QUOTE OF THE

DAYWaiting for justice, But the judiciary is not blameless

Chief Justice of India T.S. Thakur has lobbed the ball in the government’s court, pointing out that the problem of case pendency, which denies justice to millions, owes to its reluctance to fill the benches. His reference to a recommendation from the Law Commission in 1987, which had called for increas-ing the number of judges fivefold, points a finger at all the governments that have held office since that time. None of them showed sufficient interest in closing the gap, while both the population and the volume of litigation have grown rapidly. The courts generally draw public attention in extraor-dinary circumstances — when they rise to defend the Constitution and civil rights, or when they are criticised by the other pillars of democracy for ju-dicial overreach or activism. Now, Justice Thakur has used the occasion of a meeting of chief minis-ters and chief justices of the high courts to focus, with visible anguish, on the quotidian operational challenges facing the judicial system. How could Make in India possibly work, he asked, if foreign investors are put off by the tardiness of dispute res-olution? The flagship scheme provided an excellent tactical target, but the effect of pendency is most brutally felt by those without economic power. Un-dertrials have their right to liberty suspended for years at a time. The public, which depends on the courts for relief, hesitates to put assets like housing on the market. Indeed, poor legal protection urges Indians to be risk-averse as a matter of course, with significant economic and social implications. Jus-tice Thakur has drawn attention to a long-festering problem of the judicial system. However, the judi-ciary, too, has not given sufficient attention to the small systemic interventions that could dispropor-tionately increase the efficiency of justice delivery. For instance, the ease with which adjournments can be secured is a well-known cause of delay in civ-il cases. A direction from the chief justice limiting reasonable grounds for adjournment would reduce pendency considerably. Besides, cases in busy sec-tors of civil law fall into repetitive patterns.

Has the long wait end-ed? It looks so, if reports coming out of a swank residence on Road No. 25, Jubilee Hills are to be believed. Ac-tor-turned-Rajya Sabha member K. Chiranjeevi is said to have finally given the nod to director V.V. Vinayak to wield the megaphone for his 150{+t}{+h}film. The pooja to launch the film will be a private affair

at 1.30 p.m. on April 29. Needless to say, it will be strictly out of bounds for the media. The ban-ner is yet to be finalised though. It has been a rath-er longish wait – almost six years — for the actor himself, not to speak of his ‘Mega’ fans. But for at least a year now, it has been known that it could be a remake of the Tamil hit Kaththi that had ac-tor Vijay in the lead role. The Tamil film that hit

the screens on October 22, 2014 was written and directed by A.R. Muru-gadoss and was produced by Lyca Productions. While Mr. Vinayak will helm the project, it is said Mr. Murugadoss has been asked to make suit-able changes for Telugu audiences. For the re-cord, Mr. Chiranjeevi’s son Ramcharan will be the producer and the star’s wife Surekha may be presenting it.

SPORTS ROUNDUPSensex, Nifty rise to 4-month high as Maruti Suzuki, Tata Steel rally

Maruti Suzuki: Recent launches, rural markets key triggers

Rupee closes 10 paise stronger against US dollar at 66.52

Agency | Mumbai

Strong realisations and volume growth helped Maruti beat expectations on most parameters for the March’16 quarter. Volumes would have been higher but for the reservation agitation by Jats in Haryana. A product mix skewed towards higher value premium vehicles such as Ciaz, S-Cross and Baleno helped the company post 12.5% jump in realisations, which coupled with 3.9% growth in volumes helped over-all revenues grow 12.5%. While the S-Cross was launched in August 2015, the new Baleno was put on sale from October, and Ciaz over a year ago. Re-alisations could see incremental gain post the launch of the Vitara Brezza in March 2016. While compact segment sales (Swift, Ritz, Dzire, Celerio and Bale-no) are the largest volume generator and constitute half of Maruti’s domestic passenger vehicle sales, the company’s erstwhile bread and butter, the mini segment (Alto, Wagon R), continues to see a declin-ing trend. Both these trends help in improving prod-

uct mix by value and thus aid realisations.

Indian stocks rallied the most in two weeks as traders closed bearish bets in carmakers and metal producers before the expiry of the monthly deriv-atives contracts on Thursday. The Indian rupee closed stronger against the US dollar on Tuesday, after local equity mar-kets gained over 320 points. However, traders are cautious ahead of the start of the US Feder-al Reserve’s two-day policy meeting. The home currency closed at 66.52, up 0.14% from its pre-vious close of 66.62. The rupee opened at 66.72 per US dollar and touched a high and a low of 66.48 and 66.79, respectively, in intraday trade. “This is supported by strong fundamentals like fresh selling of dollars by exporters and banks. Recovery in domestic market sentiments will lead to more positive movement in Indian rupee,” said Choice Broking in its daily report. India’s bench-mark Sensex index rose 1.28%, or 328.37 points, to close at 26,007.30 points, a level last seen on 1 January. So far this year, the Sensex has fall-en 0.42%. The Federal Reserve and the Bank of Japan (BoJ) are set to meet and announce their monetary policy decisions this week. Analysts expect that the BoJ meeting on Thursday will be reactionary and dependent on the stance laid out at the Fed on Wednesday.

The overdrive the BCCI has gone into to project itself as a victim of its own success may make sense to its followers, but one also presumes they are aware of the phrase “the lady doth protest too much methinks”. William Shakespeare may have used these oft quoted lines in a different context in Hamlet, but its meaning remains very clear. It is

an insincere articulation, a poor defence of some-thing which may not have a convincing explanation. They may have reason to feel aggrieved that how is Indian Premier League to be blamed for one of the worst droughts India is facing. They may even be justified in their grouse why cricket alone is being targeted and why not the golf courses, swimming pools and many other ven-tures which are water-guz-

Barring one bad day in office, both Daredevils and Gujarat Lions had a near perfect campaign so far in the tournament. While new outfit Guja-rat Lions are lying in the second spot in the eight-team standings with eight points from five matches, the Daredevils are a place below in the third posi-tion with six points from four games. Gautam Gambhir comes across as an angry young man. He found his match in fellow Delhi-ite and India team-mate in Vi-rat Kohli three years ago when Kolkata Knight Riders and Royal Chal-lengers Bangalore came face-to-face in a 2013 IPL match in Bengalu-ru. The captains of their respective teams almost came to blows before being separated. Down the years, Gambhir and Kohli have gone differ-ent ways as far as their international careers are concerned. Mumbai Indians opener Parthiv Patel gave credit to top order batsman Am-bati Rayudu and bowlers for his side’s 25-run victo-ry over Kings XI Punjab in their IPL match in Mohali. Parthiv’s 58-ball 81 and Rayudu’s 37-ball 65 were followed by a disciplined bowling effort by the likes of Jasprit Bumrah (3/26), Tim Southee (2/28) and Mitchell McClenaghan (2/32) as Mumbai earned their third win in the tour-nament. Invited to bat,

Mumbai Indians rode on Patel’s 81, his best in IPL, and Ambati Rayudu’s knock to post 189 for 6 against Kings XI Punjab. Parthiv heaped praise on Rayudu for the way he batted, taking pressure off him after Mumbai had lost their skipper Rohit Shar-ma in the first over itself for a duck. “I think having an in-form batsman with you makes your job easier. I have had five innings and could not get going in first five games. To have an in-form batsman with you,

you can take a bit of pres-sure off yourself. Rayudu did exactly that,” he said at the post-match press conference. “Every time we felt we need to get go-ing, he used to smash a six or a boundary. That actu-ally helped me a lot. And we were talking about getting to 180 because we felt the wicket was on a drier side and 180 would be a good score,” Parthiv said about the partnership with Rayudu for the third wicket which yielded 137 runs.

Why do the courts want to curb only the IPL’s extrav-agant ways and overuse of water to maintain grounds and pitches in times of drought, is the question BCCI officials are rais-ing. Implicit in this lament is a sense of frustration that comes more from it being the target of the judiciary which is forc-ing it to mend its errant ways and implement the Justice RM Lodha panel recommendations. The BCCI is resisting these recommendations, which in general perception are nothing but pragmatic and transparent ways of how a sports body should func-tion for the betterment of the sport it governs.

The mark of Mahendra Singh Dhoni’s captain-cy, for India or Indian Premier League (IPL) franchise Chennai Super Kings, has been the cer-tainty over his playing eleven. Tinkering with the side isn’t his style. That helped mould a core group that netted CSK two titles, making them one of the most success-ful IPL franchises. When Chennai were suspended for two years with Rajas-

than Royals and two new teams floated, the big question was how Dho-ni’s methods would work

with the R i s i n g Pune Supergiants. Five matches on, and after the fourth straight de-feat, his leadership is

under test. From the CSK group, Pune picked Dhoni, R Ash-win, Ajinkya Rahane, Albie Morkel, Faf du Plessis and coach Ste-phen Fleming. Gujarat Lions named Suresh Raina the skipper with former CSK players

Ravindra Jadeja, Bren-don McCullum, Dwayne Bravo and Dwayne Smith coming on board. The Lions have made a bright start, but Dhoni has been handicapped by two factors.

Asked what made Kohli click at the rate that he is doing now-a-days, Gambhir said: “Confidence is very important. I think some-times you want to keep doing the same things to

Obviously, consistency is very im-portant in all forms of the game and he has shown how consistent he is and that is what you strive for, that is what you wish for in international crick-et that you can continue that form for as long as possible. Gujarat Lions too had a dream debut in their opening IPL season, having won three consecutive games — against Kings XI Pun-jab, Rising Pune Super-giants and Mumbai Indi-ans — before slumping to their only loss against Sunrisers Hyderabad. The Suresh Raina-led side, however, came back strongly to get the better of a star-studded Royal Challengers Bangalore in their last game. And come tomorrow, both Daredevils and Gujarat Lions will be desperate

to upstage each other to prove their suprema-cy. After the flop show in their opening match, Daredevils batting came to the party in the last two games against RCB and Mumbai Indians. In the first match against Kol-kata Knight Riders, the Daredevils got all-out for 98 and then went untested in the second game as the target was a meagre 112. In the game against RCB, South African Quinton de Kock struck the first century of IPL 9 scoring 108 off just 51 deliveries to guide Daredevils to a seven wicket win while chasing an imposing 192-run target.
