No. 236 7 /F-5-6/2016/Thirteen : In exercise of powers conferred by clause (0) of

sub-section (2) of Section 180 of the Electricity Act, 2003 (No. 36 of 2003) and in•

supersession of this department's Notification no.F.5-06-2006-X111- dated .29th November,

2011, the State Government, hereby, makes following rules for levy of fees for inspection

and approval of electrical installations by Chief Engineer (Electrical Safety) and Chief

Electrical Inspector, Superintending Engineer (Electrical Safety) and Deputy Chief Electrical

Inspector, Executive Engineer (Electrical Safety) and Divisional Electrical Inspector,

Assistant Engineer (Electrical Safety) and, Assistant Electrical Inspector and Sub-engineer in

exercise of their powers and execution of. fimetions assigned under section 162 of the said

Act, namely:-

RULES

1. Short tide, extent and commencement-

These rules may be called the Levy of Fees for Inspection and Approval of Electrical-

Installation (Madhya Pradesh) Rules, 2017.

They shall extend to the whole of Madhya Pradesh.

They shall come into force from the date of their publication in the Madhya Pradesh

Gazette.

2. Definitions.- (1) In these rules, unless the context otherwise requires,-

"Act!' means the Electricity Act, 2003 (No. 36 of 2003);

"Regulation" means the Central Electricity Authority (mea.sures Relating to

Safety and Electric Supply) Regulation, 2010;

"Schedule" means the Schedule appended to these rules.

(2) The words and expressions used herein but not defined shall have the same meaning as

assigned to them the Electricity Act, 2003 (No. 36 of 2003) and Central Electricity

.Authority (Measures Relating to Safety and Electric Supply) Regulation, 2010.

No inspection Fees shall be payable on medium voltage equipment installed within

high voltage and extra high voltage installation, but fees shall be payable for Booster,

Capacitor Bank, Generator, Reactor, Motor, Transformer, Breaker/Panel installed

within high voltage and extra high voltage installation at the rate as.spccified•in the

schedule of Part-I (2) on each equipment in accordance to their capacity.

For the generator installed in medium voltage/ high voltage/extra high voltage installation, inspection fees shall be payable at the rate as specified in schedule Part-I (2).

For the approval of -drawing of new electrical installation or addition or alteration of installation, fees shall be payable in advance at the rate of eighty percent of inspection fees as specified in schedule, provided that Inspection fees shall be separately payable in the time of inspection.

Inspection fees for Cinema, k-Ray, High voltage Neon sign tubes, Lift,. escalator. and • generator, shall be payable in each case separately. . •

7: For the internal. installation of marriage gardens or halls / nursing- homes/hospitals/ hotels/ Shopping malls inspection fees shall be payable at the rate as specified in • Of Part-II (one) of schedule and, in case of transformers and generators, installed in these installations, inspection fees shall be payable as specified in schedule part-1(2)

8„ "KiloVolt amperes" Of "BHP" or "KVAR" shall be read instead of "Kilowatts"

wherever the machinery or equipment is so rated. •

Government Water works, sewage pumping stations shall b.e exempted from the levy of • inspection fee.

. For Escalator or Lift installed in medium voltage / high voltage/ Extra high voltage installation, Inspection fees shall be payable at per the rate as specified in schedule Part-ill (II)

Inspection fee for. Generator or cooling •plants in cinema installation shall not be payable separately.

Payment of fees

The fees shall be paid by the owner or. his agent into a Government treasury under the head;

Revenue Head for installation : 0043 — Taxes and Duties on Electricity

except cinema .: 102- Fees under the Indian Electricity Rules and

. Revenue Head for Cinemas : 0043 7 Taxes and Duties on Electricity .

103- Fees for the Electrical Inspection of Cinemas

And the treasury challan shall be sent to the Electrical Inspector or Assistant Electrical Inspector.

13. The fees shall be paid before the date shown below;

For existing installations except those coming under category part-R (One) (2)

and (Two) (2), the fees shall be paid before 1st May in each year. The fees

payable by the Madhya Pradesh Poorv /Paschim /Madhya Kshetra Vidhut Vitran.

Company Limited,.Madliya Pradesh Power Transmission Company Limited and

Madhya Pradesh Power Generating Company Limited for their installations shall

be paid within one month from the date of receipt of the bill after the inspection.

For installations coming under part-11 (Two) (2), the fee for respective half year

'shall be paid before Is! May. and JSI November. Incase the installation is not in

use on the above dates, the fees for he each half year shall be paid before the

installation is used.

(3)' For the new High Tension/Extra High .Tension Generator, installation or new

cinemas including additions or alterations, the fees shall be paid in advance and

the treasury challan shall be send to the Electrical Inspector or Assistant

ElectriCal Inspector along with application for inspection or approval of such

installation. The inspection fee of the new installation shall be payable at the rate

of 150% as specified in Schedule Part-I (2)

For other new installations including addition or alteration and seasonal factories,

the fees shall bd paid before the installations are braught into use.

Fee payable .for additional inspection shall be paid before the date specified by

the Electrical Inspector in each case.

Fees under category part-I (6) shall be levied only for each subsequent inspection

necessitated due to breach of any of the provision of the Electricity Act, 2003 or

rules or regulation made theirunder, separate fee shall be payable for each service

line tapped from the same pole.

14. In case the fee is not paid before. the.dates show in clause (13), the fee payable shall

- increase by 20%

15. In Case the inspection or additional inspection is not carried out, the fees paid shall be

adjusted in the subsequent year or half year.•

If any new installation is brought into use during the last two months of the financial

year, the annual fee paid shall be deemed to cover the short period of the year in which

the fee is paid as well as the full period of the next financial year.

If Xny installation is disconnected or dismantled before an inspection is carried. out no

fee shall be charged.

IS. In case of motor or other apparatus for charging purposes installed on trial for a period

not exceeding 15 days, no fee shall be charged.

"year" for the purpose of this notification means a financial year.

The fee prescribed will be jiayable for each periodical inspection as per frequency of

inspection shown in the schedule. First or initial inspection will be deemed. to be the
