He said the Principal Secretary of Minority Af- fairs department Jayshree Mukherjee has written a letter to Principal Secre- tary of School Education and Sports Nand Kumar in this regard. Khadse said the School Education department has planned a survey of students that are not taking formal ed- ucation on July 4. “Stu- dents who are studying in Madrasas that do not provide formal educa- tion will be treated as out of school students. Our only aim behind doing this is to ensure that ev- ery child of the minority community gets a chance to learn and come into the mainstream, get good paying jobs and have a prosperous future,” Khadse said. The minis- ter said that out of a to- tal 1,890 registered Ma- drasas in the state, 550 have agreed to teach the four subjects to students. “We are even ready to pay Madrasas for giving students formal educa- tion and are ready to pro- vide them teaching staff as well,” Khadse said. Asaduddin Owaisi, who is the President of AIM- IM, questioned the ratio- nale behind the govern- ment decision, and asked whether students being imparted Vedic studies will also be considered out-of-school children. “There are many Ma- drasas that are teaching Maths, English and Sci- ence. Many Madarasa students have gone ahead and cracked civil service exam”, he said. Jamiat Ulema-e-Hind General Secretary Maulana Mah- mood Madani said that whatever happened is “unacceptable”. DAYIndian lawmakers above the law?All animals are equal, but some animals are more equal than others. The Indian Republic has had its Orwellian moments. It is not uncommon to hear the complaint that lawmakers are above the law in India. From gun-toting members of legislative assembly (MLAs) threatening toll-booth operators to actual allegations to criminal activities, violations of the law of the land don’t surprise anymore. But what is happening is Maharashtra is in a different class alto-gether. Almost a month has passed since Maharash-tra initiated amendments to sections 156(3) and 190 of the Code of Criminal Procedure, 1973 (CrPC). Section 156 deals with the power of a police offi-cer to investigate a cognizable case; sub-section 3 of this part empowers a magistrate to order an inves-tigation under this section. Section 190 empowers a magistrate to take cognizance of offences. Under the amendments moved in Maharashtra, police of-ficers cannot register cases against members of the legislative assembly (MLAs) without the permission of the speaker of the assembly. Even worse, cases cannot be registered against civil servants without the permission of the chief secretary. These changes are almost revolutionary: with the stroke of a pen an entire class of citizens has been put on a differ-ent standing before the law. An ordinary citizen has to face the law directly if he commits any criminal offence. A police officer requires no authorization to investigate a breach of the law. Police officers and magistrates now have to seek the permission of “competent authorities” before they can even begin investigating allegations of crimes by legislators and officers. There is a practical side to the matter. Legislators and civil servants wield immense pow-er by the nature of their work. The danger of abuse of power—very often criminal in nature—is greatly amplified for this class of people. There is sufficient evidence—in terms of criminal proceedings against many legislators and officers across the country—that this fear is very real. Giving legal protection to this class greatly increases the danger of greater criminality on their part. At a broader level, this is-sue is linked with that of Parliamentary privilege. The Constitution gives a measure of privilege to legislators, as it should be in any civilized country. Article 105(3) of the Constitution allows these priv-ileges to be defined by law from time to time (in case of members of Parliament). Article 194(3) does the same for MLAs. But these privileges have never been codified and this has been to the detriment of all citizens. In fact, undetermined privilege is another way for their extraordinary extension. Among other privileges, legislators cannot be arrested without in-forming the Speaker of an assembly/Lok Sabha and the vice-president (in case of members of the Rajya Sabha). Similarly, legislators cannot be subjected to legal proceedings for any vote or for what they say in the legislature.

The of-ficials of the Admission Committee of Medical and Para Medical Cours-es said that barring two medical colleges, all the self-financed colleges have surrendered their management and NRI quotas. The officials said that with the Medical Council of India (MCI) approving two new col-leges, there will be 3,080 seats in medical which

will be open for admis-sions. Earlier, all the four self-financed medical colleges had made it clear that they would admit students on the NRI and management quota on their own. Later, two col-leges decided to surrender their quota. However, two medical colleges — one each in Surendranagar and Karamsad — have already issued advertise-ments for admission on NRI and management quota. The two colleges, if found guilty, will be liable for a fine which will be as high as Rs 5 lakh per seat.According to the rules, the colleges are supposed to issue ad-vertisement and then pre-pare a merit list for man-agement and NRI quotas. The college management will then have to come to the admission committee for the final decision.
