Boothengelaars van regoor die streek het die afgelope naweek na die Nandonidam opgeruk vir deelname aan die Tribal Boats Bass Classic-toernooi ten bate van die NG Kerk Levubu-gemeente. Onder hulle was die 38-jarige Karel Pretorius en 28-jarige Willie Knoetze.

Die Makhado Munisipaliteit se finansiële prak-tyke is deurspek van “bestuursblapse”.

Die skokkende toedrag van sake by die munisi-paliteit het aan die lig gekom tydens ‘n vergadering van die munisipale komitee vir openbare rekeninge ten opsigte van die ouditeur-generaal (OG) se ver-slag vir die munisipaliteit se 2011/12 finansiële jaar.

Die komitee het op 10 April by die munisipali-teit vergader en die OG en die munisipaliteit se munisipale bestuurder, mnr. Sakkie Mutshinyali, gepeper met vrae oor die munisipaliteit se geldsake. Veral blatante onreëlmatighede wat betref sekere aankope van die munisipaliteit is uitgelig tydens die vergadering.

In die 2011/12 finansiële jaar het die munisi-paliteit glo R33 169 661 spandeer aan dag-tot-dag uitgawes, soos salarisse, weens “ernstige finansiële uitdagings.” Dié bedrag is glo begroot om as toe-lae te gebruik vir ontwikkelingsprojekte. Volgens Mutshinyali het die munisipaliteit ook van hierdie geld gebruik om munisipale diensverskaffers soos Eskom te betaal.

‘n Verdere misdryf, wat die komiteelede dwars in die krop gesteek het, was vorige finansiële jare se foute wat nooit reggemaak is deur die munisipaliteit se boekhou-afdeling nie. Een so ‘n onreëlmatigheid was JoJo watertenks wat die munisipaliteit aang-eskaf het. In 2002 het die munisipaliteit twee 10 000l tenks aangeskaf vir onderskeidelik R2 300 en R581.23. Die munisipaliteit het tydens die vergadering vinger gewys na die Vhembe Distriksmunisipalit-

eit en plaaslike verbruikers wat nie hulle muni-sipale rekening vereffen nie. Dit, het Mutshiyali herhaaldelik gesê, is maar net een van die vele “uitdagings” waarmee die munisipaliteit worstel. Talle van die foute wat uitgewys is aan die muni-sipaliteit is, volgens Mutshinyali, foutjies wat die bestuur gemaak het.

Hy het die komitee egter die versekering gegee dat die finansiële klerke gestuur is vir opleiding om te verseker dat hulle weet hoe om al die verande-rings in die boekhoustelsel van die munisipaliteit behoorlik toe te pas.

Karel is na Tzaneen afgevlieg vir mediese behandeling, terwyl Thohoyandou se ambulans-diens ontbied is vir Willie. “Baie mense is vinnig om te kritiseer, maar ek wil regtig noem dat ons fantastiese diens van die ambulansmense ontvang het, vanaf die dam waar hulle hom opgelaai het, tot by die Zoutpansberg Privaathospitaal,” sê Pa Willie.

Willie is met ‘n ernstige beenfraktuur en sny-wonde vanaf die Zoutpansberg Privaathospitaal in Makhado (Louis Trichardt) oorgeplaas na die MediKliniek in Polokwane. Hy het Maandagmid-dag ‘n operasie aan sy linkerbeen ondergaan om ‘n erge beenbreuk met penne te herstel. Karel, wat onder meer harsingskudding opgedoen het en sy neus en drie ribbes gebreek het, is Maandag-oggend reeds ontslaan.

Pa Willie is dankbaar dat sy seun en Karel leef. Hy het geen kwade gevoelens teenoor enige ie-

mand oor die ongeluk nie en sê dat dit jammer is dat daar soveel stories rondgaan oor wat presies gebeur het.

“Volgens my was dit niks anders as ‘n frats-ongeluk nie,” sê Pa Willie. Hy voeg by dat dit ander sins ‘n baie suksesvolle naweek en fonds-insa meling vir die gemeente was. Hy het ook hoë lof en dankbaarheid gehad vir Tribal Boats as hul hoofborg.

Bruce Engelbrecht van Tribal Boats het Dins-dag gesê dat hulle reeds besig is om die oorsaak van die ongeluk te ondersoek en dat hulle in die proses is om die boot terug te kry by hul fabriek. Hy sê aangesien hy nie self daar was nie, is dit moeilik om te sê wat gebeur het. Bruce sê egter dat hy verstaan die boot het klaarblyklik ‘n golf getref, in die lug in gevlieg en neus eerste die water getref.

“Ek is net bly niemand is dood nie. Ek wil graag almal bedank wat so vinnig op die toneel was om te help en my meegevoel gaan uit na die beseerdes se families,” het Bruce gesê.

Toetsrit eindig byna noodlottig vir twee

Die Makhado Munisipaliteit se geldsake is steeds wankelrig en kommerwekkend.

Die munisipaliteit se finansiële state vir die boek-jaar wat op 30 Junie 2012 geëindig het, was van so ‘n aard dat die ouditeur-generaal (OG) weereens sy ouditmening weerhou het.

Die Zoutpansberger het by ‘n plaaslike kenner gaan kers opsteek oor die bevindinge van die OG. “Dit beteken dat onsekerhede waarvoor die OG nie voldoende ouditbewyse kon vind nie, so wesenlik is dat dit nie vir die OG moontlik is om ‘n mening oor die finansiële state te vorm nie. Dus spreek die OG geen mening oor die finansiële state uit nie,” sê me. Dodrie Corbett (GRSA), van die reken-meestersfirma Nel, Havinga en Corbett.

Corbett sê ook dat daar geen beduidende ver-beterings in 2012 op die 2010/2011-ouditverslag is nie. Die OG het ook sy mening weerhou in die ver slag oor die boekjaar eindigende 30 Junie 2011.

“In die basis vir ‘n weerhouding van mening sê die OG, net soos in 2011, dat voldoende ouditbe-wyse nie gevind kon word om hulself te vergewis van die korrekte voorstelling van die syfers vir die balanse van eiendom, aanleg en toerusting, bank en kontant, asook debiteure en krediteure nie. Die balanse kon dus meer of minder op die jaareinde gewees het,” sê Corbett en wys op ‘n paar punte in die OG se mees onlangse verslag:

* Wat kapitale aanspreeklikhede betref, is daar nie ‘n kontrakbeheersisteem in plek vir die identi-fisering en erkenning van kontrakte nie. Daar kon nie voldoende ouditbewyse gevind word om te verseker dat kontraktuele verpligting van meer as R47 miljoen deur die munisipaliteit te boek gestel is nie. (In 2011 was dié bedrag meer as R24.5 miljoen).

*Die munisipaliteit het R124.2 miljoen meer aan uitgawes gespandeer as wat goedgekeur is volgens die begroting in terme van Artikel 15 van die MFA (Municipal Finance Act). Die ongemagtigde uitgawes is nie behoorlik in die finansiële state geopenbaar nie. Die nota in die finansiële state verwys slegs na R57.8 miljoen se

ongemagtigde uitgawes. ‘n Verdere R33.1 miljoen se ongemagtigde uitga wes is aangegaan deurdat voorwaardelike toelaes aangewend is vir uitgawes anders as waarvoor die toelaes geoormerk was.

*Verskeie maatreëls wat geneem is om presta-sie te verbeter, is nie behoorlik geopenbaar soos wat deur Artikel 46 van die Local Government Municpal Systems Act, 2000 vereis word nie. Dit word toegeskryf aan die feit dat alhoewel die bestuur bewus was van hierdie vereistes, hulle nog nie die nodige opleiding ontvang het om hieraan te voldoen nie.

*Ten opsigte van die begroting het die OG be vind dat die rekenkundige beampte nie die finansiële prestasie van die eerste helfte van die finansiële jaar geassesseer het soos wat deur Artikel (72) (1) (a) (ii) van die MFMA vereis word nie.

*Goedere en dienste ter waarde van R200 000 is verkry sonder dat die nodige kwotasies, soos wat vereis word deur SCM (Supply Chain Manage-ment) regulasie 17(a) en (c), verkry is.

*Kontrakte is toegeken aan persone in diens van ander staatsinstansies of aan direkteure of aandeel-houers van maatskappye in diens van staatsinstel-lings. Dit is ‘n oortreding van SCM regulasie 44. Soortgelyke toekennings is ook in 2011 gemaak.

*Die OG sê dat die rekenkundige beampte nie alle redelike stappe geneem het om te keer dat ongemagtigde uitgawes aangegaan word nie en dat daar nie ‘n effektiewe interne beheerstelsel in plek was vir die bates van die munisipaliteit, insluitende ‘n bateregister, nie. Dit word vereis deur Artikel 63 (2)(c) van die MFMA.

*Dit is die verantwoordelikheid van die bestuur om toereikende en doeltreffende beheermaatreëls in plek te stel om foute te voorkom. Die rekenkun-dige beampte en die ouditkomitee oefen nie vol-doende beheer uit om oplossings te implementeer nie. Dit het tot gevolg dat ddaar basies dieselfde tekortkominge in die ouditverslag ten opsigte van interne beheer, leierskap en bestuur uitgelig word as in die vorige jaar.

Following the disclaimer of opinion by the auditor general (AG) on the Makhado Munici-pality’s financial affairs, the municipality said that it would take time for them “to move out of disclaimer, but an audit plan has been developed to deal with all matters raised by the AG.”

The Makhado Municipality had a disclaimer of opinion in 2010/11 and 2009/10, with an adverse opinion in 2007/8 and a disclaimer in 2006/7. The report status is supplied by the AG and ranges from unqualified (best), to unqualified with other matters specified, qualified, adverse and disclaimed (worst).

The judgment of the Constitutional Court (Con-Court) on Friday, 26 April, on the withholding of fees for services not rendered in the case between Rademan and the Moqhaka Local Municipality (MLM) has elicited a lot of attention, especially in local circles, where some residents have also been withholding fees.

The members of the local ratepayers association, the Soutpansberg Ratepayers Association (SRPA), have been withholding certain funds from the Makhado Municipality (MM) for a number of years now, based on the fact that these members are not satisfied with the services provided by the MM. To that effect, the SRPA declared a dispute with the MM a number of years ago and only the fees for electricity supply are being paid to the MM, with the rest being held in a trust account.

What the judgment boils down to is that the municipality has the right to consolidate a user’s account, even though certain services and the cli-ent’s consumption thereof are specified on that account. If a consumer therefore has a dispute with the municipality regarding services which, in the consumer’s view, have not been rendered (properly), that consumer cannot refuse to pay the whole account or request that a partial payment of the account be allocated only to the electricity por-tion of that account. Consolidation of the account is the prerogative of the municipality (including the MM) and as such a consumer is responsible for payment of the whole account.

In the judgment, reference is made to the Local Government: Systems Act (LGSA) (Act 32 of 2000) which spells out the duties and obligations of a municipality, as a well as its rights. Point 10 of the judgment stresses that a municipality can make by-laws which aid it in this function and that the national and provincial government must, “by leg-islative and other measures, support and strengthen the capacity of municipalities to manage their own affairs, to exercise their powers and to perform their functions.” Any judgment regarding municipal services will therefore take this into account.

In this regard, it may appear that municipal by-laws are given preference over national laws. The chairman of the National Ratepayers Union (NRPU), Mr Jaap Kelder, in his initial reaction to the judgment, stresses that Rademan had (perhaps erroneously) relied on a possible conflict between the conditions of the Electricity Regulation Act (ERA) (Act 4 of 2006) and the LGSA regarding the termination of the electricity supply. Rademan argued that her electricity could not be cut because she had paid that portion of her account. The Con-Court disagrees.

However, the ConCourt goes further than just

give judgment on the case between Rademan and the MLM. It points out that a remedy exists for a resident or ratepayer where “the municipality de-mands payment for a service or services in circum-stances where the municipality has not provided the service or services” (point 41). It further points out (point 42) that “in the present matter it was not Ms Rademan’s case that the municipality claimed payment for services it had not rendered. Indeed, in the present matter it has not been proved that the municipality was claiming payment for services that had been rendered poorly or inefficiently. However, where a municipality claims payment from a resident or ratepayer for services, it is only entitled to payment for services that it has rendered. By the same token, where a municipality claims from a resident … for services, the resident … is only obliged to pay the municipality for services that have been rendered. There is no obligation … to pay for a service that has not been rendered” [our emphasis].

The judgment continues (point 44) by pointing out that a dispute can be declared regarding the service delivery or lack thereof between the mu-nicipality and the consumer which, in the case of the MLM’s by-laws, will be referred to an appeals committee, whose decision is final in terms of local remedies. If the resident is not satisfied with the ruling of the appeals committee, the matter can be brought to court for a decision.

According to Kelder, this is in line with the NRPU’s contention that ratepayers should not be forced to pay for services rendered poorly or not at all. In a letter to the SRPA and other ratepayers associations, he states that this ruling closes the door for people who refuse to pay for electricity on grounds other than a dispute declared. This will mainly affect the non-paying public, whereas those withholding their payment (paying into a trust account instead) will not be affected because the money will be available when necessary.

The implication for the local SRPA and its members is that the dispute with the MM regard-ing problematic service delivery will probably be contended based on the MM’s by-laws and whether or not the same remedy (or alternatives) exists as in the case of the MLM’s by-laws. A thorough study of the MM’s by-laws will determine this. The question remains how one would argue such a case in court and prove poor service delivery or lack of service delivery.

According to Kelder, a very clear “paper trail” needs to be established to provide evidence of the latter. What is apparent, however, is that this saga is very far from over.

Rademan verdict elicit widespread reaction

“Ons lede sal ons adviseer oor hoe hulle wil hê dat ons voortgaan met belastingaksies,” het voorsitter Inga Gilfillan gesê. Sy het gesê dat die SBBV, terwyl hulle wag vir regsadvies, neig na die beklemtoning van die denkrigting aangedui deur die Konstitusionele Hof in die uitspraak van die Rademan-saak dat verbruikers nie hoef te betaal vir dienste wat nie gelewer is nie. Die implikasies van die Rademan-saak sal op die vergadering bespreek word. Hierdie deurslaggewende vergadering van die SBBV sal om 18:00 by die kerksaal van die NG Kerk Soutpansberg-gemeente gehou word.

“Deur te bevind dat inwoners nie vir dienste hoef te betaal wat nie gelewer is nie, is die deur oopgemaak vir inwoners wat dispute oor swak of geen dienslewering verklaar het. Volgens paragraaf 44 van die hofuitspraak kan ‘n inwoner ‘n klagte lê oor die bedrag betaalbaar vir ‘n spesifieke diens wat geag nie gelewer te wees nie en die inwoner kan slegs betaal vir die diens of dienste waarmee hy of sy tevrede is, beide ten opsigte van die bedrag sowel as die kwaliteit van die diens. those. “Unbundling of state assets,” was the most pressing factor and the only one mentioned in the short answer received from the municipal spokes-person, Mr Louis Bobodi.

The local ratepayers association, on the other hand, had much to say about the disclaimer by the AG for the financial year ended 30 June 2012. “The opinion that the AG has expressed has once again been the worst opinion that the AG can express. It means that there are so many material issues, miss-ing information, non-compliance with accounting standards, poor or non-existent internal controls, a malfunctioning audit committee and poor internal functions, that the AG cannot express any opinion whatsoever,” said Ms Inga Gilfillan, chairperson of the Soutpansberg Ratepayers Association (SRPA).

The SRPA regards the state of the financial affairs of the municipality as very serious and “it requires that very serious actions must be taken as a matter of urgency to prevent the situation from deteriorating further or to continue.”

According to the AG’s report, assets (property, plant and equipment) to the value of R1.6 billion could not be verified for existence, completeness or valuation. The municipality’s CFO, Ms Mikateko Makhubela, stated in a report that a new functional asset register has been compiled. Valuation and depreciation of assets are to be re-assessed as per GRAP 17 standards and there should be continu-ous improvement on asset register maintenance. The SRPA said that failure of an effective system of internal control for assets was serious financial misconduct that could imply a criminal offence.

The AG report indicated in note 17 that the mu-nicipality had disclosed unauthorised expenditure to the amount of R57 872 128 but failed to disclose a further amount of R124 208 021.

“This means that the operational budget as ap-proved by council was overspent by more than R180m. It is a contravention of Section 15 of the MFMA,” said Gilfillan. In note 25, the AG reported that the municipality had incurred R33 169 661 of unauthorised expenditure by utilising conditional grants for other purposes than what they had been granted for. “This is very serious financial misconduct as well as a contravention of the Division of Revenue Act. In terms of Section 3, Part 2: Criminal Offences, this constitutes a criminal offence,” Gilfillan said.

The SRPA said they could go on and on and cite many significant findings in the AG report. “There is a total lack of financial management and numerous contraventions of the MFMA and its regulations, as well as the Municipal Systems Act. Serious intervention is urgently required,” Gilfillan said.

The SRPA indicated that they were busy with a request to the national treasury to deploy well-experienced people to the municipality to assist in saving the municipality from total financial disaster and to establish proper internal controls and train the staff in accounting standards.

The Save Mapungubwe Coalition met with their lawyers at Mapungubwe over the past weekend to determine their strategy with regard to CoAL of Africa Limited’s (CoAL) mining activities at Vele.

The environmental coalition, consisting of the Endangered Wildlife Trust, the Wilderness Foun-dation South Africa, the World Wide Fund for Nature South Africa, the Association of Southern African Professional Archaeologists, the Mapun-gubwe Action Group and BirdLife South Africa, is better known as the Coalition.

The Coalition had an informal strategy meet-ing with their lawyers from the University of the Witwatersrand’s Centre for Applied Legal Stud-ies (CALS) on Saturday (27th). Represented at the meeting were vari-ous local communities who are descendants of the first inhabitants of Mapungubwe. Also at the meeting were sur-rounding farmers and lodge owners, as well as representatives of numerous environmental awareness groups that are also part of the Coalition.

The meeting acted as a podium for the concerned parties to voice their feelings regarding CoAL. Particularly the communities felt that their concerns were being ignored, not so much by the mine, but rather by the government.

“What has happened to our previous complaints and appeals? I’m certain of it that it has been filed in File 13 and has now been long forgotten,” remarked one community leader. Due to the fact that not all the documents and remarks made during this meet-ing are public knowledge yet, the attendees asked for anonymity.

The Vele colliery is CoAL’s first operational open-cast mine in the Soutpansberg coal basin and is about 7km from the Mapungubwe World Heritage Site. Since plans became known more than three years ago about the proposed mine, the Coali-tion has been involved in a legal battle with CoAL.

This saw CoAL paying fines of about R9 million to the Department of Water Affairs (DWA) for an infringement of water licences. At that stage, however, the mine was already 95% complete, and in 2011 the mine was finished and 55 000 tonnes were hauled from its first box cut.

Afterwards, the Coalition and CoAL entered into a memorandum of understanding (MoU) to

work together to ensure that CoAL follows, to the letter, the terms of all their licences. This agreement was can-celled in December last year due to “past and on-going non-compliance with water legislation at Vele.”

Despite the water be-ing a burning issue, at-

tendees at the meeting also felt that CoAL, together with the government, only sees the money to be made out of coal and not the environment or any cultural heritage in the area. “There is no mon-etary value for them in wildlife, trees or culture,” remarked another attendee.

Since the termination of the MoU, CALS has come up with an environmental management com-mittee (EMC) – a first in South Africa.

This committee represents key role players with an interest in the mine. The EMC will see to it that CoAL stick to all the regulations as stipulated in their various mining authorisations.

What happened to all the objections against Vele?

The Louis Trichardt Society for the Prevention of Cruelty to Animals (SPCA) is at present in dire straits.

Over the last couple of months, it has become more and more difficult to fulfil their duties as a non-profit organisation. The main reason for this is a serious shortage of funds. They do not re-ceive any help from government and rely solely on donations. These donations have, however, all but dried up in recent times.

“If we do not receive help urgently in the form of frequent cash donations, we would have no other option than to close the local branch of the SPCA. If this happens, residents’ closest SPCA branch would be in Polo-kwane,” says Mrs Bea Reimer, chairperson of the management

committee.Reimer explained that, on

average, it costs the branch be-tween R40 000 and R45 000 per month to keep their gates open. This includes veterinary fees, fuel, municipal levies, office expenses and, most importantly, animal food.

“Our situation is dire and we are still waiting for the R1 million inheritance left to us by our dear friend and animal lover, Miss Betty Noakes, who passed away nearly two years ago. But even when we receive this money, we will only be able to use the inter-est on the amount,” says Reimer.

The local SPCA covers a vast area, stretching from Matoks in the south to the Zimbabwean border in the north and from Ma-sisi in the east to Vivo/Alldays

in the west.“You would therefore un-

derstand that to send out our vehicle to Masisi or Alldays for a day costs a lot of money,” says Reimer.

Reimer urged people to con-sider contributing a small amount each month, maybe by debit order, to help keep the local SPCA’s gates open. Once-off donations are also very welcome. Local SPCA in dire straits over money

Since the removal of the speed hump, this particular piece of road in Kort Street has gone from bad to worse. So much so that motorists have to drive on the shoulders of the road to avoid serious damage to their vehicles. This situation, in turn, has become a big frustration for businesses that have to give up their parking spaces, which have been reduced to mud puddles. No media comment from the Makhado Municipality regarding the situation was forthcoming at the time of going to press. Municipal spokesperson Mr Louis Bobodi acknowledged receipt of the newspaper’s questions and said that it would receive attention “soon”.

The Minister of Safety and Security was once more ordered to pay thousands of rands in damages, following yet another case of wrongful arrest by the police.

The claim for damages arose from the arrest, detention and subsequent prosecution of the then 68-year-old Mrs Issie Combrink, owner of CC Metal Merchants in Makhado (Louis Trichardt), on 23 January 2008. She, together with Mr Eric Mnisi, an employee, was arrested for allegedly being in possession of suspected stolen property in the form of scrap metal. Upon her arrest, Com-brink informed the two arresting officers, Warrant Officer Edward Ramuthuthu and Sergeant Bethuel Makananise, that she was in possession of a control register which could have assisted them in verifying that the items found and confiscated by the said police officers were legitimately obtained. She was, however, ignored by the officers, who proceeded

to arrest her.After her arrest, Combrink was detained for eight

hours in the police’s holding cells after which she was granted bail of R500. She appeared in court the next day on the said charge. Her case was postponed several times and eventually withdrawn on 25 March of that year on the grounds that “There are no prospects of a conviction. The de-fence (plaintiff) submit-ted proof of purchase of the properties by means of a receipt book and register.” Subsequently, a civil case for wrongful arrest was filed by Combrink.

Judgment in the case was given by Judge J Makgoba in the North Gauteng High Court on 19 April. In his judgement, Judge Makgoba stated,

among other things, that the two officers, who argued that Combrink had failed to produce her control register when asked to do so, did not im-press him as witnesses.

“Both of them were too talkative, long-winded and could not answer questions properly and as asked. They appeared to be tough, uncompromising

and regrettably arrogant police officers who were in a hurry to do their work and not prepared to wait any longer for further explanation from the plaintiff. I reject their version insofar as it dif-

fers with the plaintiff’s version,” Judge Makgoba said. He added that it “is improbable that the plaintiff would have risked arrest and detention instead of simply producing the control register which was in existence.”

In contrast with the two police officers’ testi-mo ny, Judge Makgoba said that, as a witness, Combrink’s credibility was beyond reproach. “She impressed me as a credible and honest witness. She testified in a straightforward manner and at no stage did she contradict herself. I accept her evidence that she offered to show the police officers the control register at her premises but was ignored,” Judge Makgoba said.

Judge Makgoba said that in order to succeed in a claim for malicious prosecution, the plaintiff [Combrink] had to allege and prove that: the de-fendants set the law in motion – they instigated or instituted the proceeding; the defendants acted without reasonable or probable cause; the defen-dants acted with malice or animo injuriandi; and the prosecution had failed.

In this regard, Judge Makgoba said that, accord-ing to Ramuthuthu and Makananise’s testimony, Combrink was arrested for failure to produce a control register and, as a consequence, was charged with being in possession of suspected stolen prop-erty. Ramuthuthu and Makananise also maintained that Combrink was arrested on reasonable suspicion that a Schedule 1 offence (possession of stolen property) had been committed and therefore the arrest was lawful.

Judge Makgoba refuted this, however, and argued that had Ramuthuthu and Makananise al-lowed Combrink to explain and produce the control register, they would have found that the plaintiff could not have reasonably been aware that any of the goods in the cash sale book were stolen. Judge Makgoba also stated that Ramuthuthu and Maka-nanise could also not explain why Combrink would have failed to produce this register and by doing so take the risk of being locked up in the police cells.

“The suggestion by the third defendant [Ramuth-uthu] that the control register did not exist at the time of the arrest but was later ‘created’ or forged to

ise acquired and perused the control register, they would have not instigated a process of prosecu-tion against Combrink. “Consequently, there was malice (animus injuriandi) on the part of the two police officers to cause the charge to be preferred against the plaintiff. In this regard, animus injuri-andi means that the police officers directed their will to prosecuting the plaintiff in awareness that reasonable grounds for prosecution were absent; in other words, that their conduct was wrongful,” Judge Makgoba said.

Upon concluding that Ramuthuthu and Makana-nise’s conduct was wrongful, Judge Makgoba said that that brought him to the issue of quantum (how much damage the plaintiff had suffered in monetary terms). In this case, he said, the indignity Combrink had suffered was taken into consideration.

In his verdict, Judge Makgoba mentioned Com-brink’s age. He stated, among other things, that she had suffered indignity by being arrested in front of her employees and then had to sit between Ramuthuthu and Makananise when taken to the police station in their vehicle, with the driver rub-bing against her leg every time gears were changed. At the police cells, Combrink had to stand in the excruciating mid-summer heat and could not stand up when required to do so and other prisoners had to help her up. “She had to wipe her hands on her clothes after fingerprints were taken and was treated with the utmost disrespect. To add salt to the wound, the plaintiff was arrested three months after the death of her son and only three weeks after the death of her husband,” Makgoba said.

Upon taking all of the above into consideration, Judge Makgoba delivered judgment in favour on Combrink as follows:

* That the Minister of Safety and Security, Ramuthuthu and Makananise are ordered to pay Combrink the sum of R60 000 damages jointly and severally, the one paying the other to be absolved plus interest thereon at the rate of 15,5% per annum from the date of judgement to the date of payment.

* That the Minister of Safety and Security, Ramuthuthu and Makananise are ordered to pay Combrink the sum of R13 886,56 (being her initial legal cost in defending her criminal prosecution) jointly and severally, the one paying the other to be absolved plus interest thereon at the rate of 15,5% per annum from 3 August 2008 (date of demand) to the date of payment.

* That the defendants pay the costs of the action on a party-to-party scale, meaning that Combrink would pay all her legal fees to be reclaimed from the defendants.

Acting on behalf of Combrink was Advocate Marisa Naudé, on instruction of attorneys Coxwell, Steyn, Vise and Naudé.

Die volgende oggend het sy opgemerk hoe mense verby haar sakeperseel ry en met ag-terdog na haar loer. Selfs in winkels, sê sy, het mense haar voorgekeer met die woorde: “Ons hoor jy was in die tronk!”

“Op grond van hierdie vernedering het ek gesweer ek gaan die saak nie hier laat nie,” het Combrink gesê. Sy het vertel hoe stomgeslaan sy was

met die polisie se aankoms by haar om haar te arresteer net meer as vyf jaar gelede.

“Alles het onwerklik gevoel. Ek het nie besef wat aan die gebeur is nie, totdat hulle my by die draadhok by die polisieselle ingevat het. Dit was eers toe dat die realiteit dat hulle my gaan toesluit, ingesink het,” het Combrink gesê. Die haglike toestande waarin sy en mede-aangehoudenes in die selle moes bly, was vir haar verskriklik. “Vuil vertel ek jou ... hulle [die mense wat reeds in die selle was] het sekerlik vir dae nie water gehad nie. En die reuk ... dit was ondraaglik,” het Combrink gesê.

Na afloop van die hofuitspraak in haar guns het Combrink gesê dat dit nooit vir haar gegaan het oor die geld nie. Haar eie hofkoste beloop meer as R100 000. Dié het sy reeds betaal, met haar regsverteenwoordiger wat gaan probeer om dit van die Minister van Polisie en die twee betrokke polisie-beamptes te verhaal.

“Al betaal hulle elk net R10 uit hul eie sakke, is ek bly. Wat hulle gedoen het, was onwettig en onregverdig,” het Combrink gesê.

• MUSINA FAMILY LAW HELP DESK A maintenance and general family law help desk has been established at the Musina Magistrate’s Court by ProBono.Org to promote access to justice by making pro bono lawyers available to assist people who find themselves in domestic violence situations and need to enforce their rights.

The aim is to facilitate the smooth administra-tion of the courts and to provide individuals with free legal assistance that will enable them to obtain relief more easily.

The help desk can provide general legal advice, assistance in completing necessary documents or forms, guidance regarding court procedures, referral to appropriate court officials and, where the domestic violence matter is dif-ficult and unresolved, refer the matter to a pro bono attorney.

The help desk will be available every first Monday of the month from 08:00 to 12:00.

• BUSHVELD WALK Ridgeway Col-lege in Makhado (Louis Trichardt) is once again hosting a Bushveld Walk on Saturday, 11 May.

Registration begins at 09:00, with the race starting at 10:00. Athletes can choose between the 5km or 10km race. The entry fee is R15 for primary-school children and R30 for high-school children and adults. Corporate teams and spon-sors are also welcome.

To get to the venue, drive south on the N1 from town and turn left on the Ford Edward Road. From there, travel another 3km, then turn right at the signpost for the Walk-a-thon.

• MONSTER ROCK FESTIVAL Residents of Makhado (Louis Trichardt) can start getting ready for the next Monster Music Festival to be held at the Rugby Lapa on 1 June.

The first band will perform at 12:00, with fétes opening at 11:00. In total, 13 bands will be performing, showcasing the best bands in Limpopo along with bands from Gauteng. The music showcased covers a wide spectrum of genres - from Afrikaans and oldies to classic rock and rock.

Bands playing include Van Smith, Flatlander, Die Vynils, Comet D Strings, Borderline, Mo-ments in Oblivion, Dezgheta, *9#, Lizzie, Rein-hardt gone solo, MeeM and Sold out.

There will be cash prizes for the tyre-throw and bungee-pull competition, as well as lucky draws and give-aways. A boat race competition will also take place. Other attractions include food and merchandise stalls, a tattoo artist and a jumping castle for the kids.

The race is hosted by the Polokwane Pedallers, with different age categories according to the UCI category list. The XCO route will be 6km for seniors and 4km for juniors under the age of 16.

Registration opens at 06:30 on the day of the race and closes half an hour before the race starts. A day-licence fee is only payable if the cyclist does not hold a valid CSA licence. Entries will be R70 for all categories. Registration can also be done at Salojees in Polokwane on Friday, 10 May.

The proposed Musina West-ern Ring Road Project now has official authorization.

The national department of environmental affairs authorized the project on the 28th of last month (March) after having been satisfied with the environ-mental impact assesment report, which was available for public review from 30 May to 30 June last year.

The environmental authoriza-tion was granted at the request

of the South African National Roads Agency Ltd. (SANRAL), who intends to upgrade and construct a new section of the N1 as a ring road to the west of Musina. The scene is now set for the construction of this new road, which will link the exist-ing carriage way to the south of Musina, from just before the entrance to the military base to the existing carriage way of the N1 to the north of Musina.

According to an earlier me-

dia release from the Musina municipality, the ring road will alleviate the serious congestion currently being experienced by international heavy-vehicle transport along the main road running through the centre of the town.

An environmental impact as-sesment was conducted for the proposed route in terms of the appropriate regulations and the draft report was made available for public comment.

Australian mining company Coal of Africa Limited (CoAL) experienced a very unstable end to their third quarter, which ended on 31 March 2013. Even so, they have no intention of stopping development of their various projects in the water-sensitive Soutpansberg coal field.

This state of affairs was revealed in a quarterly report that CoAL released on Monday.

CoAL’s export coal sales took a 34.1% plum-met to 271 069 tonnes in the March 2013 quarter, compared to the preceding quarter. Domestic coal sales also decreased with 27.1% to 112 440 tonnes, compared to the previous quarter.

This was largely due to CoAL’s waning resourc-es at their Vuna colliery in Middelburg. In addition, the mine was hit hard when their Vele colliery here in the Soutpansberg flooded in January this year.

Vele received more than 500mm of rainfall in four days, flooding the open-cast coal pit and forcing CoAL to close down operations for three whole weeks. Shortly after the floods, in Febru-ary, the collapse of a bridge along the Matola railway line also prevented CoAL from exporting coal. The railway, which is operated by Transnet Freight Rail, runs from Vele through to the Matola terminal in southern Mozambique, from where the coal is exported.

Outgoing CEO of CoAL Mr John Wallington confirmed in the report that the bridge was fixed on 19 April and that CoAL is expected to start exporting coal by mid-May.

With an eye to the future, CoAL said they ex-pected to spend around $15.0 million in develop-ment projects for the June 2013 quarter. This will include expansion and upgrading work to be done at Vele, as well as the completion of their Makhado project’s feasibility study and drilling and explora-tion work at their MbeuYashu project.

The MbeuYashu project is the new name that CoAL gave their Greater Soutpansberg Project

(GSP). The GSP incorporates CoAL’s Chapudi, Mopane and Makhado projects. The new name was decided on during the March 2013 quarter, when CoAL continued to compile exploration and techni-cal data on the GSP project. CoAL has confirmed that, as soon as the exploration work is done, that they will start applying for the various new order mining rights to start mining at MbeuYashu. For the Makhado project, which is 65km south-west of Musina, CoAL is currently waiting for their mining right to be granted, subject to completing a black-economic-empowerment transaction for the project.

For this project, CoAL apperently admitted dur-ing an info meeting held at Tshipise on 20 April that they are still not sure where the water will come from to operate the mine.

sien - ‘n vrolike en lewenslustige sewejarige met ‘n gesonde eetlus en baie sêgoed. Reinhardt is nou in ‘n vensterperiode vir twee jaar, nadat hy in Julie verlede jaar sy medikasie en behandelings voltooi het.

“Die afgelope vier jaar was ‘n roller coaster ride. Die heel moeilikste was om te sien hoe jou kind hulpeloos daar lê en jy kan niks vir hom doen nie. Gelukkig vergeet ‘n mens baie van die goed. Dit is iets wat jou sterk maak in die geloof en jou verhoudings met jou gesinslede, familie en vriende versterk,” sê Ma Louise, terwyl sy terugdink. Sy sê dat 2009 en 2010 twee moeilike jare was waarin ‘n baie siek Reinhardt in en uit die hospitaal was. In 2011 is daar ‘n virus in sy bloed gevind en het hy elke maand bloedoortappings ontvang.

“Die afgelope jaar was ‘n goeie een, veral vandat die kankermedikasie gestop is en sy liggaam sy eie immuniteit kon opbou. Reinhardt het verlede jaar ‘n hokkiewedstryd gespeel, maar ek dink hy was meer in die span as ‘n mascot!” sê Louise.

Reinhardt vertel met groot oortuiging dat hy baie van speel hou en niks van stilsit nie en demonstreer daar en dan hoe hy ‘n denkbeeldige rugbybal gaan skop. “Ek hou van wegkruipertjie, touchers en krieket. Ek hou baie van krieket, om te kolf en te boul,”sê Reinhardt, terwyl kleinboet Ewan (5) die nuus meedeel dat die krieketkolf gebreek het. Ma Louise sê dis omdat die kolf vir allerhande ander doeleindes ook gebruik word …

Die twee boeties maak seker dat hulle geboort-edatums noukeurig aangeteken word. Reinhardt sê dat hy op 14 September agt word en Ewan word sommer een van die dae (op 19 Junie) ses. Albei is in die CVO Skool Zoutpansberg, ouboet in Graad 2 en kleinboet in Graad 0

“Die ding is nou om deur die vensterperiode te kom. Volgens die dokter is hy vir alle praktiese doeleindes leukemie-vry. As hy deur die twee-jaar periode kom (vanaf Julie 2012) en nie ‘n terugslag ondervind nie, sal sy kanse daarna dieselfde as joune en myne wees om kanker te kry,” sê Louise. Nege maande van dié periode is reeds verby.

Hierdie drie jong rugbyspelers van Laerskool Messina is na afloop van hul wedstryde op 22 April in Makhado (Louis Trichardt) verkies tot die Soutpansberg-span wat op 11 Mei aan die volgende rondte proewe gaan deelneem in Polokwane. Netbalspelers van Laerskool Louis Trichardt het hulle netbalvaardighede verbeter deur ‘n netbalkliniek onder leiding van bekende net-balafrigter Martie Morey by te woon.

Al die netbalspelers, van die O/8-spelertjies tot by die O/13’s, het baat gevind by hierdie net-balkliniek, wat op 12 en 13 April by die skool aangebied is.

Morey, wat ook die afrigter van TUKS se Jongspan is, het die spelers gehelp om verskeie netbalvaardighede aan te leer, soos balvaardighede, aanvalstegnieke, spelpatrone, doelskiettegnieke en verdedigingsmetodes. ‘n Netbalspeler van Afrikaans Hoër Pretoria, Natalie du Plooy, het vir Martie bygestaan.

Die skool se netbalafrigters, waaronder Sussa Ehlers, Melinda du Plessis, Carina Joubert en Elisma Cordier, het die kursus baie leersaam ge-vind. Die kursus is georganiseer deur die netbalklub van Laerskool Louis Trichardt.

“Hulle netbal is sterk, hoor. Ek het baie lekker afgerig. Ons het ‘n goeie ontvangs gehad en alles was baie goed georganiseer,” het Martie Morey op 25 April gesê.

Die netbalklub bedank die volgende instansies en persone vir hul hulp en bydrae om hierdie netbal-kliniek moontlik te maak: Renthia Geyer van Grape Vine Gastehuis (vir die borg van die verblyf), Jan Kleynhans, eienaar van Mike’s Kitchen (vir die borg van etes), asook Anriëtte Knoetse, Vanessa Gilfillan, Madelein Nel en ander ouers vir hulle positiewe bydrae en hulp gedurende die kursus.

With just five more weeks to go before this year’s Krem-etart Cycling Race, things are really buzzing to finalize all the preparations for this popular one-day, stage cycling road race.

This year, the race will take place from 7 to 9 June and in-dications are already that there is going to be a record number of entries for the race.

Ms Renda Alexander, one of the race organisers, says that the online entries for the race are already 67% more than at this time last year.

This year, the race will also not be limited to 1 200 entries as in previous years. The or-

ganisers will prepare for 1 500 cyclists and their supporters. The Kremetart Mountain Bike race will also be hosted as a Cross Country Olympic event, and will also be a Limpopo qualifying event.

Online registration is already open and cyclists who wish to enter are encouraged to do so soon before all the slots are snatched up. Cyclists can log on to www.kremetartcycling.co.za to register.

Various local charity or-ganisations like Ladies Circle 4, Save the Rhino, Choc and the Round Table have come aboard and will support the race. Other businesses and organisations are

also encouraged to book a booth if they want to sell their products or advertise their services dur-ing the race weekend.

With this record-breaking Kremetart, accommodation for visitors is already fully booked and becoming a serious head-ache for the organizers. They have therefore appealed to any-one who may have accommoda-tion available, such as a room to rent, to phone Pétria Marais at 015 516 5771. She will be responsible for coordinating all the accommodation available at private homes.

Annual Kremetart around the corner

Die jaarlikse Grab-a-Granny/Dapper Stapper-geleentheid en rolstoelwedren op 27 April het, soos gewoonlik, baie pret opgelewer.

Me. Drienie Franklin (regs) wen die pretloop vir vroue tussen 70 en 79 jaar. Mnr. Giel Nel,die manswenner in hierdie afdeling, was afwesig tydens die neem van die foto. By tannie Drienie is me. Kittie de Bruin van Ons Tuiste.

Die trofeë word oorhandig by die Dapper Stapper/Grab-a Granny pretloop op 27 April. Van links na regs is me. Kittie de Bruin, bestuurder van Ons Tuiste, en me. Koeks Manser, wat die stapafdeling vir die ouderdomsgroep 80 jaar en ouer gewen het.

Die jaarlikse Grab-a-Granny/ Dapper Stapper rolstoelwedren en pretloop ten bate van Ons Tuiste Ouetehuis in Makhado (Louis Trichardt) het, soos gewoonlik, baie pret opgelewer.

Tannie Braampie Viljoen, in die rolstoel gestoot deur mnr. Jan van Wyngaardt, het die eer te beurt geval om die ander rolstoele weg te rol. Hulle ontvang die wisseltrofee vir die beste rolstoel-span. Hulle gesamentlike ouderdom was ‘n volle 166 jaar!

Tannie Koeks Manser stap flink en het die pret-loop vir die ouderdomsgroep bo 80 jaar gewen. Die mans- en vrouewenners vir 70 tot 79 jaar is mnr. Giel Nel en me. Drienie Franklin, terwyl mnr. Jan van Wyngaardt die trofee vir mans 60 tot 69 jaar al vir die soveelste keer inpalm. Me. Corrie Coetzee wen die vrouetrofee in hierdie afdeling.

By die 9.9km-wedloop hardloop Mathabi Ndi-vho onder almal uit en is die manswenner, terwyl

Sheryl James die vrouewenner en Chrisli Markram die O/12 wenner is. By die 5km is die wenners Au-brey Rambau (man), Glory Nkoana (vrou), Tanaka Musariri (seun) en Makgomo Nkoana (meisie). Die 3km manswenner is past. Ernie Whitcomb, met die ander wenners me. Diane Bannatyne (vrou), Ruben Potgieter (seun) en Lee-Ann de Vos (meisie).

Die prys vir die meeste gees vir die dag is gesamentlik gewen deur Ashley Lawrence en Sa-lomé Lubbe. Hoewel daar minder deelnemers as gewoonlik was as gevolg van baie geleenthede wat op dieselfde dag plaasgevind het, sê organiseerders Lucas en Rina Vermeulen dat dit steeds lekker was en dat daar ‘n goeie vooruitsig vir volgende jaar is. Dapper Stapper word weer goed ondersteun

Die Dapper Stapper wenners vir die ouder doms-groep 60 tot 69 jaar vertoon hulle trofeë. Van links na regs is me. Corrie Coetzee en mnr. Jan van Wyngaardt, wat die wisseltrofee al vir die soveelste keer inpalm.

Hierdie gedugte rolstoelspan, bestaande uit me. Braampie Viljoen (voor) en mnr. Jan van Wyngaardt (links agter), het die rolstoelresies gewen. Hulle het ´n gesamentlike ouderdom van 166 jaar! Saam met die span is me. Kittie de Bruin van Ons Tuiste, wat die prysuitdeling behartig het.

Mathabi Ndivho en Sheryl James is die manswenner en vrouewenner van die 9.9km-wedloop tydens die pretloop ten bate van ons Tuiste op 27 April. Van links na regs is Mathabi, me. Kittie de Bruin, bestuurder van Ons Tuiste, en Sheryl.

Bo: Limpopo se O/19-seunspan verwerf ‘n twee-deplek in die A-afdeling van die Suid-Afrikaanse Junior Platteland-toernooi wat vanaf 25 tot 28 April in Bloemfontein plaasgevind het. Erik Welman en Gysbert Guillaume van die Soutpansberg Muurbalklub het deel gevorm van die span. Erik wen al sy wedstryde en word aangewys as die nommer 1 SA Platteland-speler vir 2013. Hy word ook ingesluit in die SA Platteland span wat vanaf 22 tot 26 Junie aan die SA Interprovinsiale Toernooi in Kaapstad gaan deelneem. Gysbert word op sy beurt gekies as reserwe vir die span. Voor, van links na regs, is die O/19-span, bestaande uit Ronel Welman (spanbestuurder) en Erik. Agter is Gysbert, Calvyn van Wyk (Polokwane) en Christiaan Labuschagne (Polokwane). Foto verskaf.

Erik is beste Platteland-speler

Limpopo se O/16-seunsmuurbalspan het vanaf 25 tot 28 April deelgeneem aan die Suid-Afrikaanse Junior Platteland-toernooi in Bloemfontein en as wenners van die B-afdeling uit die stryd getree. Pieter Guillame en John Kuhne van die Soutpansberg Muurbalklub in Makhado (Louis Trichardt) het deel gevorm van hierdie wenspan. Pieter wen al sy wedstryde en word ingesluit in die SA Platteland-span wat vanaf 22 tot 26 Junie aan die SA Interprovinsiale Toernooi in Bloemfontein gaan deelneem. Van links na regs staan spanlede Pieter, Pieter Maré (Polokwane), Yvonne Kotzé (spanbestuurder), Wouter Kotzé (Tzaneen) en John. Foto verskaf.

Hierdie rugbyspelers van Laerskool Louis Trichardt is gekies om aan die provinsiale rugbyproewe in Polokwane deel te neem. Die O/12-spelers se proewe is op 10 Mei en die O/13’s op 11 Mei. Voor is die O/12 rugbyspelers. Hulle is, van links na regs, Ruan van Tonder, Dewald van der Westhuizen, Stefan Corbett, Roy Stewart, Nsuku Baloyi, Ruan Ackerman en Johannes Joubert.
