Ini kerana Menteri Besar, TanSri Abdul Khalid Ibrahim engganmengulas mengenai status kon-traktor-kontraktor tersebut dan

. dilihat kurang senang ketika di-ajukan soalan mengenainya olehwartawan.

Malah, beliau dilihat seolah-olahmenyalahkan kontraktor terlibatkerana mendedahkan rintihan me-reka kepada pihak media.

Abdul Khalid mengumumkanperkara itu ketika beliau mempe-ngerusikan Mesyuarat TindakanEkonomi Selangor (MTES)pada 17Februari'lalu.

TImbalan Yang Dipertua MPSJ,Abdullah Marjunid berkata, langkahjangka pendekclanjangkapanjangdi-ambil di kawasan cenm berisil<oter-utama di Bandar Puteri 9.

Menurutnya, bagike$Bandar PUteri9, MPSJ menubuhkan JawatankuasaBencana Alam terdiri daripada kakita- .ngan JabatanKejuruteraan MPSJ,wakilpolis, Jabatan Bomba clan Penyelamat,Pejabat Tanah, penduduk clan pernajuperurnahan.

Sementara bagi cenm lain, pe-mantauan dijalankan secara berkala dan

kontraktor dilantik mengambil tindakan

After a publichearing in2008, Sime Darby Property revertsthe park to status quo as a recreationalarea.

MAY 17,2009~ The State Planning Committee (SPC),under the State Planning Department, ap-proves in principle Sime Darby PropertyBerhad's proposed development at 7.7ha ofthe 29.39ha park in a meeting on April 21,2009. The approval is granted on conditionthat the company upgrades the remainingarea ofthe park and surrenders it to MPSJ. Anew access route to the development was tobe constructed.

PETA!..INGJAYA: A total.of 200 Toxorhynchitesmosquitoes were released in USJI, Subang Jayayesterday in a trial attempt to counter the breedingof Aedes aegypti mosquitoes, which is the cause ofdengue fever.

The 100 male and 100 female mosquitoes werereleased by the SubangJaya Municipal Council(MPSJ) in a project in collaboration with UniversitiSains Malaysia and CIMBBank. .

Speaking at a press conference after the release,State Health, Plantation Workers, Poverty andCaring Government executive councillor Dr XavierJayakumar said that this was the first time thesemosquitoes were released in a residential area.

However, he said there was no cause for worryas the mosquitoes do not bite humans and were notthe same as the genetically modified Aedes

The genetically modified (GM)Aedes mosquitoes were released in astudy running from Dec 2010to Jan 5this year.

"The GM mosquitoes are acompletely different organism fromthe Toxorhynchites mosquitoeswhich are found'in the wild, injungles," said Jayakumar.

"We are just bringing them outinto areas where other mosquitoesare breeding," he said.

"The idea is that the larvae ofthese mosquitoes will eat the othermosquito larvae," he added, sayingthat the mosquitoes which had a lifecycle of two months were

indigenous to Malaysia."I hope that we will get good

results from this, and we will knowthe outcome ina month," saidJayakumar, adding that theToxorhynchites mosquitoes werereleased in an abandonedconstruction area as such areas werefound to have the highest'concentration of Aedes mosquitoes.

Mean'fhile, Professor Zairi Jaal ofthe USM Vector Control ResearchUnit said that it was unlikely that theToxorhynchites mosquitoes wouldbe found in homes as they preferredforested areas. .

THE Subang Jaya MunicipalCouncil (MPSJ) and residentshave won the Subang Ria Park

case after the Appeals Board rejectedthe developer's application for plan-ning permission yesterday.

Board member Datin Teh ZawahirAbdul Malek said the council couldnot grant planning permission if theapplication did not conform to thezoning ofthe local plan.

"The developer's planning applica-tion for exclusive housing and medi-cal suites for its medical centre arenot defined under the local plan'szoning," Teh said.

She said the park was only for rec-reational use and at the time theapplication was made, the local draftplan was still in force and not theLocal Plan 2020 which was, gazettedin Maylastyear. -

Under the local draft plan, the total29.39ha of the park was classified anopen space, while under the LocalPlan 2020 approval was given inprinciple by the state planning com-mittee to Sime to develop 7.7ha ofthe park.

"So the board agrees that MPSJiscorrect in rejecting Sime DarbyPrope~e~' planning application forsub-dIVl~mgthe land and changing apart of It from recreational to resi-dential and commercial," she said.

Another board member Ho KhongMing said the proposed developmentof 7.7ha of the park was too large tobe disregarded as something minor.

"However, the appellant can stillsubmit their application that,~om-plies with the land use zoning of thelocal plan.

"SubangJaya residents need a pub-lic open space and not necessarily anupgraded and more expensive park,"said Ho, while also advising the stateto wor~ with Sime to revert to a pub-lic recreational area," he said.

He added that the board was sadthat the local plan process was flawedin two aspects, which was in themanner it was approved and its con-tents.

"The manner in which it wasapproved showed absence of com-munication and consultation betweenthe state planning committee and thelocal authority.

"And the local plan should not beused as a vehicle for conferring privi-leges to selected landowneI:s.

"The respondent (MPSJ)in thiscase, should 'clean' up the local planof its flaws with the assistance of thestate planning committee," said Ho.

Board president Datuk Abu BakdrAwang said the appeal was rejecteC\without any cost ordered on anyparty.

Rajiv Rishyakaran, who is specialassistant to Subang Jaya assembly-man Hannah Yeoh, said the good

news was that the local plan wasbeingproperlyadheredto.

"It'san importantmilestoneto puton record.Nowwe need to continuepushing Sime to seriously considerreturning the park,"saidRajiv.

Subang Jaya Residents AssociationchairmanAS.Gillsaidhewaspleasedwith the .decision and hoped thiswould serve as a precedent else-where.

SHAH AIAM: The Selangor StateAp-peals Board has rejected Sirne UEPProperty Bhd's appeal to subdivideand reclassify 7.7ha of the 29.3haSubang Ria Park in SS12 from recre-ational to commercial and residen-tial.

The unanimous decision was madeby a three-member panel at Ban-gunan Darul Ehsan yesterday.

In May last year, the Subang JayaMunicipal Council had reject the ap-plication as it was not in line with thezoning of recreational land gazettedin the Subang Jaya Local Plan 2020.

In delivering the judgement, boardmember Datin Teh Zawahlr AbdulMalek said the type of developmentstated in Sirne UEP's application wasnot included under recreational.

"It is limited to bistros, waterfrontcafes, art, as well as recreational ac-tivities. Since medical snites and res-idential housing are not related torecreational and are not compatiblewith the title of Subang Ria Park,which is recreational, we have re-

,principal the development on the7.7ha plot following a meeting onApril 21, 2009.

The approval was given based onthe condition that the park would beupgraded and surrendered to thecouncil, and that there would be anadditional access road into the pro.posed development.

However, the council rejected theproposed development as it was notill line with the<:ommercial zoning ofthe park.

An appeal was made by Sirne UEPat the board against the council's de-cision.

Echoing Teh Zawahir, board panelmember Ho Khong Ming descrthedthe ownership of Subang Ria Park asmore of an agony than an asset toSirne UEP.

"This may be an opportunity toconsider an amicable agreementwith the state authority to make Sub-ang Ria Park a truly public park.

"The people ofSubang Jaya need apublic open space, not necessarily anupgraded, sophisticated and costlyrecreational facility. The hoard is en-

Ho added that the Local Plan wasflawed in the manner in which it wasapproved and its contents.

"The absence of communicationand consultation between the SPCand Local Plan authority introduceda lack of transparency and possiblyan element of public distrust.

"In its contents, a local plan is astatutory plan with 'a general appli-cability for an entire municipality. Alocal plan should not be a vehicle forconferring privileges to selectlandowners," he said, adding thatSirne UEP was free to submit a newplan that cQmplied with zoning re-quirements.

The board also strongly suggestedto the council, as the owner of theSubang Jaya Local Plan 2020, to seekthe assistance of SPC to rectify thelocal plan.

'Panel head Datuk Abu BakarAwang, said no cost was ordered toany of the parties.

Sime Darby representatives de-clined to comment.

The special assistant to SubangJaya assemblyman RajivRishyakaran said it was a big reliefthat the only decision that shouldhave been made was made.

"This matter which has dragged onfor the last couple of years has finallycome to an end, with a very cleardecision. W. need to continue to pre-serve whatever recreational land

tliat we have, so this is a very goodstart. We hope Sirne UEP will seri-ously consider giving the park back,"he said, adding that it was good thatthe Local Plan was respected.

Subang Jaya Residents Associationchairman A.S. Gill hoped that SimeUEP would hand the park hack toresidents after basic upgrades werecarried out.

Eightareastargetedfor clean-upKUAlA LUMPUR: The city is set toundergo a massive clean-up follow-ing the launch of the Gerak 'fumpucampaign in Chow Kit yesterday.

The campaign, which will focus oneight areas in the city, is a collab-oration between Alam Flora Sdn Bhdand City Hall.

The areas are Jalan Bukit Bintang,Jalan Doralsamy, Pudu, KampungAttap and tittle India in Bricldields,Kompleks Damal, Damansara andLucky Gardens in Bangsar.

The areas were chosen becausethey were deemed not clean enough.

Alam Flora Sdn Bhd chief executiveofficer Mohd ZaIn Hassan said that

the campaign was launched to tackleillegal dumping in the city centre.

"Federal Territories and UrbanWellbeirig Deputy Minister Datuk M.Saravanan, during a visit to BukitBintang, told Alam Flora to clean upthe area as part of its Key Perfor-mance ludex O<PD. We started thecleanliness campaign since May 9and will take about two months tocomplete it. w. will be conducting thecampaign in stages, with at least

three days in each area," he said.Zain said Alani Flora would be ex-

tending its cleaning hours in tittleIndia, Bukit Bintang and Masjid in-dia. It collects 2,200 tonnes ofgarbage daily around the city.

"These three areas are usuallybusy with a high number of touristspatronising the many restaurantsand retail outlets. Thus, the areasgenerate a lot of garbage. W. will beextending our collection of rubbishfrom 5.30pm to 2amthe next morn-ing," he said. Previously, such ser-vices were carried out from 4.30amto 5.3Opm.

ZaIn said that the campaign willnot only focus on the city centre butwill be expanded to other areas. "Forthe time being, we will focus on thecity centre. We will later move on toother parts of the city as part of anon-going elTort to clean up the cityand its surrounding areas," he said.

Zain also urged the public to playiheir role inkeeping the city clean. Hesaid they shonld dispose of theirgarbage in proper bins and ensureihat ihe plastic rubbish bags do

not leak."In most residential areas, only

about half of households have propergarbage bins, while in commercialareas, only 60 per cent have garbagebins. Usually, it is only after we haveissued notices that people buy propergarbage bins, hut this is not enough.What we need to achieve is total com-pliance in all areas," he said.

Zain said that those who do nothave garbage bins will be fmed be-tween RM30 and RM1,OOOfor res-idential homes, and between RMlooand RM1,OOO(commercial areas).

IT IS illegal to,combine a childcare~ntre and kindergarten in thesame premises. According to the

Sodal Welfare Department, a child-care centre and kindergarten cannotoperate from the same premises.

"Child care centres and kindergar-tens have to operate from two sepa-rate premises. If it is in the samehouse, it has to be separated by awall and must have separateentrances.

"Renovation-wise, the localauthority has to approve first," saidan officer from the WelfareDepartment.

He pointed out that the activitiesand menu for 'children at child care

centres and kindergartens were dif-ferent, and it would be "dangerous"for children from two different sec-tors to mix. '

"Even the permits are issued bydifferent departments.

"Usually, activities in a childcarecentre will entail play sessions andeven naps.

"But classes are not allowed asthis will classify it as a kindergar-ten," he said, adding that the depart-ment would take action againstchildcare centres that doubled up askindergartens,

All childcare centres are requiredto register with the nearest WelfareDepartment office.

Random enquiries made to child-care centres in Bandar Kinrara 4 and5 in Puchong revealed that some aredoubling up as kindergartens,

past 12'to 15 years while otherswere only approved last year.. A few of these childcare centres,when approached, said they didcater for kindergarten children.

Althoughone of them admitted itwas "dangerous"to doso,hence theyonly provided transportation to thenearest kindergarten but did notacceptthe childreninto their centre.

When MPSJ received the pro temresidents association's objection let-ters in December 2009 on grounds'of noise pollution, disturbance andtraffic woes, the local authorityrejected the centre's application.

Another resident asked MPSJ tocheck on the operating hoursbecause tJie centre was open untilthe night and sometimes on week-ends.

She claimed that her childcarecentre was to only look after chil-dren and other services adverti~on her banner were not conductedon the premises.
