas-es in the same period. Gujarat and Rajasthan together account for more than half of all swine flu deaths in the country. When the state govern-ment first released data compiled till mid-March, when the total swine flu cases in Gujarat were 5,800, it was found that 2,646 patients were men while 3,158 were women. More deaths were record-ed among women (197) compared to men (156). It was also found that 10 districts reported over 90% of the infections. Senior citizens were the worst affected with near-ly 50% deaths.
