QUOTE OF THE

DAYAn all-India judicial service will ensure transparency

After striking down the National Judicial Appoint-ments Commission (NJAC) as unconstitutional in 2015, the five-judge constitution bench of Justices JS Khehar, Jasti Chelameswar, MB Lokur, Kurian Joseph and Adarsh Kumar Goel explored alter-natives to make the Supreme Court’s collegium system, which appoints judges to the nation’s con-stitutional courts, transparent. The court sought suggestions from the public and the response was overwhelming. There are many who have ques-tioned the SC’s decision to ask for suggestions, but what is significant is that the issue of transparency in judicial appointments is finally being debated across the country. While it is no longer possible for nepotism and favouritism to sneak into judi-cial appointments, vested interests are still trying their best to promote their own since there are vacancies in the Supreme Court and high courts (nearly 40%). They are trying to push the agenda of the old non-transparent appointment process through the collegium system. This should be stopped by the Supreme Court. Vacancies might be affecting the criminal justice system but pen-dency and vacancies cannot justify non-transpar-ent appointments. Even when there were fewer number of vacancies, the performance of the ju-diciary in clearing outstanding and pending cas-es was not extraordinary. While it is important to ensure that we have a mechanism for speedy dis-posal of cases, the most important thing is to en-sure a transparent appointment mechanism of the higher judiciary. This mechanism must be thor-oughly examined and a proper procedure should be first put in place before any appointments are made. To avoid wrong appointments, the govern-ment in consultation with the chief justice of must introduce an all-India judicial service. This will go a long way towards attracting the brightest and the best talent available in the country. This is a five-decade-old demand but it has not been imple-mented on account of vested interests both in the political and judicial systems. Their intention is to perpetuate nepotism and favouritism in judicial appointments. This goes against objectivity, fair-ness, sensitivity and professional approach to the judiciary’s working. Several people have asked the Centre and Supreme Court for such a service but it appears that the judiciary is taking advan-tage of a divided Parliament to push its agenda of perpetuating judicially-sponsored appointments.

In my last column, I had written at length about Rohit Sharma and Virat Kohli, the two batting lynchpins around whom India will launch their campaign at the World T20. There is a three-man component that will influ-ence the bowling group too, spearheaded by the experienced Ashish Nehra with the admirable Ravi-

chandran Ashwin and the ebullient Jasprit Bumrah for company. Nehra’s is a stirring tale of determi-nation and courage. He is the most experienced fast bowler in international cricket at the moment — he made his Test debut in 1999 against Sri Lan-ka — but his somewhat fragile body has contrib-uted to him not playing as much international crick-

Citing history, Pakistan coach Waqar Younis on Tuesday reasoned that no team can be labelled as favourites in the World Twenty20 due to the un-predictability attached with the format. “You play well in the three weeks and win the World Cup. I will not tag anyone as fa-

Former Pakistan cap-tain Muhammad Yousuf has picked India as the strong contender to win the ICC World Twen-ty20 as he feels the home team has the batting fire-power. Yousuf pointed out that there were high scoring matches in the WT20 qualifying round for associate teams and in warm-up games, and said it would be no different in

the main round of the me-ga-event as well. “India are a strong contender be-cause their batting is very strong and they are capa-ble of chasing big totals down. Even in the warm up match against South Africa they fell short by 4-5 runs, chasing a total of 190 plus,” said You-suf. ”Their other advan-tage is they are playing at home. Farmers of 22 villages in Dholera taluka have called for the scrapping of the Special Investment Region (SIR) planned there and decided to hold a protest rally to press their demand. Under the banner of Akhil Bhartiya Koli Samaj (ABKS), the Gujarat chapter of which is headed by Congress leader and former MP Kunvarji Bavaliya, the farmers will hold a rally at Dholera on April 24 de-manding denotification of Dholera SIR. Nearly one

lakh farmers are expected to participate in the pro-test, organisers claimed. “The Dholera SIR covers 920sq.km of land which includes agricultural land belonging to farmers in 22 villages. The Gujarat SIR Act of 2009 provides power to the state gov-ernment to acquire land from farmers without due compensation, and we are protesting against that,” Bavaliya told reporters here. He claimed that un-der the Act, the state gov-ernment acquires half of a farmer’s land for free and

Nehra always harboured hopes of a comeback even when the national selectors seemed to look elsewhere. He did bowl excellently in 2008 and 2009 to make his way back into the Indian team, and was a vital cog during the 2011 World Cup, where he injured himself in the semi-final against Pakistan and did not play for India again until the Twenty20 International series in Australia earlier this year.

The only oth-er way we can do well is for our bowlers to suc-cessfully defend totals in the range of 140-150 or bowl out opposing teams for under par scores,” Yousuf said. “We won in the warm up game against Sri Lanka but again our batsmen didn’t score enough to get a big total. I think we will be depending a lot on our bowlers and they will need to bowl out oppos-ing teams or defend to-tals around 140-150.”
