1. Waarom deze brochure?

In deze brochure staat hoe u een visum kunt aanvragen.

Ook leest u wat u kunt doen om uw aanvraag voor een visum

goed te laten verlopen.

Vreemdelingendievooreenkortverblijf(maximaaldriemaan-

den)naarNederlandwillenreizenhebben,afhankelijkvan

hunnationaliteit,eenvisumnodig.Eenvisumiséénvande

voorwaardenvoorhetverkrijgenvantoegangtotNederlanden

deandereSchengenlanden(België,Denemarken,Duitsland,

Estland,Finland,Frankrijk,Griekenland,Hongarije,Italië,

Letland,Litouwen,Luxemburg,Malta,Noorwegen,Oostenrijk,

Polen,Portugal,Slovenië,Slowakije,Spanje,Tsjechië,IJsland,

ZwedenenZwitserland).Hetisookmogelijkdateenvisum

wordtbeperkttotéénofmeerdereSchengenlanden(territo-

riaalbeperktvisum).Indiegevallenishetverblijfalleentoe-

gestaanophetgrondgebiedvanéénofmeerdereaangewezen

Schengenlanden.

DeNederlandseoverheidtoetstofuinaanmerkingkomtvoor

eenvisumkortverblijf.Detoegangsvoorwaardenzijnterugte

vindeninde(Europese)SchengenUitvoeringsovereenkomst

endehierbijbehorendeGemeenschappelijkeVisuminstruc-

ties,deSchengengrenscodeenindeNederlandseVreemdelin-

genwet.

Houdt u er rekening mee dat de aanvraag veel tijd in beslag

neemt. Vraag een visum op tijd aan en boek uw reis nooit

definitief vóór u zeker weet of u het visum krijgt.

2. Voor wie is deze brochure

bedoeld?

Dezebrochureisbedoeldvoorvreemdelingendievooreen

periodevanmaximaaldriemaandennaarNederlandwillen

komenenafkomstigzijnuiteenvisumplichtigland.Welkelan-

denvisumplichtigzijn,leestuinbijlage1.Allepersonenmet

Alsudenationaliteithebtvaneenlanddatnietvisumplichtig

is(bijlage2)kuntuvrijinhetSchengengebied,waaronder

Nederland,verblijvenvooreenperiodevanmaximaaldrie

Let op!Alsumeerderenationaliteiten(enpaspoorten)bezit,

wordtdevisumplichtbepaalddoorhetreisdocumentwaar-

meeuwiltreizen.

Ukuntzelfkiezenmetwelkreisdocumentureist.Hetisvoor

deNederlandseoverheidnietvanbelangofureistophetpas-

poortvanhetlandwaaruwoont.Alsueenreisdocumentvoor

vreemdelingenenvluchtelingenhebt,datisafgegevendoor

derdelanden,danhebtuinprincipealtijdeenvisumnodig.

Hetmaaktdaarbijnietuitwatuweigennationaliteitisofwelk

landhetreisdocumentheeftafgegeven.Eenuitzonderinggeldt

voorpersonenmeteenreisdocumentvoorvluchtelingendatis

afgegevendooréénvandelidstatenvandeEU,éénvandelid-

statenvandeEER(Liechtenstein,NoorwegenenIJsland)of

Zwitserland.Indezegevallenhebtugeenvisumnodig.

3. Wat is een visum kort verblijf?

Eenvisumiseenstickerdiewordtaangebrachtinuwreis-

document(bijvoorbeeldeenpaspoort).Eenvisumgeeftaan

daterophetmomentvanafgiftegeenbezwaarbestaattegen

uwbinnenkomstvooreenkortverblijf.Hetvisumisgeldig

vooreenbepaaldeperiode(maximaaldriemaanden).

Hetbezitvaneenvisumisgeengarantiedatudaadwerkelijk

totNederlandwordttoegelaten.OpSchiphol,ofeenandere

grenspost,kanookcontroleplaatsvindenopuwreisdoelenuw

financiëlemiddelen.Neemaltijddebenodigdeinformatieen

documentenmeeopuwreisnaarNederland.Ditvoorkomt

vertragingenandereongemakkenaandegrens.Denkdaarbij

aaneenkopievande(gelegaliseerde)uitnodigingsbriefen

indienvantoepassing,eenkopievandegarantverklaringvan

uwreferentofgarantsteller.Watuverdermoetdoenbijaan-

komstinNederland,kuntulezeninhoofdstuk7.

Erbestaandriesoortenvisakortverblijf.

A-visum: transitvisum voor luchthavens

Vooreenaantalnationaliteitengeldtdetransitvisumplicht

voorluchthavens.Ditvisumisnodigalsutijdenseeninter-

nationalevlucht-naareenlandbuitenhetSchengengebied-

eentussenlandingmaaktopeenSchengenluchthaven

(bijvoorbeeldSchiphol).Umagtijdensdezetussenlandingde

internationalezonevandeluchthavennietverlaten.

Hettransitvisumvoorluchthavensgeeftdanookgeentoegang

tothetSchengengrondgebied.Indeel1vanbijlage3vindtude

lijstvanlandenwaarvandeonderdanenvooralleSchengen-

stateneentransitvisumnodighebben.Indeel2vanbijlage3

vindtuenkelelandenwaarvandeonderdaneniniedergeval

voorBelgië,NederlandenLuxemburgeentransitvisumnodig

hebben.

B-visum: doorreisvisum voor maximaal vijf dagen

Ditvisumisbestemdvoorvisumplichtigevreemdelingendie

inmaximaalvijfdagendoorhetSchengengebiedwillenreizen.

HuneindbestemmingligtineenlandbuitenhetSchengen-

gebied,waarvoordetoegangisgewaarborgd.

Hetdoorreisvisumkanafgegevenwordenvooréén,tweeof

meerdoorreizenvansteedsmaximaalvijfdagen.

C-visum: visum kort verblijf voor maximaal drie maanden

Eenvisumkortverblijfkanvoorverschillendedoelenworden

aangevraagd,bijvoorbeeld:vakantie,toerisme,zakenbezoek,

vrienden-offamiliebezoek,deelnameaancongressenof

sportevenementen.

Let op!Ineenperiodevanzesmaandenmageenvisumplich-

tigevreemdelingmaximaaldriemaandeninhetSchengen-

gebiedverblijven.Eenvreemdelingkanniet,nadathijdrie

maandenachtereeninNederlandisgeweest,bijterugkomst

aansluitendeennieuwvisumkortverblijfverkrijgen.

Anderszouersprakekunnenzijnvan‘verkapt’langverblijf

(verblijflangerdandriemaanden).Voorlangverblijfiseen

mvvvereist.

Let op!AlsumeteenvisumkortverblijfNederlandbentinge-

reisd,kuntuhiermeegeenverblijfsvergunningkrijgen.

Vooreenverblijfsvergunningmoetuterugnaaruwlandvan

herkomstoflandvanbestendigverblijfombijdeNederlandse

ambassadeofhetconsulaateenmvvaantevragen.

4. Algemene voorwaarden

Alsueenvisumkortverblijfwiltaanvragen,geldendevol-

gendealgemenevoorwaarden:

– Uwpaspoort(reisdocument)moetruimgeldigzijn.Ophet

momentvandeaanvraagmoethetpaspoortdriemaanden

langergeldigzijndanheteindevandevisumperiode.

– Umaggeengevaaropleverenvoordeopenbareorde,de

volksgezondheid,denationaleveiligheidofdeinternatio-

nalebetrekkingenvanéénvandeSchengenlanden.Bijhet

openbareordecriteriumspeeltondermeereenrolofu

eerderbentveroordeeldvoorofwordtverdachtvanhet

begaanvaneenstrafbaarfeit.Ookhetvoorkomenvan

illegaleimmigratie(vestigingsgevaar,tijdigeterugkeer

onvoldoendegewaarborgd)valtonderditcriterium.

Bijdebeoordelingofersprakeisvaneengevaarvoor

illegaleimmigratie,spelenmeerderefactoreneenrol.

Hierbijwordtbijvoorbeeldgekekenofualdannieteen

sterkesocialeen/ofeconomischebindinghebtmetuwland

vanherkomstoflandvanbestendigverblijf,maarookofhet

opgegevenreisdoelvoldoendeaannemelijkisgemaakt.

– Umaggeengevaarvormenvoorde(goede)internationale

betrekkingenenmagunietvermeldstaanopdelijstte

weigerenpersonen.

– Umoetovervoldoendemiddelenvanbestaanbeschikken.

Het land van bestendig verblijf is het land waar u langer

dan drie maanden legaal mag verblijven op grond van

een verblijfstitel of in afwachting van een verblijfstitel.

5. Welke documenten hebt u

nodig?

Alsueenvisumkortverblijfaanvraagt,hebtueenaantaldocu-

mentennodig.Umoetdezedocumentenbijhetindienenvan

deaanvraaglatenzien.Hetgaatondermeeromdevolgende

documenten:

– Geldig paspoort (reisdocument).

– Bewijsstukken ter onderbouwing van uw reisdoel.

DatkanbijvoorbeeldeendoordegemeenteinNederland

gelegaliseerdeuitnodigingsbriefvanvriendenoffamilie

zijn.Anderevoorbeeldenzijn:eenhotelreservering(alser

geenreferentisopgegeven),eenuitnodigingvaneenin

Nederlandgevestigdbedrijf(bijvoorbeeldbijeenzaken-

bezoek)ofeentewerkstellingsvergunning.Voorartiesten

geldtdatzijgeentewerkstellingsvergunningnodighebben

alszijkorterdanvierwekeninNederlandverblijven.

– Bewijsstukken die aantonen dat u voldoende middelen

van bestaan hebt voor uw verblijf in Nederland, doorreis

en/of terugreis.

Bijvoorbeelddooréénofmeerbankafschriftenofreis-

chequestelatenzienofmetcontantgeldaantetonendatu

overminimaal€34,-perpersoonperdagbeschikttijdens

deduurvanuwvisum.

– Een garantverklaring.

Ditiseenverklaringdateenfamilielidofeenandererelatie

garantstaatvooruwverblijfinNederland.Dezeisalleen

nodigalsunietovervoldoendemiddelenvanbestaan

beschikt.Deuitnodigendepartij(referentinNederland)of

eenderdemoetindatgevaleengarantverklaringinvullen

enondertekenen.Uitdezegarantverklaringmetbijbeho-

rendestukken(bijvoorbeeldrecenteloonstrookjesenkopie

arbeidscontract)moetblijkendatdegarantstellerovervol-

doendeenduurzamemiddelenvanbestaanbeschikt.

Dezeverklaringmoetubijdeambassadeofhetconsulaat

latenzien.Ondervoldoendemiddelenvanbestaanwordt

bedoeldminimaalhetminimuminkomenvoordecategorie

echtparenengezinnenvolgensdeWetWerkenInkomen.

Voormeerinformatieziewww.st-ab.nl.Bijgarantstellingen

voormeerderepersonenkunnenaanvullendeen/ofmeer-

deregarantverklaringenwordengevraagd.

– Bewijsstukken die aantonen dat u een toereikende

medische reisverzekering hebt (zie ook hoofdstuk 6).

Let op!Vooreentransitvisumvoorluchthavens(A-visum)

eneendoorreisvisum(B-visum)geldtgeenverplichte

medischereisverzekering.

– Reserveringsbewijs van de reis.

– Documenten die de terugkeer naar uw eigen land of

land van bestendig verblijf aannemelijk kunnen maken.

Bijvoorbeeldeenwerkgeversverklaring,inschrijvingschool-

gaandekinderen,eeneigendomsbewijseigenwoningen/of

overigeonroerendegoederen.

– Twee pasfoto’s.

Let op!Eenambassadeofconsulaatkanaltijdextradocumen-

tenofstukkenvanuvragen.

6. Aanvraagprocedure

EenvisumkortverblijfkuntuaanvragenbijdeNederlandse

ambassadeofhetconsulaatinuwland.Meestalisdithetland

-buitenhetSchengengebied-waaruwoont.

Let op!AlshethoofddoelvanuwreiseenanderSchengenland

isdanNederland,moetubijdeambassadevandatSchengen-

landdevisumaanvraagindienen.Voorbeeld:Uwiltvoor

familiebezoektweemaandennaarDuitslandendaarnaastwilt

uvoortweedagennaarNederland.Hethoofdreisdoelisindit

voorbeeldDuitsland.UmoetdanhetvisumbijdeDuitsever-

tegenwoordigingaanvragen.Alsnietisvasttestellenwelkland

hethoofdreisdoelis,danisdeambassadevanhetlandwaaru

heteerstnaartoereistbevoegduwaanvraaginbehandelingte

nemen.

Eenaanvraagvooreenvisumkortverblijfmoetupersoonlijk

opdeNederlandseambassadeofhetconsulaatindienen.

Vergeetnietdebijhoofdstuk5genoemdestukkenendocu-

mentenmeetenemen.

Boekuwreisdefinitiefalsudepositievebeslissingvande

Nederlandseambassadeofhetconsulaathebtontvangen.

Voordatuhetvisumkrijgt,wordendegeldigheidvanuwpas-

poortenhetbewijsvanuwgeboekteterugreisgecontroleerd.

Ubentverplichtomeentoereikendemedischereisverzekering

aftesluiten.Dezemoeteventueleuitgavenvoorrepatriëring

ommedischeredenenofdringendemedischezorg(bijvoor-

beeldspoedbehandelingineenziekenhuis)dekken.Umoetde

verzekeringafsluiteninhetlandwaaruuw(vaste)woon-of

verblijfplaatshebt.Demedischereisverzekeringmoetvoorhet

heleSchengengebiedgeldigzijneneenminimaledekking

hebbenvan€30.000,-.Demedischereisverzekeringmoetde

geheleduurvanhetverblijfgeldigzijn.Umoethetbewijsvan

deorigineleverzekeringspolisbijdeafgiftevanhetvisumlaten

zien.Wachtdaarommethetdefinitiefafsluitenvandever-

zekering,totdatuzekerweetdatuwvisumaanvraagisgoed-

gekeurd.

Geldigheidsduur van het visum

Hetvisumwordtinprincipeafgegevenvoordeduurwaarvoor

uhethebtaangevraagd.Ookwordtdedatumvanin-enuitreis

opuwvliegticketgecontroleerd.Hetaantaldagendatuinhet

Schengengebiedmagverblijvenisopdestickervermeldinde

rubriek‘duurverblijf’.Inderubriek‘vanaf’isdedatumver-

meldwaaropdegeldigheidvanhetvisumingaat.Vanafdiedag

maguhetSchengengebiedinreizen.Vóórdiedatumishet

visumnognietgeldig.Inderubriek‘tot’isdedatumvermeld

waaropdegeldigheidvanhetvisumeindigt.Nadiedatumis

hetvisumnietmeergeldig.ZodrauvoetopNederlandse

bodemzet,gaathetaantaldagentellendatinderubriek‘duur

verblijf’isingevuld.

Ookkanaangegevenstaanvoorwelklandofwelkelandenhet

visumgeldigis.Determ‘Schengenstaten’betekentdatuw

visumvoorhetgeheleSchengengebiedgeldigis.Determ

‘Benelux’geeftaandathetvisumalleengeldigisvoordeBene-

lux-landen.

7. Wat moet u doen bij aankomst

in Nederland?

AlsuinNederlandbentaangekomen,moetuzichbinnendrie

werkdagenmeldenbijdevreemdelingenpolitieindeplaats

waarutijdelijkverblijft.

Let op!Alsunietvoldoetaandezemeldingsplicht,bentu

strafbaar.

Bijverblijfineenhotelhoeftuzichniettemeldenbijde

vreemdelingenpolitie.AlsukorterdandriedageninNeder-

landbent,geldtdezeverplichtingookniet.

8. De kosten

Elkevisumaanvraagkostgeld.Krijgtugeenvisum,dankrijgtu

geengeldterug.Hetvisumbetaaltumeestalinlokalevaluta.

Inuitzonderlijkegevallen(alsdelokalemuntnietinwisselbaar

is)kuntuineenanderevalutabetalen.Informatiehierover

kuntukrijgenbijdeNederlandseambassadeofhetconsulaat.

Ookkunnenerextrakosten,diedeambassadevooruwvisum-

aanvraagmaakt,aanuwordendoorberekend.

De kosten

– Transitvisumvoorluchthavenpassagiers:€60,-

– Doorreisvisummaximaalvijfdagen:€60,-

– Visummaximaaléénmaand:€60,-

– Visummaximaaldriemaandenmetéénbinnenkomst:€60,-

– Visummaximaaldriemaandenmettweeofmeerdere

binnenkomsten:€60,-

– Verlengingmettenhoogstedertigdagen:€25,-

– Verlengingmetmeerdandertigdagentottenhoogste

negentigdagen:€30,-

– Wijzigingvisum:€35,-

Uitzonderingen

Devolgendecategorieënaanvragerskunnenkostelooseen

visumkortverblijfverkrijgen,mitszijvoldoenaandevoor-

waarden:

– kinderenonderdezesjaar;

– leerlingen,studenten,afgestudeerdestudentenenbegelei-

dendelerarendieeenreisondernemeninhetkadervan

studieofeeneducatievetraining;

– wetenschappelijkeonderzoekers;

– visumplichtigefamilieledenvan:

-eenburgervandeUnie;

-onderdanenvandeEER;

-onderdanenvandeZwitserseBondsstaat.

Let op!FamilieledenvanNederlanderszijnnietvrijgesteldvan

betalingvandekosten,behalvealsdeNederlanderzijnrecht

opvrijverkeeruitoefent.Gezinsledenvaneenpersoonmetde

Nederlandsenationaliteitdiegeengebruikheeftgemaaktvan

zijnrechtopvrijverkeer,komendanooknietinaanmerking

voorkostelozeverstrekkingvanvisa.

Nationaliteiten waarvoor het verlaagde tarief geldt

VoorlandenwaarmeedeEUeenvisumfacilitatieovereenkomst

heeftgeslotenofzalsluiten,geldthetverlaagdetariefvan

€35,-.HetbetrefthierdeRussische,Oekraïnse,Macedonische

(FYROM),Albanese,Bosnische,Montenegrijnse,Servischeen

Moldavischenationaliteiten.

9. Bijzondere omstandigheden

Erkunnenzichbijzondereomstandighedenvoordoendiehet

noodzakelijkmakendeduurvanuwverblijfinNederlandte

verlengen.Ditkunnenpersoonlijkeofhumanitaireredenen

(bijvoorbeeldernstigeziekte)zijn.Verlengingvandegeldig-

heidsduurvanhetvisumkanindiegevallenwordentoege-

staantoteentotaleverblijfsduurvandriemaanden.

Verlengingvandegeldigheidsduurvanhetvisumvandrietot

zesmaandenwordtslechtsbijuitzonderingeninzeerbijzon-

deregevallentoegestaan.Alsdegeldigheidsduurvanuwvisum

verlengdwordt,ishetalleengeldigvoordelandenBelgië,

NederlandenLuxemburg.Hierbijmagdetotaleverblijfsduur

dezesmaandennietoverschrijden.Hetverlengenvande

geldigheidsduurvanuwvisumkostgeld.

Vindtudatuinaanmerkingkomtvooreenverlenging,dan

moetucontactopnemenmetdeINDvia09001234561(€0,10

p.m.plusdekostenvoorhetbellenmetuwmobieletelefoon).

Vanuithetbuitenlandbeltu+31208893045(ditnummeris

vanuitNederlandnietbereikbaar).Daarbijinformeertde

medewerkerudirectoveruwkansenopinwilligingvanhet

verzoek.Mochtdemedewerkervanmeningzijndatu(moge-

lijk)inaanmerkingkomtvoorverlenging,danwordtinoverleg

metueenafspraakgemaakt.Afhankelijkvanuwverblijfplaats

wordtbepaaldnaarwelkIND-loketumoetkomen.Mochtde

medewerkeruhebbenuitgelegddatunietinaanmerking

komtvoorverlengingvandegeldigheidsduurvanhetvisum

danzal-ingevalutekennengeefthethierinhoudelijkniet

meeeenstezijn-alsnogdoordebetreffendemedewerkervoor

ueenafspraakwordengemaaktbijhetIND-loketvoorhet

indienenvaneenverlengingsaanvraag.Tegeneeneventuele

weigeringkuntuoverigensbezwaarmaken.Meerinformatie

hierovervindtuinhoofdstuk10.

Let op!ZonderafspraakwordtunietgeholpenaanhetIND-

loket.Alsueenafspraakhebt,betekentditnietdatdegeldig-

heidsduurvanuwvisumookverlengdwordt.

10. Bent u het niet eens met

de beslissing?

AlsuwaanvraagwordtafgewezendoordeNederlandseover-

heid,kuntuhiertegenbezwaarmaken.Namensukanuwwet-

telijkevertegenwoordiger,bijzondergemachtigdeofadvocaat

ditdoen.Alsuwreferentnamensueenbezwaarschriftindient,

moethijeendooruondertekendeschriftelijkemachtiging

kunnenlatenzien.Indebeschikkingwordtaangegevenhoeu

eenbezwaar-ofberoepschriftkuntindienentegendebeslis-

sing.Leesdebeschikkinggoeddoorenletinhetbijzonderop

determijnenwaarbinnenuuwbezwaar-ofberoepschriftmoet

indienen.Meestalmoeteengemotiveerdbezwaar-ofberoep-

schriftschriftelijkwordeningediendbinnenvierwekennade

dagwaaropdebeschikkingaanubekendisgemaakt.Umoet

eenkopievandebeschikkingmeesturen.Vooruitgebreide

informatiekuntuterechtbijdeadvocatuurofderechtshulp-

verlening.

11. Met welke instanties hebt

u te maken?

Nederlandse ambassade of consulaat

maken.

Garantverklaring

Eengarantverklaringwordtgevraagdalsonduidelijkisofde

vreemdelingzelfvoldoendemiddelenheeftominhetlevens-

onderhoudtevoorzientijdenshetverblijfinNederland.

Ookkanineenvisumprocedureeengarantverklaringgevraagd

wordenommeerzekerheidtekrijgenoverdetijdigeterugkeer

vandevisumaanvrager.Indegarantverklaringstaatdatde

kostendievoordeStaatofandereoverheidsinstellingenzijn

ontstaan,opdegarantstellervandevreemdelingwordenver-

haald.

Garantsteller

Degarantstellerisdepersoondiegarantstaatvoordevreem-

delingdieinNederlandverblijft.AlsdeNederlandseoverheid

kostenmoetmakenvoordezevreemdeling,kunnendezever-

This brochure tells you how to apply for a visa. It also

describes what you can do to ensure that your visa

application is correctly processed.

beinggrantedaccesstotheNetherlandsandtheother

Schengencountries(Belgium,CzechRepublic,Denmark,

3. What is a short stay visa?

Avisaisastickerwhichisattachedinsideyourtraveldocu-

ment(apassportforexample).Avisaindicatesthatatthe

momentofissuethereisnoobjectiontoyourenteringthe

countryforashortstay.Thevisaisvalidforafixedperiod

(maximumthreemonths).Possessingavisaisnoguarantee

thatyouwillactuallybeadmittedtotheNetherlands.

AtSchipholAirportorsomeotherbordercrossing-point,your

purposeoftravelandfinancialmeansmayalsobechecked.

Alwaystakethenecessaryinformationanddocumentswith

youonyourjourneytotheNetherlands.Thisavoidsdelaysand

otherinconvenienceattheborder.Examplesinthisregardare

acopyofthe(authenticated)letterofinvitationandwhere

applicable,acopyofthesponsordeclarationofthereferentor

sponsor.Chapter7describeswhatelseyouarerequiredtodo

whenyouarriveintheNetherlands.

Therearethreetypesofshortstayvisa.

A-visa: transit visa for airports

Forasomenationalitiesatransitvisaobligationforairports

applies.Thisvisaisneededifyoumakeastopoverata

Schengenairport(suchasSchiphol)duringaninternational

flighttoacountryoutsidetheSchengenarea.Youmaynot

leavetheinternationalzoneoftheairportduringsucha

stopover.Thetransitvisaforairportsdoesnotthereforegive

therighttoentertheSchengenarea.Inpart1ofappendix3,

youwillfindthelistofcountrieswhosesubjectsrequirea

transitvisaforallSchengencountries.Inpart2ofappendix3,

youwillfindalistofseveralcountrieswhosesubjectsrequirea

transitvisaforinanycaseBelgium,theNetherlandsand

Luxembourg.

B-visa: transit visa for a maximum of five days

Thisvisaisintendedforforeignerswhorequireavisaandwho

wanttotravelthroughtheSchengenareawithinamaximum

periodoffivedays.Theirfinaldestinationissituatedina

countryoutsidetheSchengenareatowhichaccessis

guaranteed.Thistransitvisamaybeissuedforone,two,or

moretransitjourneysoffivedaysatthemost.

C-visa: short stay visa for a maximum of three months

Ashortstayvisamaybeappliedforinrelationtovarious

purposes,suchas:vacation,tourism,businesstrip,visitto

friendsorfamily,participationinconferencesorsporting

events.

Please note!Aforeignerrequiringavisamaystayfora

maximumofthreemonthsintheSchengenareawithina

sixmonthperiod.AfterstayingintheNetherlandsforan

unbrokenthreemonthperiod,aforeignermaynotapplyon

hisreturnforanewshortstayvisaforaconsecutiveperiod.

Otherwisehewouldbestayingfora‘disguised’longperiod

(stayinglongerthanthreemonths).Foralongstay,anmvv

(provisionalresidencepermit)isrequired.

Please note!IfyouenteredtheNetherlandsbymeansofa

shortstayvisa,youcannotuseittoobtainaresidencepermit.

Toobtainaresidencepermityoumustreturntoyourcountry

oforiginoryourcountryofcontinuousresidencetoapplyfor

anmvvattheDutchembassyorconsulate.

4. General conditions

Ifyouwishtoapplyforashortstayvisa,thefollowinggeneral

conditionsapply:

– Yourpassport(traveldocument)mustremainvalidfora

longenoughperiod.Atthetimeofapplication,thepassport

mustbevalidforafurtherthreemonthsbeyondthedateon

whichthevisaperiodends.

– Youmustnotconstituteadangertopublicorder,public

health,nationalsecurityortheinternationalrelationsof

oneoftheSchengencountries.Constitutingadangerto

publicordermeans,forexample,thatyouhavebeen

sentencedfor,oraresuspectedof,committinganoffence.

Anotherpossibledangeristhatofyoursettlinginthe

Netherlandsillegally(residingillegallyintheNetherlands,

thereareinsufficientguaranteesthatyouwillreturntoyour

countryoforiginattheappropriatetime).Severalfactors

playaroleinassessingwhetherthereisariskofyour

settingintheNetherlandsillegally.Forexampleitwillbe

examinedwhetherornotyouhavestrongsocialand/or

economictieswithyourcountryoforiginorcountryof

continuousresidence,butalsowhetherthestatedpurpose

ofyourtripissufficientlyplausible.

– Youmustnotconstituteadangerto(good)international

relationsandyournamemustnotbeonthelistofpersons

toberefused.

– Youmusthavesufficientmeansofsupport.Formore

informationonthissubjectseechapter5.

– Youmustprovidesufficientevidenceofthepurposeofyour

trip.Formoreinformationonthissubjectseechapter5.

A country of continuous residence is a country in which a

person is permitted to reside for a period of more than

three months, by reason of entitlement to temporary

residence or pending entitlement to temporary residence.

5. What documents do you

need?

Whenapplyingforashortstayvisa,youneedanumberof

documents.Youmustshowthesedocumentswhensubmitting

yourapplication.Thedocumentsrequiredincludethe

following:

– Valid passport (travel document).

– Documentary evidence in support of the purpose of

your trip.

Thiscouldbealetterofinvitationfromfriendsorfamily

authenticatedbythemunicipalityintheNetherlands,for

example.Otherpossibleexamplesare:ahotelreservation

(ifnoreferenthasbeenindicated),aninvitationfroma

companyestablishedintheNetherlands(forabusiness

visitforexample),oraworkpermit.Artistsdononeeda

workpermitiftheyarestayingintheNetherlandsforless

thanfourweeks.

– Evidence showing that you have sufficient means of

support for your stay in the Netherlands, transit journey,

and/or return journey.

Showingyouhaveatleast€34perpersonperdayatyour

disposalforthedurationofyourvisa,bymeansofbank

statements,traveller’schequesorcashforexample.

– A sponsor declaration.

Thisisastatementthatafamilymemberorsomeother

relationissponsoringyourstayintheNetherlands.Thisis

onlyrequiredifyoudonothavesufficientmeansofsupport.

Inthatcasetheinvitingparty(referentintheNetherlands)

orathirdpartymustcompleteandsignasponsor

declaration.Thissponsordeclarationwithaccompanying

documents(suchasrecentwagesslipsoracopyofthe

employmentcontract)mustshowthatthesponsorhas

sufficientanddurablemeansofsupport.Youmustshow

thisdeclarationattheembassyorconsulate.

Sufficientmeansofsupportisunderstoodtomeanatleast

theminimumincomeforcouples/familiesaccordingtothe

6. Application procedure

YoucanapplyforashortstayvisaattheDutchembassyor

consulateinyourcountry.Usuallythisisthecountry-outside

theSchengenarea-whereyoulive.

Please note!Ifthemaindestinationofyourjourneyisa

SchengencountryotherthantheNetherlands,youmust

submityourvisaapplicationattheembassyofthatother

Schengencountry.Forexample:youwanttotraveltoGermany

fortwomonths,butyouwouldalsoliketovisittheNether-

landsfortwodays.Themaindestinationinthiscaseis

Germany.Youthereforehavetoapplyforyourvisafromthe

Germanrepresentation.Ifthemaindestinationofyour

journeycannotbedetermined,theembassyofthecountryto

whichyouwilltravelfirstisauthorisedtodealwithyour

application.

Youmustsubmitanapplicationforashortstayvisaatthe

Dutchembassyorconsulateinperson.Donotforgettotake

theitemsanddocumentsreferredtoinchapter5withyou.

Donotmakeadefinitivebookingforyourtripuntilyouhave

receivedapositiveanswerfromtheDutchembassyor

consulate.Beforeyoureceivetheactualvisa,thevalidityof

yourpassportandproofthatyourreturnjourneyhasbeen

bookedwillbechecked.

Youareobligedtotakeoutadequatemedicaltravelinsurance.

Thismustcoveranyexpenditureforrepatriationonmedical

groundsorurgentmedicalcare(suchasurgenttreatmentina

hospital).Youmusttakeouttheinsuranceinthecountry

whereyouhaveyour(permanent)placeofresidence.

Themedicalhealthinsurancemustbevalidfortheentire

Schengenareaandprovideminimalcoverageof€30,000.

Themedicaltravelinsurancemustbevalidfortheentire

durationofyourstay.Youmustshowproofoftheoriginal

insurancepolicywhenthevisaisissued.Youshouldtherefore

waituntilyouaresureyourvisaapplicationhasbeen

approvedbeforefinalisingyourinsurancepolicy.

ticketarealsochecked.Thenumberofdaysyoumaystayin

theSchengenareaisstatedonthevisastickerinthesection

‘duurverblijf’(durationofstay).Thedateonwhichthevisa

firstbecomesvalidisstatedinthesection‘vanaf’(from).

YoumaytravelintheSchengenareafromthisdateonwards.

Thevisaisnotvalidbeforethisdate.Thedateonwhichthe

visaceasestobevalidisstatedinthesection‘tot’(to).

Afterthisdatethevisaisnolongervalid.Thenumberofdays

indicatedinthesection‘duurverblijf’arecountedfromthe

momentyousetfootonDutchsoil.

Thevisamayalsostatethecountryorcountriesforwhichitis

valid.Theterm‘Schengenstaten’(SchengenStates)meansthat

yourvisaisvalidfortheentireSchengenarea.Theterm

‘Benelux’indicatesthatyourvisaisonlyvalidfortheBenelux

countries.

7. What should you do on

arriving in the Netherlands?

WhenyouarriveintheNetherlands,youmustreporttothe

AliensPoliceatthelocationwhereyouarestayingwithinthree

workingdays.

Please note!Ifyoufailtofulfilthisobligation,youareliableto

punishment.

Ifyouarestayingatahotelhowever,youdonothavetoreport

totheAliensPolice.Norareyouobligedtodosoifyouwillbe

stayingintheNetherlandsforlessthanthreedays.

Everyapplicationforavisacostsmoney.Ifyouarenotgranted

avisa,youwillnotgetanymoneyback.Usuallyyoupayfor

yourvisainthelocalcurrency.Inspecialcases(ifthelocal

currencyisnotconvertible)youmaypayinadifferent

currency.Informationonthismattercanbeobtainedfromthe

Dutchembassyorconsulate.Youmayalsobechargedforany

extracostsincurredbytheembassyorconsulateinconnection

withyourvisaapplication.

exemptfrompayingcosts,exceptwheretheDutchcitizenis

exercisinghisorherrighttofreemovement.Familymembers

ofapersonofDutchnationalitywhohasnottakenadvantage

ofhisorherrighttofreemovementarethereforealsonot

eligibletoreceiveavisafreeofcharge.

Nationalities to which the reduced fee applies

Thereducedfeeof€35appliestocountrieswithwhichthe

EUhasconcludedorwillconcludeavisaagreement.

Thisconcernsthefollowingnationalities:Russian,Ukranian,

Macedonian(FYROM),Albanian,Bosnian,Montenegrin,

SerbianandMoldavian.

9. Exceptional circumstances

Exceptionalcircumstancesmayarisewhichmakeitnecessary

toextendthedurationofyourstayintheNetherlands.

Thesemaybepersonalorhumanitarianreasons(serious

illnessforexample).Inthesecases,itmaybepermittedto

extendthedurationofthevalidityofthevisa,uptoa

maximumdurationofstayofthreemonths.Extendingthe

durationofthevalidityfromthreemonthstosixmonthsis

onlypermittedinveryexceptionalcircumstances.Ifthe

durationofthevalidityofyourvisaisextended,thisextension

isonlyvalidforthecountriesBelgium,theNetherlandsand

Luxembourg.Inthatcasethetotaldurationofyourstaymay

notexceedsixmonths.Afeeispayableforextendingthe

durationofthevalidityofyourvisa.

Ifyouthinkyouareeligibleforanextension,youshould

fromamobilephone).Whencallingfromabroadyoucanuse

the decision?

IfyourapplicationisrejectedbytheDutchgovernment,you

maylodgeanobjection.Yourlegalrepresentative,oraperson

withspecialpowerofattorney,orlawyer,maydothisonyour

behalf.Ifyourreferentsubmitsanobjectiononyourbehalf,he

mustbeabletoshowawrittenauthorisationsignedbyyou.

Thedecisiononyourvisaapplicationwillincludeadescription

ofhowyoucansubmitanobjectionorappealagainstthe

decision.Readthedecisioncarefully,andnoteinparticularthe

periodswithinwhichyourobjectionorappealmustbe

submitted.Usuallyanobjectionorappealmustbesubmitted

inwriting,completewitharguments,withinfourweeksofthe

dayonwhichthedecisionwasmadeknowntoyou.Youmust

sendacopyofthedecisiontogetherwithyourobjectionor

Sponsor declaration

Asponsordeclarationisrequestedifitisnotclearwhetherthe

foreignerinquestionhassufficientmeansofsupportduring

thestayintheNetherlands.Asponsordeclarationmayalsobe

requestedduringavisaprocedure,toobtaingreatercertainty

aboutthetimelyreturnofthevisaapplicant.Thesponsor

declarationstatesthatcostsincurredbytheStateorby

governmentinstitutionswillberecoveredfromthesponsorof

theforeigner.

Schengen

In1985and1990severalmemberstatesoftheEuropean

UnionsignedtheSchengenConventionandtheSchengen

ImplementationAgreement.Amongotherthingsthis

agreementprovidedforthefreemovementofpersonsinthe

so-calledSchengenarea,consistingofBelgium,Czech

Republic,Denmark,Estonia,Germany,Finland,France,

Greece,Hungary,Italy,Latvia,Lithuania,Luxembourg,Malta,

theNetherlands,Norway,Austria,Poland,Portugal,Slovakia,

Slovenia,Spain,Iceland,SwedenandSwitzerland.

Schengen visa

WiththecomingintoforceoftheSchengenConvention,a

Schengenvisawasalsointroduced.Withthisshortstayvisaor

C-visa,aforeignermaytravelfreelyinsidetheterritoryofall

theSchengencountries.InprincipleaSchengenvisaisvalid

foramaximumofthreemonths.

Astandardformwhichcanbeobtainedfromthemunicipalities

intheNetherlands.ThereferentintheNetherlandsappliesfor
