THE vast majority of us do not like to think about the possibility of losing our mental capacity, and consider how we would cope with our financial affairs in that eventuality.

It is, therefore, eminently prudent to look to the future and plan ahead, in order to ease the potential burden on your relative, should this occur - by creating a Lasting Power of Attorney.

An LPA is is a legal document that allows you to choose other people whom you wish to make decisions on your behalf, including a time when they you lack the requisite, mental capacity to do so.

It is crucial that an LPA is ‘completed’ while you are still mentally capable, well before you require it.

There are TWO types of LPA:-

* Property and financial affairs (allowing an attorney to make decisions about paying bills, dealing with the bank, collecting benefits, selling your house etc.).

* Health and welfare (allowing decisions on treatment, care, medication, where you live etc.).

An LPA allows you to plan in advance the decisions you want to be made on your behalf if/when you lose the capacity to make them yourself; the people you want to make these decisions; how you want the people to make these decisions.

Having an LPA is a safe way of

maintaining control over decisions made for you because: 1) It has to be registered with the Office of the Public Guardian before it can be used (if someone else tries to register if you and your attorney[s] will be able to make an objection); 2) You choose someone to provide a ‘certificate’ confirming that you

understand the significance and purpose of it; 3) You can choose ‘people to be told’ about your LPA when it is registered (so that they have an opportunity to raise concerns); 4) Your signature, and the signatures of your chosen attorneys must

be witnessed; 5) From a legal perspective, your attorney(s) must follow the code of Practice of the Mental Capacity Act 2005 - if they don’t always act in your best interests, the OPG can step in, and your attorneys(s) may be held accountable; 6) The OPG provides helpful support and advice.

Do You Need a

Lasting Power of Attorney (LPA)If you “lose capacity” all of your �nancial arrangements will be “locked”, even those you held jointly.

Your bank and other institutions have no choice but follow the rules MCA and deny your spouse/family access to your accounts.

To “unlock” your accounts, and also be able to sign and act on your behalf someone has to either produce a previously arranged LPA, or make an application to the Court of Protection

An application to the Court is neither cheap (£2,000 to £3,000 are typical), or quick (3-4 months+) and is no guarantee of success.

The Court may reject your family’s application and instead appoint a Local Deputy (a local solicitor) who will take over all of your �nances.

From your estate, the Deputy will deduct all court fees as well as his own fees and expenses, which in some cases has been known to run into £1000's

With this in mind, Newcastle-based Croft Veterinary Clinic has drawn up a few, topical tips. Harvest mites are a problem in late-Summer and Autumn. These very seasonal parasites are picked up in woodland and long grasses, and swarm onto passing pets, where they tend to congregate on the ears, eyelids, feet and the underside of the abdomen. They are identified as tiny, bright, orange dots, adhering tightly to the skin, and are usually a cause of great irritation, with itchy, crusting lesions developing. Ticks are particularly active during the Autumn months, living in long grass and woodland areas. They clamber onto passing pets, firmly attaching themselves and feeding on their blood. Worse still, they can also spread a range of infectious diseases, such as Lyme disease and Babesiois.

Conducted by Ben Gernon, the concert commences with the Fantasy Overture: ‘Romeo & Juliet’. and finishes with his

Symphony No. 6 (‘Pathétiqué).

The middle work is the Horn Concerto No. 4 by Wolfgang Amadeus Mozart (1756-91).

Another triumph for Victory Club!!THRIVING Stoke-on-Trent venue, Smallthorne Victory Club, is busy not only raising cash for charities; it’s also investing money in a number of enhancements to its Hanley Road premises!

Recently, the club realised £300 for the North Staffs. branch of the Alzheimer’s Association via a series of fund-raising raffles.

“We are in the process ofspending about £30,000 this year, including 15,000 on improvements to the ladies’ toilet at the front of the building; creating a new kitchen for the Steward’s accommodation and upgrading its roof,” said Club Secretary, Ian Machin.

“Also, a new ceiling, complete with energy-saving lighting, for the Concert Room, is on the cards, as this club is still flourishing.

“Smallthorne Victory continues to grow, thanks to the support of our members and the local community,” explained Ian, who has held the post of Club Secretary since April, 2008.

In recent years, the club has seen its Bar transformed, plus the installation of a ‘new-look’ Concert Room Bar, and is looking to the future with renewed confidence.

Autumn hazards!!AS temperatures drop and the nights draw in, it’s great to get out and active in the Autumn, but there are some factors that still need to be considered to keep our pets fit and well.

With this in mind, The Croft Veterinary Clinic, Newcastle, has a few, topical tips:

Harvest mites are a problem in late-Summer and Autumn. These very seasonal parasites are picked up in woodland and long grasses, and swarm onto passing pets where they tend to congregate on the ears, eyelids, feet and the underside of the abdomen.

They are identified as tiny, bright orange dots

adhering tightly to the skin, and are virtually a cause of great irritation with itchy, crusting lesions developing.

Ticks are particularly active in the Autumn months, living in long grass and woodland areas; they clamber onto passing pets, firmly attaching themselves and feeding on their blood.

Worse still, they can also spread a range of infectious diseases, such as Lyme disease and Babesiois.

Fleas are more of a year-round problem, and, unlike the parasites mentioned above, fleas love central-heating, and will make
