The two judges, who had confirmed the conviction, gave a split verdict on the punish- ment for Ansals and the matter was then placed before the three-judge bench. In 2007, the trial court sentenced the An- sal brothers to two years in jail but next year the Delhi High Court re- duced the sentence by half. QUOTE OF THE

DAYdeath for the nation-state is valorisedNation-states and religion are the only two ideolo-gies that both regulate and consecrate the meaning of death. This also makes them competitors. The ultimate exercise of sovereignty by the state is its claim to determine the conditions under which death is permissible. It also decides what forms of dying can be given public meaning — death for the na-tion-state is valorised. Any other attempt to deter-mine the conditions under which we die is a usur-pation of sovereignty, and other public meaning or consecration of forms of dying need to be eviscer-ated. Even the difference between what is religious and what is secular is not an antecedently given distinction; it is a distinction internal to the exercise of sovereignty. The state decides what is religious and what is not; it even decides what is essential to religion. These decisions sometimes wear the garb of neutrality. But the state’s own view of dying and death often carries unconscious theological baggage it regards as neutral. Certainly the IPC has traces of a Christian view of life and dying. It cannot even contemplate alternative modes in which that event in life has been imagined. It is not surprising, therefore, that in Nikhil Soni vs Union of India, the Rajasthan High Court has concluded that the Jain practice of santhara or sallekhana shall be considered a crim-inal offence under Section 309 of the IPC, which provides for punishment for attempted suicide, and Section 306, which provides for punishment for abetment of suicide. Sallekhana is the Jain practice of withdrawing from taking food, under some very special circumstances, as a way of subduing all pas-sions that cause himsa and preparing for a purified passage into the death state and beyond. The theo-logical issues are complex. There are varieties of santhara, from a willed long fasting to a short-lived ritual withdrawal from food under conditions of ex-treme distress. It is often now used in a token sense to give significance to the last moments of cancer patients at the edge of death. The conditions under which it can be undertaken and the forms of super-vision for this practice have also evolved historical-ly. Some of this is wonderfully captured in Shekhar Hattangadi’s documentary on the subject. The exis-tential pathos and struggle of trying to subdue all passions prematurely was brilliantly dramatised in Ship of Theseus. The court, in a remarkably perfunc-tory treatment, has dismissed this practice. It claims, dubiously, that it is not essential to Jainism. The sub-duing of all desire is the central thread of Jainism; this is merely one expression. The “essential practic-es” test is a piece of contorted chicanery. It implies that if a practice were “essential” but morally wrong, it could not be regulated, and it takes away the be-liever’s autonomy to decide what is essential.

“The population (of uttar Pradesh) is 21 crore while that of Madhya Pradesh is 6 crore. There (in MP), the percentage of rape cases is 9.8 while in uP, it is 2. Moreover, in Rajasthan — also ruled by BJP — this percentage is 7. Don’t even ask about Delhi, I live there and know what happens. Telugu-Tamil blockbust-er Baahubali’s 300-style VFX broke new ground in Indian cinema and two Diwalis from now, it will be joined by Ajay Devgn’s new film Sons of Sardaar. Sons of Sardaar sounds like a sequel to the 2012 film Son of Sardaar that Ajay pro-duced and starred in, but the only thing the two films will have in com-mon is the similarity of name. Unlike the origi-nal action comedy, Sons

of Sardaar will be based on a page from the histo-ry books and will tell the story of the 21 Sikhs who fought to death in the 1897 Battle of Saragarhi. On September 12, 1897, a 21-strong contingent from what is now the Sikh Regiment defended an army post in the North West Frontier Province against 10,000 Afghan tribesmen. All 21 Sikh soldiers fought to death, shouting the battle cry of “Jo Bole So Nihal, Sat Sri Akal.” They posthumous-

ly received the Indian Or-der of Merit, which was British India’s equivalent of the Param Vir Chakra and Saragarhi Day is cel-ebrated every September 12 in Sikh communities around the world. De-tails about the planned film are yet unknown. Ajay Devgn already has experience with histori-cal subjects, having won a National Award for his performance as the titular freedom fighter in 2002’s The Legend of Bhagat Singh.

After months of specula-tions, the filmakers have finally confirmed that Fugly actor Kiara ad-vani will play the role of Sakshi Dhoni in MS Dho-ni: The Untold Story. Ear-lier, the rumours were that Parineeti Chopra and Alia Bhatt were in the running to play the Indian cricket captain’s wife. But, Kiara Advani has been finalised by Neeraj Pandey. Ac-cording to Bombay Times report, a source close to

the project confirms, “It was quite challenging to find the right girl to play Sakshi as people at large have seen her quite fre-quently on television and in person, so they would tend to compare. Neeraj was clear that he wanted a young actress in this biopic. He didn’t wish to cast a leading lady who has done many roles be-cause he didn’t want the audience to have a pre-conceived notion or form an impression about her.

He basically wanted an actor without baggage.” Kiara will be paired op-posite Sushant Singh Ra-jput, who will play Dhoni in the biopic. Reportedly, the chemistry between her and Rajput during the audition is said to have been what made her land the role. MS Dhoni: The Untold Story traces Dhoni’s inspirational rise from humble beginnings in Ranchi to an icon. The film is slated to release on October 22 this year.

The global e-commerce industry generates over $1.2 million (roughly Rs. 7.9 crores) in revenue ev-ery 30 seconds with Facebook, Pinterest and Twit-ter contributing $5,483 (roughly Rs. 3,57,800), $4,504 (roughly Rs. 2,93,904) and $4,308 (roughly Rs. 2,81,114) respectively, says a joint study by As-socham-Deloitte. Social networks are contributing significantly to the growth of e-commerce business revenue. The maturity of social media and its reach across the masses and classes makes it a suitable platform for online sales, said the study which was released here on Wednesday. Social media pages provide information regarding new products in the market, user reviews and ratings of the product, recommendations, and information technology (IT) products. “Social media also helps e-tailers build brand awareness by responding to custom-er queries. Seasonal sales and offers are displayed on social networks to reach maximum number of people.

They are 1-0 down and trying to avoid a series loss. They are up against a team who is preparing to give its beloved son a grand send-off. It doesn’t get tougher than this for India as they take on Sri

Manchester United’s Dutch manager Louis van Gaal said he want-ed to ‘kiss’ midfielder Memphis Depay after he scored two goals and set up another in his side’s 3-1 Champions League play-off win over Club Brugge at Old Trafford on Tuesday. United went behind to an eighth-min-

ute Michael Carrick own goal in the first leg, but Depay scored two su-perb goals before teeing up substitute Marouane Fellaini for an inju-ry-time header that put Van Gaal’s team firmly in control of the tie. A 2-1 win would have given the Belgian side real hope of turning the tie around in Bruges next Wednesday and after seeing Depay

set Fellaini up for the cru-cial third goal, Van Gaal declared, “I want to kiss him tonight.” The line, however, was part of an answer in which Van Gaal explained his reluctance to single out individual players for praise and the United manager said that Depay’s true value to the squad could be seen in the example he set for his younger team-mates.

Raina is working on his fitness and spending qual-ity time in the nets facing Dutch medium fast bowl-ers on the synthetic pitch-es. Determined to make a strong start in the next domestic season, India batsman Suresh Raina is presently undergoing a month-long high intensi-ty training at the synthet-ic pitches of Amsterdam Cricket Club (ACC) in the Dutch capital. Raina, who is currently on a vacation with his newly-wed wife Priyanka in The Neth-erlands, is training with the Dutch national team, which has recently quali-fied for the ICC Twenty20 World Cup to be held in India next year. “With the new season around the corner, I am deter-mined, hungry and eager to play the highest form of the game for India,” the 28-year-old left-hand-ed middle-order told PTI from Amsterdam. “It is wonderful to be able to

Our mindset will be the same.” Shastri told reporters. “The en-deavour of this team is to play fearless cricket that comes with mindset. These boys have enough talent.” While they may have enough talent, they certainly struggle against spin. Fifteen of the 20 India batsmen fell to Sri Lanka’s spinners in the first Test and this is a big worry for the visi-tors. First it was Moeen Ali, then Nathan Lyon and now Rangana Herath and Tharindu Kaushal have tormented the In-dian batsmen. The key to India’s chances will depend on how well they play spin.

Ashes: Michael Clarke splits opinion right until the end

Australia`s Michael Clarke will retire from international cricket af-ter the fifth Ashes Test against England, starting on Thursday, with a bril-liant record but strange-ly lacking the universal praise his figures might suggest. Only three Aus-tralia have scored more runs than Clarke -- who has battled a chronic back condition throughout his career -- and the outgo-ing captain is also the only Australian to score a hundred on both his home and away Test debuts. Yet Clarke won`t bow out

On Preity Zinta’s report-ed comments about some Kings XI Punjab players

being allegedly involved in suspicious activities, Shukla said nothing was discussed in that regard. “I think Preity Zinta has already clarified in her statement. Nothing of this sort has been discussed.” Citing anonymous sourc-es, the story claimed that Zinta pulled up players who she thought weren’t playing fair, dropped them from games and even put them up for auction.

After Patel communi-ty, Brahmins in Gujarat have mounted pressure on state government by seeking reservation in education and jobs for their economically weaker members. The community members have also threatened to launch a statewide agita-tion if their demands are not met. After holding meeting with the repre-sentatives of 400 sub-castes of the community, the All Gujarat Brahm Samaj has prepared an agenda of their demands, which includes reser-vation to economically weaker members. Their other demands include setting up of a board to look after economically

weaker Brahmins, reser-vation to Brahmin stu-dents in education sector among others. “Because of the current reservation system, Brahmins have suffered a lot and are left behind others. Reserva-tion system was meant only for some years after we gained independence. But, politicians contin-ued this system till today to secure their vote banks. This has to come to an end now,” Brahm Samaj president Shailesh Joshi told reporters at a press conference here. Accusing Prime Mnister Narendra Modi of prac-ticing “double standard”, Leader of Opposition in the Gujarat Assembly Shankersinh Vaghela on Tuesday said that while he refused to wear Mus-lim skull-cap in Ahmed-abad during his ‘sad-bhavna’ fasts, he went to Abu Dhabi’s Jama Masjid just to attract in-vestments in India. “This nothing but double stan-dard and highly shame-ful,” remarked Vaghela.

Regarding Modi’s claim that Abu Dhabi’s rulers announced to allocate land for a temple in Du-abi, Vaghela said that the land in question was in fact gifted to the Swa-minarayans by an Arab businessman in 2013 and it was in the process of being handed over for the temple. “But Modi pro-jected it in such a man-ner as if the UAE gov-ernment gave the land in his honour. Gujarat high court has re-strained Rajasthan-based tea manufacturer from us-ing the trademark ‘Sher Bakri’ after Ahmed-abad-based ‘Wagh Bakri’ tea producer alleged in-fringement of its trade-mark rights. After hear-ing the case, Justice Akil Kureshi of the high court ordered Bhagaram Gan-chi not to sell his product under ‘Sher Bakri’ brand until final disposal of the case. However, the judge also stayed operation of his order till September 15 so that the aggrieved par-ty can move the Supreme Court. According to case details, Bhagaram Ganchi has been selling his tea un-der the brand name, ‘Sher Bakri’, since late 1996. He even got it registered as

trademark of his product. When the owners of ‘Wagh Bakri’ — Gujarat Tea De-pot Company and Gujarat Tea Processors & Packers Ltd — came to know about this, they first objected to registration of the trade-mark. They argued that this was an infringement of their trademarks rights as they too had ‘Wagh Bakri’ name and logo registered as ‘Sher Bakri’ (translation of Wagh Bakri in Hindi.) Last year, Wagh Bakri tea owners had moved a city court requesting it to stay Ganchi from selling his tea under the brand name that was similar to theirs. But the court refused to order a stay on the ground that Ganchi had been selling tea since 1996 and Wagh Bakri owners had obtained registration of ‘Sher Bakri’ trademark in 2004.

As the Gujarat govern-ment makes mental health a part of its School Health Programme, among the questions it is asking are on a child’s gender identi-ty. A detailed seven-page questionnaire prepared for parents and teach-ers deals with 16 men-tal diseases. It also in-cludes questions such as “whether a boy behaves like a girl” and “a girl like a boy”, “whether a girl expresses her wish to be a boy and a boy express-es his wish to be a girl”, and “whether a child gets consumed in thoughts of his/her gender most of the times”. The respondents can choose answers rang-ing from “not true” to

“always true”. The “Men-tal School Health Pro-gramme” is being touted as the first such initiative for schoolgoing children between the ages of 4 and 16 years. The module running into 32 pages is to be launched by the Gu-jarat health department in close coordination with the education department. The questions for the mental health programme were framed by experts, said Commissioner, Health, J P Gupta. “They have a far better under-standing of a child’s men-tal health condition. I am sure these must have been added with some valid reason.” The “mental dis-eases” identified by the government and covered by the module include

any community solely on the criterion of econom-ic condition in future. “Thus, we want the gov-ernment to change this system and introduce a system which is based on economic condition, not on castes. We be-

lieve that anyone who is financially weak should get reservation, includ-ing Brahmins. Our chil-dren could not get good education or jobs just because of the current reservation system,” said Joshi.

Thus, it is better if we identify such cases at an early age and offer them medical and psychiatric support. Oth-er mental traits like de-pression and anxiety can also be related to such a gender identity disorder.”

Across the city and country, wherever Ganesh Chaturthi is celebrated by installing idols, sculptors begin work in April-end or May. Hitesh Joshi, a member of the mandal constituted by idol makers in Vadodara, said the sculpting work would continue as usual. Joshi said, “We have held a meeting and decided to discuss this issue with the Commissioner of Police.

It is common knowledge that by this time most sculptors have taken or-ders for idols and complet-ed them too. The prohibi-tory order seems to have been issued only to help a particular political party take advantage of the is-sue by coming forward to resolve the matter. More-over, they have arrested the small sculptors and not those who make idols for popular pandals of the city that are patronised by political leaders,” Joshi said. Commissioner of Po-lice, E Radhakrishana said that the police department was organising area-wise meetings and dialogues with Ganesh mandals to seek their cooperation in the interest of the city.
