In overweging genomen hebbende:

- dat de ministerraad van Nederland bij bindende schriftelijke aanbeveling van 22 oktober 2019

heeft besloten om mevr. Sophie van Bijsterveld, geboren op 20 augustus 1960 in de Verenigde

Staten van Amerika, van Nederlandse nationaliteit, te benoemen tot lid van Raad van Toezicht van de Integriteitskamer;

- dat ten aanzien van betrokkene zijdens de Minister van Algemene Zaken een veiligheidsonderzoek is ingesteld, waaruit geen bezwaren zijn gerezen tegen haar benoeming;

1955 te Aruba, van Nederlandse nationaliteit, te benoemen tot lid van Raad van Toezicht van de Integriteitskamer;

DE STATEN VAN SINT MAARTEN

Overwegende: dat de leden R. Brison, F.G. Richardson, C.T. Emmanuel, S.E. Jacobs, E.J. Doran, A.M.R. Irion en W.V. Marlin op 13 augustus 2019 een voorstel hebben ingediend voor het houden van een parlementaire enquête inzake Mullet Bay zoals beschreven in het voorstel (IS/1378/2018-2019 d.d. 13 augustus 2019);

dat dit voorstel op 10 oktober 2019 in de Centrale Commissie is behandeld overeenkomstig artikel 83 van het Reglement van Orde van de Staten en dat daarvan een verslag is opgemaakt;

dat naar aanleiding van de beraadslagingen in de Centrale Commissie diverse vragen aan de regering zijn voorgelegd omtrent Mullet Bay; dat het voorstel en het verslag van de Centrale Commissie op 5 november 2019 in de Openbare

Vergadering zijn behandeld; dat de Staten van Sint Maarten, overeenkomstig artikel 2, eerste lid, van de Landsverordening parlementaire enquête (AB 2010, GT. no. 16), tot het houden van een parlementaire enquête hebben besloten inzake Mullet Bay zoals beschreven in document nummer IS/1378/2018-2019 d.d. 13 augustus 2019;

dat de Staten van Sint Maarten voorts hebben besloten dat de commissie uit vijf leden zal bestaan; dat de leden R. Brison, S.L. Duncan en A.E. Richardson op 2 december een voorstel hebben ingediend voor de vaststelling van de samenstelling van de commissie (IS/374/2019-2020 d.d. 2 december 2019);

dat dit voorstel voor de samenstelling van de commissie in de Centrale Commissie van 12 december

2019 is behandeld overeenkomstig artikel 83 van het Reglement van Orde van de Staten; dat het voorstel voor de samenstelling van de commissie van de Centrale Commissie op 12 december 2019 in de Openbare Vergadering is behandeld; dat de Staten van Sint Maarten, overeenkomstig artikel 2, vierde lid, van de Landsverordening parlementaire enquête (AB 2010, GT. no. 16), over de samenstelling van de commissie hebben besloten;

dat op grond van artikel 2, vijfde lid, van de Landsverordening parlementaire enquête, de voorzitter van de Staten, in de Landscourant mededeling doet van de besluiten bedoeld in artikel 2.

Gelet op: Artikel 2, vijfde lid, van de Landsverordening parlementaire enquête;

HEBBEN BESLOTEN: Artikel 1 De Staten van Sint Maarten hebben op 5 november 2019 overeenkomstig artikel 2 van de Landsverordening parlementaire enquête besloten een parlementaire enquête te houden inzake Mullet Bay.

Artikel 2 Doel van de voornoemde parlementaire enquête is inzicht verkrijgen in het eigendomsrecht van het

Mullet Bay gebied en de huidige gespannen (juridische) verhouding tussen de eigenaar, de overheid en de inwoners van Sint Maarten. Voorts strekt deze parlementaire enquête tot de beoordeling van de noodzaak of de Staten en de overheid van Sint Maarten dienen in te grijpen op welke manier dan ook,

om de meest waardevolle stuk grond gelegen aan de kust en de waterwegen in het belang van het land te beschermen als ook om de mogelijkheden te onderzoeken hoe het gebied het beste kan worden benut vanuit een economische, milieu, erfgoed en juridisch perspectief in het belang van de bevolking. Artikel 3 De parlementaire enquête wordt uitgevoerd door de Commissie Parlementaire Enquête Mullet Bay zoals

vastgesteld op 12 december 2019. Tot lid van deze commissie zijn benoemd: 1. Rolando Brison 2. Christophe T. Emmanuel 3. Anna E. Richardson 4. Tamara E. Leonard

5. Sidharth M. Bijlani

THE PARLIAMENT OF SINT MAARTEN

Whereas:

that the members R. Brison, F.G. Richardson, C.T. Emmanuel, S.E. Jacobs, E.J. Doran, A.M.R. Irion and W.V. Marlin submitted a request on August 13, 2019 for a parliamentary inquiry to be conducted with regards to Mullet Bay as described in the proposal (IS/1378/2018-2019 dated August 13, 2019); that this proposal was discussed in the Central Committee meeting of October 10, 2019 in accordance with article 83 of the Rules of Order of Parliament and that a report was made thereof;

that based on the discussions in the Central Committee, several questions were posed to the Government about Mullet Bay; that the proposal and the report of the Central Committee were discussed in the Public meeting of November 5, 2019; that the Parliament of Sint Maarten, in accordance with article 2, paragraph 1, of the National Ordinance

Parliamentary Inquiry (AB 2010, GT. no. 16), decided to conduct a parliamentary inquiry into Mullet Bay as described in document number (IS/1378/2018-2019 dated August 13, 2019); that the Parliament of Sint Maarten furthermore decided that the committee would consist of five members;

that the members R. Brison, S.L. Duncan and A.E. Richardson submitted a proposal for the establishment of the composition of the committee on December 2, (IS/374/2019-2020 dated December 2, 2019); that this proposal for the composition of the committee was discussed in the Central Committee meeting of December 12, 2019 in accordance with article 83 of the Rules of Order of Parliament; that this proposal for the composition of the committee of the Central Committee was discussed in the

Public meeting of December 12, 2019; that the Parliament of Sint Maarten, in accordance with article 2, paragraph 4, of the National Ordinance

Parliamentary Inquiry (AB 2010, GT. no. 16), decided about the composition of the committee; that based on article 2, paragraph 5, of the National Ordinance Parliamentary Inquiry, the Chairman of Parliament, has to notify the public of the decisions taken in accordance with article 2 in the National

Gazette. Considering: Article 2, paragraph 5, of the National Ordinance Parliamentary Inquiry

HAVE DECIDED: Article 1

The Parliament of Sint Maarten have decided on November 5, 2019 in accordance with article 2 of the National Ordinance Parliamentary Inquiry to conduct an inquiry into Mullet Bay. Article 2 Goal of the aforementioned parliamentary inquiry is to obtain insight into the ownership of the Mullet

Bay area and the current volatile (legal) position that exists between the owner, Government and the citizens. Furthermore this parliamentary inquiry serves to assess the need for Parliament and Government to intervene in every feasible way possible to protect one of its most precious coastal and inland waterways in the national interest of the country as well as to explore possibilities how best it can

be used in the interest of the people from an economic, environmental, heritage and legal perspective. Article 3

The parliamentary inquiry will be conducted by the Committee Parliamentary Inquiry Mullet Bay as established on December 12, 2019. The following are appointed as members of the committee:

1. Rolando Brison 2. Christophe T. Emmanuel 3. Anna E. Richardson 4. Tamara E. Leonard

5. Sidharth M. Bijlani

The Parliament, on December 12, 2019, has appointed Rolando Brison as the chairman of the committee

Policy on to be undertaken efforts by Employers to fill their vacancies with suitable

candidates from the Sint Maarten market.

Introduction

As per article 6 paragraph 1 of the National Ordinance on Employment of Foreigners the Minister can

impose conditions to an employment permit pertaining to the efforts that must be exercised by an

employer to fill vacancies with suitable candidates from the local Sint Maarten market. The aftermath

of hurricane Irma has seen many foreigners employed with companies on Sint Maarten. In addition,

several companies even 2 1/2 years after hurricane Irma are still continuously filing for labour permit

renewals for foreign employees.

Unemployment remains alarmingly high on Sint Maarten. This, even though various occupations of the

growing pool of registered jobless persons match the vacancies posted by Employers on Sint Maarten.

This necessitates further objective restructuring of the requirements of Employers to, within the vacancy

time period, strive, as much as possible, to fill their vacancies with registered or unregistered jobseekers

in Sint Maarten. As such, to - further--define what constitutes suitable efforts from Employers to fill

their vacancies with persons from the local job market.

Policy objective

The objective is to create a balanced and transparent system, with the requisite checks and balances,

to safeguard that Employers duly comply with their legal obligation to exercise the requisite efforts to

fill their vacancies first with suitable candidates on Sint Maarten, before contracting foreign employment

Effective February 7th, 2020, till further order, the following criteria shall apply to the requirement of

Employers as per article 6 paragraph 2 of the National Ordinance on Labour of Foreigners, to exercise

efforts in filling vacancies with jobless persons in the local Sint Maarten market.

The criteria are:

1. Employers will have to closely work together with the designated representatives from the

National Employment Service Center to fill all possible vacancies as much as possible with

suitable jobless persons on Sint Maarten;

2. This concretely means that Employers will have to request and obtain whenever they have

a vacancy, a list of suitable candidates, from the National Employment Service Center;

3. Before filing an application for a work permit for a foreigner, Employers must furthermore

conduct interviews with the candidates presented by the National Employment Service

Center;

4. These interviews must be conducted in the presence of the designated representative of the

National Employment Service Center. The Employers and the National Employment Service

Center will jointly coordinate the scheduling of the interviews;

5. The National Employment Service Center will keep a ledger of all interviews conducted,

stating the dates on which the interviews were held, the names of all participants and

possible special observations/remarks. Within ultimately one (1) week after all potential

candidates referred by the National Employment Service Center to the Employer, have been

interviewed, the National Employment Service Center will sent a copy of the ledger to the

Employer;

6. The Employer will, within ultimately four weeks after each interview has been conducted,

inform the National Employment Service Center if the interviewed candidate is a match, or

not, and if a job offer has been made and accepted;

7. Rejections by an Employers of interviewed candidates will be adequately motivated by him

same Employer;

8. The National Employment Service Center can, to its sole discretion, decide to discuss compel

an Employer to conduct a follow-up meeting, to discuss the findings of the Employer and

the decision to employ an interviewed candidate, or not;

9. Noncompliance by an employer with the criteria set for what constitutes efforts for filing

vacancies for foreigners, can constitute a ground for rejection of labour permit applications

filed.

This policy will not apply on all applications for work permit submitted on or before February 3, 2020.

This policy will remain in effect, until further order.
