Even in this situation, as his life hangs on the slender thread of a fresh mercy plea to the President, is the irreversible and inhuman sentence of death the only recourse for a democrat-ic government? Carrying out the sentence will only have the appearance of a justice that is retributive and vengeful, not substantial or morally different from the very offence that gave rise to the proceedings. In recent times, we saw the horrific judicial murder of Afzal Guru, who was hanged in secret without a final opportunity for his family to meet him, marking an unprecedented abandonment of morality on the part of the state. It was only in apparent cognisance of this that the Supreme Court ruled early last year that a formal communication to the convict and his fami-ly, intimation to the local legal aid centre and a clear gap of 14 days between the communication and the execution were necessary. Further, there are bound to be questions each time someone is hanged or spared. Even in the Mumbai blasts case, the 10 men sentenced to death by the trial court for planting the explosives were given only life terms by the Supreme Court on appeal, while Yakub Memon alone was awarded the death penalty. Such distinctions may seem arbitrary to the layman. As also, the revelation that the Memon family may have been induced to return to India will cast a shadow on the legitimacy of hanging a man who cooperated with Indian agencies. The debate on the need and desirability of retaining the death penal-ty has been overshadowed by much intellectual exer-tion on the nature of the crime involved, its gravity, its heinousness and the fatalities it caused. The time has come to end this debate once and for all by ascending to a moral position that there shall be no death penalty on the statute book, regardless of the heinousness of the offence, the circumstances or the number of fatal-ities involved. Anyone following closely the evolu-tion of the law on death sentences and the clemency jurisdiction in India will understand that the Supreme Court is making it more and more difficult for the ex-ecutive to carry out death sentences. It has evolved a jurisprudence that limits capital punishment to the ‘rarest of rare cases’, allowed a post-appeal review as well as a curative petition, and made decisions on ap-peals for mercy justiciable. It has laid down a cast-iron rule against undue delay in disposing of such mercy pleas, and it has humanised the process by repeatedly intervening in favour of condemned prisoners, often at the very last minute. A truly lasting solution to the moral dilemma that each instance of capital punish-ment poses will be to abolish it altogether and replace it with a sentence of imprisonment for the rest of the convict’s life. The quality of mercy is not strained. The President, under Article 72 of the Constitution, has the power to grant pardon, and to suspend, remit or commute sentences.

Nestle India, the subsid-iary of Swiss food giant Nestle SA, slipped to a second-quarter loss as sales plunged after its hugely popular Maggi noodles were pulled off shelves over safety con-cerns. Nestle India report-ed a net loss of Rs 64.4 crore in quarter ended June 30 as compared with a profit of Rs 288 crore in the year-ago period. Nes-tle’s sales declined over 19 per cent to Rs 1,957 crore as against Rs 2,432 crore year-on-year as the company had to reverse revenues of Rs 288 crore due to withdrawal of its popular Maggi noodles from the market. Maggi

is estimated to contribute 20-25 per cent to Nestle India’s total sales. Nestle India also incurred a one-time loss of Rs 452 crore in the April-June quar-ter. Domestic brokerage Nirmal Bang in a note to clients said, Nestle In-dia’s Q2 earnings are be-low estimates even after adjusting for the Maggi noodle impact. “Even af-ter adjusting for Maggi noodle reversal of Rs 288 crore, net sales of Nestle India declined in the June quarter. Shares of Nestle India, which has a market value of above Rs 60,000 crore, have slumped 12 per cent since mid-May amid the Maggi contro-versy.

Public sector Dena Bank’s net profit plunged 81.4 per cent to Rs 15.16 crore in the first quarter ended June 30 on a sharp rise in bad loans. The public sector lender’s net profit in the same quarter of last fiscal, 2014-15, was at Rs 81.52 crore. The steep fall was at-tributed to a sharp rise in non-performing assets (NPAs) and consequent-ly a higher allocation to-wards provisioning. Its income increased mar-ginally by 3.2 per cent to Rs 2,914.87 crore in the first quarter of 2015-16,

as against Rs 2,824.58 crore in the year-ago pe-riod, Dena Bank said in a BSE filing. The asset quality deteriorated fur-ther as gross NPAs or bad loans shot up to 6.2 per cent of gross advanc-es during the quarter under review as against 4.21 per cent a year ago. Its net NPAs too rose further to 4.24 per cent from 2.94 per cent of net advances. Thus the pro-vision towards bad loans and contingencies was raised by over 42 per cent to Rs 324.75 crore during the quarter, from Rs 228.06 crore a year ago.

The IT ministry has objected to a provi-sion in the Bill which allows authorisation of interception of telephone conversations and their admissibility as evidence before a court of law. The Ministry of Home Af-fairs (MHA) had sent the Bill to the IT ministry as part of inter-ministerial consultation. Heavy rains in north and central Gujarat claimed more lives on Wednes-day, taking the total toll in the state to at least 27 since Tuesday. Banaskan-tha, Patan and Mehsana districts are the worst-af-fected, besides Kutch. Banaskantha alone re-ported nine more deaths on Wednesday. As rains eased off a bit, three he-licopters from Indian Air Force (IAF) and Border Security Force (BSF), along with 15 teams —

comprising 510 trained NDRF personnel and 180 jawans of the BSF — conducted relief and rescue operations in north Gujarat where hundreds of villages remained ma-rooned due to large-scale flooding. Seven columns of the Indian Army have also been sent to Banas-kantha. The NDRF teams, with 57 rubber boats, have been deployed at various flood-affected parts of the state, like Suigam (one team), Dee-sa (two teams), Hahara (one team), Banaskantha

(two teams), Bhuj (one team) and Ahmedabad (four teams). Further two teams of NDRF are being airlifted from Bhisinia airfields to Gandhinagar and two teams from Pune airport to Ahmedabad. So far, NDRF teams have evacuated 283 persons (including 111 persons at Varun village and 87 persons at Chatara vil-lage) from affected areas of Banaskantha district to safer place, stated an offi-cial release. Among those rescued include 24 people stranded inside a GSRTC

bus near Shankeshwar in Patan district where ris-ing flood waters had sub-merged the bus. Those stranded were airlifted. Two helicopters from the Indian Air Force and one from Border Security Force are being deployed. They have been rescuing people from 21 marooned villages in Banaskantha.
