The following resolution wasoffered by William Gebo andseconded by Carl Hamann.
WHEREAS, in August 2018,the Sanford Lake Improve-ment Board renewed a lake im-provement project to, amongother things, assess costs re-lated to nuisance aquatic plantcontrol, plant control coordina-tion, water quality monitoring,and information dissemination(“Lake Improvement Project”).As part of the Lake Improve-ment Project, the Lake Im-provement Board confirmed aspecial assessment roll withfive-years of special assess-ments from 2019 to 2023; and
WHEREAS, the Lake Improve-ment Board renewed the as-sessments as part of continu-ing improvements to SanfordLake. Streambank stabilizationis referenced in a 2000 San-ford Lake Management Plandrafted for the Board as an im-provement to the lake for thisspecial assessment district;and
WHEREAS, on May 19, 2020,the Edenvil le and Sanforddams failed after a historic rainevent. These dam failures dev-astated Sanford Lake and thesurrounding area. After thedam failures, the President ofthe United States approved amajor disaster declaration forMidland County. Various otherentities are approving erosioncontrol and disaster reliefprojects on Sanford Lake; and
WHEREAS, after the tragicdam failures, traditional aquat-ic weed management on thelake is not feasible due to thecondition of the lake. In re-sponse to the lake’s currentcondition, the Lake Improve-ment Board met at a publicmeeting on June 18, 2020, todiscuss how to handle the ap-proved assessments. The LakeImprovement Board made amotion to hold a public hearingto discuss: (1) terminating fu-ture uncollected assessments;and (2) using the remaining un-spent assessments towardsdisaster relief activities includ-ing, but not limited to, stream-bank stabilization and erosioncontrol.
WHEREAS , Pa r t 309 o fMichigan’s Natural Resourcesand Environmental ProtectionAct (“Part 309”) outlines a pro-cedure to hold new public hear-ings to remedy special assess-ments under Part 309. MCL324.30920; and
WHEREAS, the Sanford LakeImprovement Board notes thatthe August 2018 Resolution in-cludes “plant control coordina-tion” as a purpose of the LakeI m p r o v e m e n t P r o j e c t .Moreover, previous studies andother documents associatedwith assessments imposed bythis Lake Improvement Boardindicate that “streambank sta-bilization” is an authorized im-provement. The Lake Improve-ment Board finds that due tothe current condition of the lake(with much, if not all, of the wa-ter drained from the lake) thaterosion control projects andother disaster relief (such as,but not limited to, removingdebr is f rom the lakebed)projects will help control thegrowth of plants on the lake (asplant control coordination) andprevent erosion from furtherimpacting the lake (stream-bank stabilization). Further, theLake Improvement Board findsthat not performing any erosioncontrol or disaster relief activit-ies on the lake may signific-antly impact the structure of thelake making any future aquaticweed control activities on thelake once restored unfeasible.

WHEREAS, the Sanford LakeImprovement Board duly no-ticed this hearing pursuant toPart 309, which requires twopublications of notice in anewspaper of general circula-t i on in M id land Coun ty ,Michigan, the first of whichmust be published not lessthan 20 days prior to this hear-ing. Property owners also re-ceived a mailing notice consist-ent with Part 309 with instruc-tions of how to join the publichearing and participate. Thenotice was posted on the web-site of the Midland CountyDrain Commissioner; and
WHEREAS, it is the desire ofthe Sanford Lake Improve-ment Board to allow the re-maining assessments to bespent on erosion control anddisaster relief activities.
NOW, THEREFORE, BE ITRESOLVED AS FOLLOWS:
1. To the extent required un-der statute, the Lake Improve-ment Board finds performingdisaster relief and erosion con-trol activities practicable. It ap-proves plans of using the re-maining already collected as-sessments towards erosioncontrol and disaster relief activ-ities on the lake (with costs be-ing the remaining balance ofthe collected assessmentsminus anticipated Board ongo-i n g e x p e n s e s ) . M C L324.30912. On behalf of theLake Board, the MidlandCounty Drain Commissionerwill complete a computation ofcosts in a form substantiallysimilar to Exhibit A and willkeep the document on file intheir office after approving thisresolution. 2. The Sanford Lake Improve-ment Board finds that the cur-rent special assessment roll forthe 5-year project approved inAugus t 2018 shou ld beamended to make future annu-al assessments as $0.00 and,in an abundance of caution, willhold another public hearing un-der Part 309 to confirm said rollterminating assessments. MCL324.30912.
3. The Sanford Lake Improve-ment Board hereby orders thepublication of this resolution ina newspaper of general circula-t i on in M id land Coun ty ,M ich igan . Id .

WHEREAS, in August 2018,the Sanford Lake Improve-ment Board renewed a lake im-provement project to, amongother things, assess costs re-lated to nuisance aquatic plantcontrol, plant control coordina-tion, water quality monitoring,and information dissemination(“Lake Improvement Project”).As part of the Lake Improve-ment Project, the Lake Im-provement Board confirmed aspecial assessment roll withfive-years of special assess-ments from 2019 to 2023; and
WHEREAS, the Lake Improve-ment Board renewed the as-sessments as part of continu-ing improvements to SanfordLake. Streambank stabilizationis referenced in a 2000 San-ford Lake Management Plandrafted for the Board as an im-provement to the lake for thisspecial assessment district;and
WHEREAS, on May 19, 2020,the Edenvil le and Sanforddams failed after a historic rainevent. These dam failures dev-astated Sanford Lake and thesurrounding area. After thedam failures, the President ofthe United States approved amajor disaster declaration forMidland County. Various otherentities are approving erosioncontrol and disaster reliefprojects on Sanford Lake; and
WHEREAS, after the tragicdam failures, traditional aquat-ic weed management on thelake is not feasible due to thecondition of the lake. In re-sponse to the lake’s currentcondition, the Lake Improve-ment Board met at a publicmeeting on June 18, 2020, todiscuss how to handle the ap-proved assessments. The LakeImprovement Board made amotion to hold a public hearingto discuss: (1) terminating fu-ture uncollected assessments;and (2) using the remaining un-spent assessments towardsdisaster relief activities includ-ing, but not limited to, stream-bank stabilization and erosioncontrol.
WHEREAS , Pa r t 309 o fMichigan’s Natural Resourcesand Environmental ProtectionAct (“Part 309”) outlines a pro-cedure to hold new public hear-ings to remedy special assess-ments under Part 309. MCL324.30920; and
WHEREAS, the Sanford LakeImprovement Board notes thatthe August 2018 Resolution in-cludes “plant control coordina-tion” as a purpose of the LakeI m p r o v e m e n t P r o j e c t .Moreover, previous studies andother documents associatedwith assessments imposed bythis Lake Improvement Boardindicate that “streambank sta-bilization” is an authorized im-provement. The Lake Improve-ment Board finds that due tothe current condition of the lake(with much, if not all, of the wa-ter drained from the lake) thaterosion control projects andother disaster relief (such as,but not limited to, removingdebr is f rom the lakebed)projects will help control thegrowth of plants on the lake (asplant control coordination) andprevent erosion from furtherimpacting the lake (stream-bank stabilization). Further, theLake Improvement Board findsthat not performing any erosioncontrol or disaster relief activit-ies on the lake may signific-antly impact the structure of thelake making any future aquaticweed control activities on thelake once restored unfeasible.
