Ill. DEFINITIONS

As used in the context of this plan, the following terms arc dct:ned:

• "Small Business" means a concern, including its affiliates, that is Independently owned and operated, not dominant in the field of operation in which it is bidding on government contracts, and qualified as a Small Business under the criteria and size standards in 13 CFR Part 121. S~.;ch a concern Is "net dominant in Its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity In w hich a number of business concerns are primari ly engaged. In determining whether dominance exists, consideration mus~ be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license a~::reements, facilities, s-. les territory, and na~ure of business activiw. (See 15 U.S.C. 632.)

• "Small Disadvantaged Business (SDB)" means a Small B·Jsiness concern that is at least 51 percent owned by one or more individua Is who are socia:ly and economically disadvantaged, or a pJbllcly owned business having at least 51 percent of its stock owned by one or more socially and t!Conomlcally dis~dvantaged individuals and has its management and daily business controlled by one or more such individuals. This term also means a Small Business concern that is at least 51 percent unconditionally owned by an economically disadvantaged lndian·Owned tribe or Native Hawaiian Organization, or a publicly owned business having at least 51 percent of Its stock uncondit ionally owned by one or more of these entities, which has its management and daily business controlled by members of an economically disadvantaged Indian-Owned t ribe or Native Hawaiian Organization, and tha: meets the requirements of 13 CFR 124.

• "Women-Owned Small Business (WDSB)" means a firm which meets the above criteria as a Small Business and which is at least 51 percent owned by one or more women; or, In the case of any publicly owned business, at lr.ast 51 percent of the stock of which is owned by one or more women, and whose management and daily business operations arc controlled by one or more women.

• " HUBZone Small Business (HZSB}" means a firm which neets the above criteria of a Small Business, that is located in a qualifled census tract, a quali fied "non ·metropolitan county", or lands within the boundaries of f ederally recognized Indian reservations; is owned and controlled by one or more U.S. Citizens, and at least 35% of its employees reside in a HUBZone.

• "Veteran·Dwned Small Busfness (VDSB)" means a Small Business concern not less than 51 percent of which is owned by one or more veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and the management and daily business operations of which are controlled by one or more veterans.

"Servlce·Disabled, Veteran·Owned Small Business {SDVOSB}" means a "Small Business concern owned and controlled by service-disabled-veterans'' (as defined in section 101 (16) of title 38, Uflited States Code); not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case any publicly owned busi.'1ess, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and the management and dally business operations of whic:h are contro~led by one or more service-disabled veterans or, in the case of a veteran with permanent and severe disabili ty, the spouse or permanent caregiver of such a veteran.H

• "Historically Block Colleges and Universities (HBCU's}" means Institutions determined by the Secretary of Education to meet the requirements of 34 CFR Section 608.2.

• "Minority Institutions (MI's)" means institutions meeting the requirements prescribed by the Secretary of Education at 34 CFR 607.2. The term a:so includes any nonprofit research institution that was an integr<~l part of <1 historically black co!lege or university before November 14, 1986.

• " lndlan"···any person who is a member of any !ndian tribe, band, group, pueblo, or community that is recognized by the Feder~ I Government as eligible for services from the Bureau of Indian Affairs (BIA) in accordance w ith 25 U.S.C. 1452(c) and any "Native" as defined in the Alas!<a Native Claims Settlement Act (43 U.S.C. 1601) or Native Hawaiian organization as defined by 15 U.S.C. 637(a)(15) and 13 CFR 124.3.

• Hlndian tribe" means any Indian tribe, band, group, pueblo, or community, includ:ng native villages and native groups (including corporations organized by Kenai, Jun eau, Sitka, and Kodiak) as defined In the Alaska Nat:ve Claims Settlement Act (43 U.S.CA"

.!601 et seq.), that is recognized by the Federal Government as eligible for services from the Bureau of Indian Affairs in accordance with 25 U.S.C. 1452(c). This definition also Includes lndlan-owred economic enterpr ises that meet the requirements of 25 U.S,C. 1452(e ).

• "Alaska Native Corporotlon (ANC}" means any Regional Corporation, Village Corporation, · Urban Corporation, or Group Corporation organized under the laws of the State of Alas~a in accordance wi th the Alaska Native Claims Settlement Act, as LJmended (43 U.S.C. 1601, et seq.) and which is considered a minority and economically disadvantaged concern under the criteria at 43 U.S.C. 16?-§kli!}. This definition also includes ANC direct and Indirect subsidiary corporations, joint ventures, and partnerships that meet the requirements of 43 U.S.C. 16:?6(e)(2).
