In the horse sport in general and in the show-jumping sport specifically, national borders have long since disappeared. Naturally the ‘orange heart’ will beat a little faster when a Dutch rider enters the arena of the Olympics or an EC or WC. But the days when breeders exclusively used stallions from their own studbook, or when you could only transport your horse across the border after completing a stack of papers, or when an Australian rider could only live and work from Australia, are a thing of the remote past.

Every breeder can choose from the best stallions in the world, no matter which studbook granted his licence. Europe is the centre of the international showjumping sport, where riders from all over the world are working and training. And the top of the international showjumping sport is flying out, week in, week out, all over the world to the best paying competitions in the most exclusive locations to find out who has the best form.

In this international playing field the Expo Talent Sale is a hatchery of top-class talents: the best young showjumping horses from European breeding, trained by the best sport stables and selected by the best showjumping riders. Jeroen DubbeldamJeroen (Zwolle, 15 april 1973) runt in Weerselo zijn eigen wedstrijdstal ‘Stal De Sjiem’, vernoemd naar het paard waarmee hij wereldroem oogstte door tot twee keer toe het hoogst haalbare te winnen: de Olympische titel in Syd-ney en de Grote Prijs van Aken. Met BMC Nassau won de Twentenaar in 2005 de Nations Cup van Barcelona en op het Europees kampioenschap in San Patrignano team brons en individueel brons. In 2006 veroverde de Nederlandse springequipe met Jeroen en BMC Up and Down teamgoud op de Wereldruiterspelen in Aken. In 2007 maakten Jeroen en BMC Up and Down opnieuw deel uit van een gouden team. Zijn beste paard momenteel voor het hoogste werk is Utascha SFN.

highest achievement possible: the Olympic title in Sydney and the Aachen Grand Prix. On BMC Nassau the man from

Twente won the Nations Cup of Barcelona and team and individual bronze in the European Championship of San

Patrignano in 2005. In 2006 the Dutch showjumping team, including Jeroen and BMC Up and Down won team gold at

the Aachen World Equestrian Games. In 2007 Jeroen and BMC Up and Down again rode in the gold-winning team.

His current best horse for the big work is Utascha SFN.

Ben SchröderBen (Tubbergen, 17 april 1971) is de tweelingbroer van Wim en oudere broer van Gerco Schröder. Samen met zijn broer Wim werd Ben als jonge ruiter opgeleid door Hans Bijen van Stal Maathuis. Ben trad later in dienst van Wim van der Vorm van de Margaretha Hoeve en werd Nederlands kampioen met Bollvorm’s Athletico. Als zelfstandige ruiter moest Ben zelf een toppaard opleiden en wachten tot zijn tijd als internationaal topruiter weer zou komen. Daarin slaagde hij dankzij BMC Rubert R en later de aan Athina Onassis verkochte Unaniem. Ben is een voortreffelijke trainer, die menig paard naar de Grand Prix brengt. Samen met zijn broer Wim runt Ben Schröder de BWG Stables in Tubbergen.

Daarnaast ontwikkelde hij zich als topscout van toptalent, zoals de olympische hengst London waarmee Gerco momenteel zeer succesvol is.

Wim SchröderWim (Tubbergen, 17 April 1971) is the elder brother

of Gerco and the twin of Ben. Wim has been connected to Stal Eurocommerce right from the beginning and

largely responsible for the success of this world-famous showjumping stables. Wim wrote important competi-

tions to his name on Eurcommerce Montreal and came fourth in the Nations Cup of the Atlanta Olympics. In

addition, he developed into a top-class scout of top-talent horses, such as the Olympic stallion London on

which Gerco is currently very successful.

Whats Exclusive (v. Indoctro) hebben veel met el-kaar gemeen. Ze waren niet alleen zeer succesvol

op het NK Mierlo, waar Gert Jan Bruggink met PrimeVal Dejavu de titel won en met PrimeVal

What’s Exclusive de Grote Prijs. Beide paarden zijn verkocht op

de Expo Talent Sale aan Dirk Kat en Alex Postma, nog steeds

de huidige eigenaren.

“Van de drie springpaarden die wij op de Expo Talent Sale

kochten, hebben er twee de top gehaald. Dan kun je niet

anders dan heel tevreden zijn”, vertelt Dirk Kat, directeur van PrimeVal voe-

dingssupplementen. “Je koopt hoop. De paarden waren vijf, zes jaar. Je zag dat ze talent hadden, maar dat moet nog wel worden waargemaakt.

Wij hadden toen gelukkig de beste adviseur die we ons konden bedenken, Jos Bruggink, de

vader van onze ruiter Gert-Jan. Wij zijn Gert Jan overigens heel veel dank verschuldigd, want

tenslotte wint de combinatie.”

Dat Jeroen Dubbeldam, Wim en Ben Schröder voor de inbreng van de paarden zorgen, was

de reden om op de Expo Talent Sale te inves-teren in de toekomst. “Een commissie die er

niet om liegt. Drie jongens met gigantisch veel ervaring en ruiters achter zich die voor een

goede training van de jonge paarden zorgen. Dat wekt veel vertrouwen. Bovendien hebben

zij één groot belang: kwaliteit aanbieden. Als

er vraagtekens zouden zijn zou ik nooit meer

op deze veiling kopen, maar die zijn er niet. Dit

jaar ben ik weer van de partij, want PrimeVal wil blijven investeren

in goede paarden en de paardensport.”

A lot of confidence in the selectorsPrimeVal Dejavu (by Heartbreaker) and PrimeVal Whats Exclusive (by Indoctro) have a lot in common. Not only were they both very successful at the NC in Mierlo, where Dejavu won the title and What’s Exclusive the Grand

Prix under Gert-Jan Bruggink. But they were also both sold at the Expo Talent Sale to Dirk Kat and Alex Postma, who are still their owners. “Of the three showjumping horses that I bought at the Expo Talent Sale, two made it to the top. You can only be very pleased with such

a result”, says Dirk Kat, director of PrimeVal feed supplements. “What you buy is hope. The horses were 5-, 6-yr-olds. You could see that they were talented, but that does not yet say everything. Fortunately, at the time I had the best possible adviser, Jos Bruggink, the father of Gert-Jan who would ride the horses. We owe a lot to Gert Jan, because it is the combination that wins.” The fact that Jeroen Dubbeldam, Wim and Ben Schröder select the horses themselves was the reason to invest in horses for the future at the Expo Talent Sale. “A selection committee that deserves the highest respect. Three guys with a gigantic amount of experience and with riders behind them that can make sure of a sound training of these young horses. That gives confi-dence. Besides, one thing is of utmost impor-tance to them: to offer quality. If I would have got the slightest reason for doubt, I would never have bought at this auction again, but I never got a moment of doubt. So I will be back again

this year, because PrimeVal intends to continue to invest in good horses and in the horse sport.”

1Elmo

Elmo wordt met BTW verkocht. Elmo will be sold with VAT.

Wie op hoog niveau wil springen, heeft in Elmo een paard voor de toekomst. Deze jonge ruin ontwikkelt bijzonder veel ver-mogen bij het springen. Hij heeft relatief weinig ervaring, maar laat zich al zeer goed rijden en heeft een goede galop. Een compleet springpaard. Elmo’s vader Quatro Z stamt net als de topspringpaarden Big Star, Star Power, Quick Study en Vleut af van de fameuze Quick Star. Als jonge hengst viel Quatro al snel op en werd hij op zesjarige leeftijd aan Mario Deslauriers verkocht. Het prestatiebloed van Pilot is tweemaal vast-gelegd in de pedigree van Elmo. Zijn half-zus Beau Monde (Padinus) was in 2009 de topper bij het vrijspringen tijdens de KWPN-stamboekopname.

If you want to jump at a high level, Elmo is your horse for the future. This young gelding shows an exceptional amount of power in jumping. He has relatively little experience, but is already easy to handle under saddle and he has a fine canter. A complete showjumping horse. Elmo’s sire Quatro Z descends, like the top-class showjumping horses Big Star, Star Power, Quick Study and Vleut, from the famous Quick Star. Quatro already drew attention as a youngster and he was sold as a 6-yr-old to Mario Deslauriers. The sport blood of Pilot is doubled in the pedigree of Elmo. De merrie lijkt zeer veel vermogen te hebben, heeft een zeer goede galop met veel balans en is goed geconcentreerd tijdens het werk.

Moeder Walanda, een elitemerrie van de wereldberoemde Heartbreaker, sprong op 1.50m niveau met Tobias Thoenes onder de naam Heartbeat en is een volle zus van het 1.50m springpaard VDL Groep Zidane (Eric van der Vleuten). Elanda EB stamt net als de Grand Prix-springpaarden Warrior, Billy Angelo en Vigaro af van Tangelo van de Zuuthoeve.

De in Zweden ontdekte Click for Quality gaat straks als alles meezit over de hoog-ste parcoursen springen. De ruin heeft bijzonder veel vermogen en springt met een spectaculaire manier. Een heerlijk springpaard dat zich goed laat rijden en nuchter is. Springvermogen ligt verankerd in de afstamming. Vader Click and Cash springt Grand Prix met Niklas Arvidsson en stamt af van de goede vererver Cash and Carry. Moeder Quesada springt op 1.30m niveau in Zweden en is een dochter van de internationale springhengst Quite Capitol, die gefokt is uit de halfzus van Capitol I en II. Extra power voegt Caglio-stro via de grootmoeder toe.

Discovered in Sweden, Click for Quality will, if all goes well, soon jump the highest courses. The gelding is exceptionally powerful and has a spectacular jump. An honest showjumping horse that is easy to right and is cool-headed. Showjumping genes abound in his an-cestry. Sire Click and Cash is jumping at Grand Prix level under Niklas Arvidsson and descends from the great sire Cash and Carry. Dam Quesada is jumping at 1.30m level in Sweden and is a daughter of the international showjumping stallion Quite Capitol, who is bred out of the half-sister of Capitol I and II. Cagliostro adds some extra power via the grandam.

Op vierjarige leeftijd viel Doris al op tijdens de KWPN stamboekopname, waar ze 85 punten scoorde voor het vrijspringen. Ook onder het zadel is ze een opvallend springpaard. De voorlopig keur- en prok-merrie springt met heel veel kwaliteiten en is daarnaast zeer fijn te rijden.

Doris stamt af van Tangelo van de Zuuthoeve x Kroongraaf, een combinatie die eerder al het top-Grand Prix spring-paard Billy Angelo van William Funnell gaf. Tangelo van de Zuuthoeve heeft al diverse kinderen op Grand Prix niveau. Moeder Sarida sprong op 1.30m niveau. Via Kroongraaf en Phantom voert ze het bloed van de gewaardeerde hengsten Burggraaf en Pilot.

As a 4-yr-old Doris was already noticed at the KWPN studbook registration, where she scored 85 points in the free jumping. Also under saddle she draws attention as a showjumping horse. This provisonal keur- and prok-awarded mare performs with a lot of quality and is extremely pleasant to ride.

Doris is by Tangelo van de Zuuthoeve x Kroongraaf, a combination that earlier pro-duced the top-class Grand Prix showjump-ing horse Billy Angelo ridden by William Funnell. Tangelo van de Zuuthoeve already sired many offspring performing at Grand Prix level. Dam Sarida jumped at 1.30m level herself. Via Kroongraaf and Phantom she carries the blood of the reputable stal-lions Burggraaf and Pilot.

De met veel reflexen springende hengst Canturano maakt bijzonder veel indruk met zijn nafok. In september werd een vijfjarige zoon voor maar liefst 325.000 euro in Weert geveild en ook Durano E is een opvallend springpaard. Durano E springt met heel goede manieren en is daarbij heel voorzichtig. Een heel fijn paard dat bovendien ongecompliceerd te rijden is.

Moeder Monette (Libero H) is een halfzus van de nationale springhengst Climax (Concorde), 1.40m springpaard Annette (Nassau) en de 1.35m geklasseer-de Zilmax (Winner E). Grootmoeder Bonnette (Nimmerdor) is een volle zus van de internationale springpaarden Drummer (Emile Hendrix) en Zildzjan.

Dame de Frondriére heeft voor haar leef-tijd al veel ervaring. Ze kwam afgelopen zomer in het 1.20m uit, is winnares van finale voor de vijfjarige springpaarden op CSI*** Lummen en was finalist van de VION Cup in Ermelo. Een heel fijn, onge-compliceerd paard met een goede spring-techniek en een mooie sprongafloop.

De Grand Prix springhengst Vingino is hier gecombineerd met interessante bloedlijnen. Moeder Baloubet Deux stamt af van de Grand Prix-springhengst Baloubet Junior Z die de genen van de wereldhengsten Baloubet du Rouet, Darco en Ramiro voert. Grootmoeder Minvinity (Legaat) is gefokt uit Invinity (Wisconsin), die op 1.35m niveau presteerde.

Dame de Frondriére is, considering her tender age, already fairly experienced. This summer she already started at 1.20m level, won the finals for 5-yr-old showjumping horses at CSI*** Lummen and was finalist in the VION Cup in Ermelo. A real nice, uncomplicated horse with a good jumping technique and a well completed jump.

The Grand Prix showjumping stallion Vingino is here combined with interesting bloodlines. Dam Baloubet Deux descends from the Grand Prix showjumping stallion Baloubet Junior Z who carries the genes of the world-class stallions Baloubet du Rouet, Darco and Ramiro. The 5-yr-old Diarado, descending from a family that already produced several inter-national showjumping horses, is a striking grey. He jumps with a lot of power, is care-ful and always co-operative. Dali’s vader Zavall VDL, zoon van de top-hengst Casall, timmert aan de weg met Jur Vrieling en geeft veel kwaliteit mee aan zijn nakomelingen. Moeder Talieta is een voorlopig keurmerrie met de waar-devolle genen van Voltaire en G.Ramiro Z. The 5-yr-old Dali is a pleasure to ride. An extremely fine showjumping horse that is easy to ride, always wants to co-operate and throws a good jump. He is uncom-plicated to handle and to work with and suitable for any rider.

Dali’s sire Zavall VDL, son of the top-class stallion Casall, is giving good performances in the ring under Jur Vrieling and passes on a lot of quality to his offspring. De grote, langgelijnde zoon van Colandro toont veel vermogen, is voorzichtig en laat zich fijn rijden. Via Colandro voert Dexter het bloed van de gerenommeerde hengsten Contendro I en Calando I. Grootvader Guidam sprong op internationaal niveau en bracht toppaarden als Authentic, Luidam en Vindicat W. For Dexter the fences are rarely too high. He has gained experience at 1.20m level and has everything to grow to a high level. Op zoek naar een echte crack? Dan mag je Dante niet missen. Een zeer compleet springpaard waarbij superlatieven tekort schieten. Dante heeft een super instelling, veel bloed, een goede galop, heeft veel springvermogen en is daarbij zeer voor-zichtig. De hengst laat zich bijzonder goed rijden. Een topper voor de toekomst. Hij maakte al indruk op de KWPN-heng-stenkeuring, waar hij voor 65.000 euro geveild werd en nam deel aan het verrich-tingsonderzoek. De nakomelingen van Padinus zijn zeer populair en breken door op Grand Prix-niveau. Dante is nauw ver-want aan veilingpaard Dali (Zavall VDL). Hun moeders zijn zussen. Dante’s moe-der Realieta (Mr.Blue) gaf ook het 1.30m springpaard Sjinto Z (Sjapoo) en 1.35m springpaard William (Heartbreaker).

Looking for a real star? Then you better have a good look at Dante. He is a very complete showjumping horse for which superlatives fall short. Dante has a superb attitude, a lot of blood, a fine canter, lots of jumping potential and is very careful as well. The stallion makes a comfortable ride. A top-class horse for the future.

He already made an impression at the KWPN stallion selection, where he was auctioned for 65,000 euro and then started in the perfor-mance test. The products of Padinus are very popular and are breaking through at Grand Prix level. Dante is closely related to another horse in this auction, Dali (Zavall VDL). Their dams are sisters. De zesjarige Carino is nog niet het meest geroutineerde springpaard, maar ver-dient met verve een plekje in de veiling. De ruin laat onbegrensd springvermogen zien, is zeer voorzichtig op de sprong, goed te rijden en ook nog eens een eye-catcher qua type. Vader Larino maakte met Peter Geerink deel uit van landenwedstrijden en viel in de sport op door zijn schitterende springmanieren. Grootvader Numero Uno presteerde op 1.50m niveau en staat nu wereldwijd bekend als vader van topspringpaarden als Tamino, Tobalio, Winchester en Tyson. De merrielijn gaat terug op Rosaly, een dochter van de geëx-porteerde hengst Julius (Voltaire x Zeus).

The 6-yr-old Carino is not very experienced yet in showjumping, but certainly is worthy of his place in this auction. This gelding displays sheer unlimited jumping potential, is very careful over the fence, besides, and also a great eye-catcher. algemeen1. Expo Talent Sale BV (hierna: ‘ETS’), organiseert op woensdag 4

december 2013 de Expo Talent Sale (hierna: ‘de veiling’) in het Go Planet Expo Hall te Enschede. De veiling zal plaatsvinden onder toezicht van een notaris.

2. De relatie tussen ETS en de verkoper is een overeenkomst van opdracht.

3. Deze veilingvoorwaarden zijn primair van toepassing op de relatie tussen ETS en de verkoper en op de relatie tussen ETS en de bieder/koper. Onder verkoper en bieder/koper worden ook eventuele rechtsopvolgers/rechtsverkrijgers begrepen.

4. ETS is niet gebonden aan overeenkomsten tussen de verkoper en de bieder/koper, tenzij in deze veilingvoorwaarden anders is vermeld.

5. Alle bedingen in deze veilingvoorwaarden zijn mede gemaakt ten behoeve van al diegenen die voor of ten behoeve van ETS werkzaam zijn of waren. De bepalingen uit deze veilingvoorwaarden zijn rechtstreeks op deze personen van toepassing, als ware zij zelf ETS.

6. De deelneming aan de veiling wordt aangemerkt als aanvaarding van deze veilingvoorwaarden, met uitsluiting van eventueel door de deelnemer zelf te hanteren voorwaarden.

de veiling7. De paarden worden verkocht voetstoots zonder actie of refactie, in

de staat waarin zij zich bij gunning bevinden. 8. De veilingmeester heeft de bevoegdheid om de volgorde van de

te verkopen paarden te wijzigen of zonder opgave van redenen personen als bieder/koper te weigeren.

9. Bieders/kopers worden geacht volledig handelingsbekwaam te zijn en bij het volle verstand. Iedere bieder/koper wordt geacht voor zichzelf te hebben gebo den en is aan zijn bod gehouden totdat een hoger bod definitief is geaccep teerd. Een bieder/koper is naast zijn eventuele lastgever volledig aansprake lijk voor het niet nakomen van zijn verplichtingen. Een verkoper die zijn paard blijkt te hebben teruggekocht, wordt mede beschouwd als bieder/koper en voor de alhier bedoelde verkoper gelden aldus eveneens alle bepalingen (waaronder mede begrepen alle (betalings)verplichtingen) in deze veilingvoorwaarden die bieders/kopers betreffen. van legitimatie een schriftelijke koopovereenkomst tekenen. Mocht de koopovereenkomst niet onmiddellijk aan de bieder/koper ter ondertekening worden aangeboden, dan dient hij zich direct na de veiling te melden bij het secretariaat van ETS.

10. Ingeschreven paarden worden bij opbod verkocht met een minimuminzet van € 12.000,- per paard. Indien geen openingsbod wordt gedaan kan de veilingmeester zakken naar € 10.000,-. Indien dan alsnog geen bod komt, is het paard niet verkocht.

11. Het risico ter zake van de paarden, waaronder mede begrepen doch niet beperkt tot de schade aan en veroorzaakt door paarden, gaat op het moment van gunning onmiddellijk over van de verkoper op de bieder/koper. Zolang ETS geen algehele betaling van de bieder/koper heeft ontvangen, blijft de verkoper eigenaar van het paard.

12. De bieder/koper zal onmiddellijk na gunning onder vertoning van legitimatie een schriftelijke koopovereenkomst tekenen. Mocht de koopovereenkomst niet onmiddellijk aan de bieder/koper ter ondertekening worden aangeboden, dan dient hij zich direct na de veiling dienen te melden bij het secretariaat van ETS.

informatie13. ETS heeft gepoogd de catalogus zo nauwkeurig mogelijk samen

te stellen. De informatie over de pedigrees is erop gericht een indruk te geven van de kwali teit van de paarden, zonder de

pretentie volledig te zijn en zonder daarmee garanties te geven.14. Het is de verantwoordelijkheid van de verkoper om de juistheid

van de informa tie in de catalogus ter zake van het door hem aangeboden paard te controleren en ETS vóór de veiling tijdig en schriftelijk van eventuele fouten of onvolledigheden in kennis te stellen en daarbij zo gedetailleerd als mogelijk aan te geven welke wijzi gingen of aanvullingen dienen te worden aangebracht.

15. Een afschrift van het veterinair rapport alsmede röntgenfoto's kunnen op verzoek zeven dagen voorafgaand aan de veiling en op de dag van de veiling worden ingezien. De inhoud van het veterinair rapport, de röntgenfoto's en eventuele overige door ETS verstrekte veterinaire rapportage is bindend voor ETS, de verkoper en bieder/koper.

16. De bieders/kopers zijn verplicht om op verzoek van ETS informatie te verschaf fen omtrent hun financiële gegoedheid, waarbij zij bescheiden aan ETS dienen over te leggen waaruit deze gegoedheid blijkt. Door een verzoek tot deelname aan de veiling machtigen de bieders/kopers ETS informatie in te winnen bij derden over hun financiële gegoedheid.

inschrijvingen, kosten en betaling17. ETS is te allen tijde bevoegd een inschrijving zonder opgave

van redenen niet in behandeling te nemen, danwel paarden en/of verkopers te weigeren. Het inschrijfgeld is een commissie van 8% inclusief BTW over de koopsom exclusief BTW, met een minimumbedrag van € 2.000,00 inclusief BTW. Dit minimumbedrag van € 2.000,00 is door de verkoper aan ETS verschuldigd vanaf het moment dat een ingeschreven paard is gefotografeerd of is opgenomen op video, of zoveel eerder als een mondelinge danwel schriftelijke opdracht tot verkoop door verkoper aan ETS is verstrekt. De verkoper dient op de veiling het overige inschrijfgeld gerelateerd aan de koopsom contant te betalen bij het secretariaat van ETS, in euro’s, zonder enige korting of inhouding.

18. Op het moment dat de verkoper het minimumbedrag aan inschrijfgeld overeenkomstig het bepaalde sub 17 verschuldigd wordt aan ETS, zal hij ervoor zorgdragen dat het bedoelde bedrag binnen 14 dagen is bijgeschreven op bankrekeningnummer 65.52.53.122 van ETS onder vermelding van het inschrijfnummer. De verkoper en zijn paard(en) worden pas toegelaten tot de veiling, nadat hij bescheiden heeft overgelegd waaruit blijkt dat het bedoelde bedrag volledig is voldaan.

19. Alleen de door ETS erkende adviseurs die voor aanvang van de veiling bij ETS schriftelijk hebben opgegeven dat zij optreden voor één of meer van de bieders/kopers, kunnen jegens de betreffende verkoper aanspraak maken op provisie. Deze provisie bedraagt maximaal 4% inclusief BTW over de koopsom exclusief BTW. Eerst nadat de bieder/koper geheel aan zijn (beta-lings)verplichtingen heeft voldaan, is de verkoper de provisie verschuldigd. De verkoper dient de provisie inclusief BTW op het sub 18 genoemde rekeningnummer van ETS te voldoen, die voor doorgeleiding aan de betreffende adviseur zorgdraagt, nadat de bieder/koper aan al zijn (betalings)verplichtingen heeft voldaan.

20. De bieder/koper dient op de veiling de koopsom vermeerderd met 10% opgeld inclusief BTW over de koopsom exclusief BTW, contant te betalen bij het secretariaat van ETS, in euro’s zonder enige korting of inhouding.

21. Indien de bieder/koper hiermee in verzuim is, heeft ETS de bevoegdheid het paard onmiddellijk te herveilen, waarbij het bod van de oorspronkelijke bieder/koper niet weer wordt aangenomen. De oorspronkelijke bieder/koper is gehouden het verschil tussen zijn bod en de uiteindelijke lagere koopsom, alsmede de kosten van herveiling aan ETS te voldoen. De bieder/koper heeft geen aanspraken ingeval van een hogere opbrengst na herveiling.

veilingvoorwaarden

22. Slechts met voorafgaand schriftelijk verkregen toestemming van ETS heeft een bieder/koper het recht giraal te betalen, waarbij het verschuldigde binnen 7 dagen na de veiling op het sub 18 genoemde rekeningnummer van ETS dient te zijn bijge schreven. ETS verplicht in dat geval de bieder/koper het paard met onmiddellijke ingang en voor rekening van de bieder/koper te laten verzekeren bij Hippo Zorg BV, voor een periode van maximaal één week met een premie van 1,0% van de koopsom, of maximaal één maand met een premie van 1,5% van de koopsom, waarbij in het geval van schade aan de bieder/koper voorts een jaarpremie van 4% van de koopsom in rekening wordt gebracht. Deze korte samenvatting van de bedoelde verzekering pretendeert niet volledig te zijn en de bieder/koper kan hieraan geen rechten ontlenen. De bieder/koper kan de verzekeringsvoorwaarden op de dag van de veiling verkrijgen bij het secretariaat van ETS.

23. ETS heeft onder andere de bevoegdheid voornoemde toestemming te onthouden indien de bieder/koper zijn financiële gegoedheid naar oordeel van ETS niet aantoont of geen danwel onvoldoende zekerheid stelt middels een bankgarantie of anders zins. ETS heeft de bevoegdheid de door haar gegeven toestemming op elk moment weer in te trekken indien naar haar oordeel twijfel bestaat over de financiële gegoedheid van de bieder/koper of over de door hem gestelde zekerheid.

24. Betaling aan enig ander dan ETS, bevrijdt de verkoper of de bieder/koper niet van de betalingsverplichtingen jegens ETS.

25. Indien ETS niet binnen 7 dagen na de veiling algehele betaling van de bieder/koper heeft ontvan gen, is de bieder/koper van rechtswege in verzuim. De bieder/koper is dan, naast het overig door hem verschuldigde, aan en ten behoeve van ETS een vergoeding verschuldigd ter grootte van 12% inclusief BTW van de koopsom exclusief BTW. Het totaalbedrag dat de bieder/koper uit hoofde van zijn betalingsverplichtingen is verschuldigd, wordt vermeerderd met een rente van 1,5% per maand, te berekenen vanaf de veiling tot het tijdstip van algehele betaling.

26. Indien ETS niet binnen 7 dagen na de veiling algehele betaling van de bieder/koper heeft ontvan gen, heeft ETS voorts de bevoegdheid zonder ingebrekestelling namens de verkoper en zonder zijn toestemming de koop als ontbonden te beschouwen. De verkoper en de bieder/koper blijven in dat geval jegens ETS gehouden om aan al hun in deze veilingvoorwaarden genoemde betalingsverplichtingen te voldoen, voor zover die een vergoeding ten behoeve van ETS betreffen.

27. Indien de bieder/koper of de verkoper in verzuim ter zake van zijn (betalings)verplichtingen, komen alle (buiten)gerechtelijke kosten die ETS daar door maakt voor rekening van de bieder/koper danwel de verkoper, met een minimumbedrag van € 1.000,00 inclusief BTW.

28. Indien en pas nadat aan alle (betalings)verplichtingen jegens ETS is voldaan door zowel verkoper als bieder/koper, zal ETS uiterlijk 30 dagen daarna het door haar aan de verkoper verschuldigde voldoen.

29. Verrekening van wederzijdse vorderingen door de verkoper danwel de bieder/koper ten opzichte van ETS is uitgesloten. ETS is te allen tijde bevoegd wederzijdse vorderingen te verrekenen.

selecties en keuringen paarden voor de veiling 30. ETS bepaalt de criteria waaraan voor de veiling te selecteren

paarden dienen te voldoen. 31. Een door ETS samengestelde selectiecommissie onderzoekt en

selecteert de paarden die in aanmerking komen voor deelname aan de veiling. Een besluit van de selectiecommissie ter zake is bindend. De selectiecommissie is bevoegd advies in te winnen bij derden, doch heeft te allen tijde de bevoegdheid een paard zonder opgave van redenen te weigeren op grond van (lichamelijke)

gebreken, alsmede wegens andere door de selectiecommissie te bepalen gronden, ook indien het paard reeds voor de veiling is geselecteerd. ETS (en de selectiecommissie) is (zijn) nimmer gehouden om, op welke grond dan ook, de door de verkoper gemaakte kosten te voldoen.

32. Alle paarden zijn in de drie maanden voorafgaand aan de veiling röntgenologisch en klinisch onderzocht. Een afschrift van de veterinaire keuring alsmede de röntgenfoto's liggen zeven dagen voorafgaand aan de veiling ter inzage.

afwezigheid paarden op de veiling33. Een geselecteerd paard dient aan de veiling deel te nemen,

bij gebreke waarvan de verkoper, naast het overig door hem verschuldigde, aan en ten behoeve van ETS een vergoeding is verschuldigd ter grootte van € 15.000,00. Het totaalbedrag dat de verkoper uit hoofde van al zijn betalingsverplichtingen is verschuldigd wordt vermeerderd met een rente van 1,5% per maand, te berekenen vanaf datum veiling tot het tijdstip van algehele betaling.

34. Mocht een paard naar oordeel van de verkoper wegens gezondheidsredenen niet aan de veiling zal kunnen deelnemen, dan dient dit tijdig, schriftelijk en met een zo gedetailleerd mogelijke omschrijving van de aandoening aan ETS te worden medegedeeld, waarna een door ETS aangewezen veterinair de aard van de aandoening zal vaststellen. De vaststelling van die veterinair ter zake is bindend.

35. Indien de verkoper aan en naar bindend oordeel van voornoemde veterinair geen c.q. onvoldoende gelegenheid biedt het paard (tijdig) te onderzoeken, danwel indien het paard door die veterinair is goedgekeurd en desondanks niet aan de veiling deelneemt, is de verkoper de sub 33 genoemde vergoeding aan ETS verschuldigd. Indien een door die veterinair al dan niet goedgekeurd paard niet aan de veiling deelneemt, dient de verkoper in ieder geval de door ETS in dat verband gemaakte (veterinaire) kosten te voldoen, met een minimumbedrag van € 1.000,00 inclusief BTW.

afgifte en verwijdering paarden36. Onmiddellijk na gunning is de bieder/koper verantwoordelijk voor

de zorg van en aansprakelijk voor schade aan het paard en/of door het paard ontstaan.

37. De bieder/koper dient het paard uiterlijk 2 uur na afloop van de veiling op eigen kosten van het veilingterrein te hebben verwijderd. Indien de bieder/koper het paard niet tijdig heeft verwijderd, is hij van rechtswege in verzuim. ETS heeft dan de bevoegdheid het paard van het veilingterrein te (doen) verwijderen en elders te stallen, waarbij alle in redelijkheid door en naar oordeel van ETS te maken kosten in dat verband voor rekening komen van de bieder/koper. De bieder/koper blijft verantwoordelijk voor de zorg van en aansprakelijk voor schade aan het paard en/of door het paard ontstaan.

38. Indien en pas nadat de bieder/koper volledig aan zijn (betalings)verplichtingen heeft voldaan, waaronder mede begrepen betalingsverplichtingen die een vergoeding ten behoeve van ETS betreffen, kan de bieder/koper over het paard beschikken, waarbij hij de benodigde bescheiden zal ontvangen. ETS is nimmer verplicht het paard af te geven indien de bieder/koper niet geheel aan zijn (beta lings)verplichtingen heeft voldaan.

stalondeugden en gebreken39. Indien de bieder/koper bij het gekochte paard stalondeugden

constateert, zijnde kribbebijten, weven of luchtzuigen, dan dient de bieder/koper binnen 7 dagen na de veiling ETS hiervan

schriftelijk en met een zo gedetailleerd mogelijke omschrijving van de aard van de stalondeugden op de hoogte te stellen. Alsdan zal ETS het paard op een door haar te bepalen locatie onderbrengen, teneinde het paard door een door haar aan te wijzen veterinair op de door de bieder/koper omschreven stalondeugden te laten onderzoeken. Voornoemde veterinair stelt de aard van de stalondeugden bindend vast. Indien naar oordeel van die veterinair van de door de bieder/koper omschreven stalondeugden sprake is, dient de verkoper de ter zake gemaakte kosten, waaronder mede voor wat betreft de stalling, het transport en de kosten van die veterinair, aan ETS te voldoen. De bieder/koper dient de bedoelde kosten aan ETS te voldoen indien naar oordeel van voornoemde veterinair geen sprake is van de door de bieder/koper omschreven stalondeugden.

40. Het bepaalde sub 39 geldt eveneens indien de bieder/koper bij het gekochte paard gebreken, anders dan bedoelde stalondeugden, constateert.

41. Indien de bieder/koper niet binnen voornoemde termijn van 7 dagen na de veiling op voornoemde wijze melding maakt van bedoelde stalondeugden of (andere) gebreken en/of indien voornoemde veterinair de stalondeugden of (andere) gebreken niet vaststelt, vervalt de bevoegdheid van de bieder/koper de koop te ontbinden of een beroep te doen op een wilsgebrek.

ontbinding en vernietiging42. Indien de koop rechtsgeldig door de bieder/koper of de verkoper

wordt ontbonden of vernietigd, blijven de verkoper en de bieder/koper gehouden aan al hun in deze veilingvoorwaarden genoemde betalingsverplichtingen jegens ETS te voldoen, voor zover die een vergoeding ten behoeve van ETS betreffen. De koop kan worden ontbonden of vernietigd met inachtneming van de ter zake geldende wettelijke bepalingen, voor zover daarvan in deze veilingvoorwaarden niet rechtsgeldig is afgeweken.

aansprakelijkheid 43. ETS is niet aansprakelijk voor de accuratesse van de informatie in

de catalo gus, de informatie gegeven op het veilingterrein en de informatie tijdens de veiling. De verkoper vrijwaart ETS tegen ieder aanspraak van derden (waaronder mede begrepen bieders/kopers) wegens schade die voortvloeit uit het niet voldoen aan de controle- en mededelingsverplichting door verkoper ter zake van de catalogus als bedoeld sub 14.

44. ETS is niet aansprakelijk voor de accuratesse van de informatie in het veterinair rapport, de veterinaire informatie gegeven op het veilingterrein en de informatie tijdens de veiling.

45. ETS is niet aansprakelijk voor schade voorafgaand aan, tijdens of na afloop van de veiling door en/of aan personen, goederen of paarden geleden.

46. Ter zake van onder meer de paarden sluit ETS geen verzekering af ten behoeve van de verkopers en bieders/kopers. Aangezien verkopers en bieders/kopers geheel voor eigen rekening en risico aan de veiling deelnemen, adviseert ETS hen bedoelde verzekering zelf af te sluiten.Ingeval van dood van het paard op de dag van de veiling, terwijl de betreffende verkoper of bieder/koper geen uitkering op grond van een eventueel door hemzelf afgesloten verzekering ontvangt, zal ETS het inschrijfgeld ad € 2.000,00 inclusief BTW aan de betreffende verkoper of het opgeld aan de betreffende bieder/koper terugbetalen. Met voornoemde terugbetaling verleent ETS service aan verkopers en bieders/kopers, zonder dat ETS enige aansprakelijkheid erkent en zonder dat verkopers en/of bieders/kopers hieraan nu of in de toekomst rechten kunnen ontlenen.

47. ETS is niet aansprakelijk voor tekortkomingen van derden. Hieronder valt tevens de wanbetaling van de bieder/koper.

48. ETS sluit aansprakelijkheden uit, behoudens ingeval van opzet of bewuste roekeloosheid van ETS en/of diegenen die voor of ten behoeve van ETS werkzaam zijn of waren.

49. Een ieder die schade toebrengt aan (goederen van danwel gebruikt door) ETS is aansprakelijk voor deze schade.

50. Zowel de verkopers als de bieders/kopers zijn aansprakelijk voor alle schade door hen veroorzaakt. Zowel de verkopers als de bieders/kopers vrijwaren ETS tegen iedere aanspraak van derden (waaronder mede begrepen andere verkopers en/of bieders/kopers, danwel bezoekers) ter zake daarvan.

overig51. Indien ter zake van de overgang van geveilde paarden naar een

andere lidstaat van de Europese Unie op verzoek van de bieder/koper wordt gefactureerd met het BTW-nulta rief, verplicht de bieder/koper zich alle daartoe noodzake lijke voorwaarden te vervullen teneinde een rechtsgeldige intracommunau taire transactie te verwezenlijken.

52. Indien toepassing van het BTW-nultarief door welke omstandigheid dan ook (achteraf) niet mogelijk blijkt, is de bieder/koper op dat moment alsnog een bedrag verschuldigd ter grootte van het bedrag dat verschuldigd zou zijn indien sprake is van een binnenlandse levering van het desbetreffende paard. Op verzoek van ETS is de bieder/koper echter verplicht vorenbedoeld bedrag onmiddellijk aan ETS te voldoen. Alsdan zal terugbetaling daarvan eerst en slechts plaatsvinden indien de bieder/koper aan de voorwaarden sub 51 heeft voldaan. De bieder/koper is aansprakelijk en vrijwaart ETS in ieder geval voor alle schade die voortvloeit uit het niet voldoen aan de voorwaarden sub 51. Daarnaast is de bieder/koper aansprakelijk voor alle (buiten)gerechtelijke kosten die ETS maakt, met een minimumbedrag van € 1.000,00 inclusief BTW.

conversie53. Indien één of meer van de in deze veilingvoorwaarden genoemde

bepalingen niet rechtsgeldig zou(den) zijn of worden, blijven de overige bepalingen verder rechtsgeldig. In dat geval treedt in plaats van de bedoelde niet rechtsgeldige bepaling een nieuwe bepaling, die met de bedoelde oude niet rechtsgeldige zoveel als mogelijk overeenkomt voor wat betreft inhoud, bereik en doel daarvan.

geschillen54. Indien bij een gunning een verschil van mening ontstaat over

de vraag wie het laatste bod heeft gedaan, of indien er andere moeilijkheden, onduidelijkheden en geschillen ontstaan bij biedingen en/of over de gunning, is de veilingmees ter bevoegd hierover een bindend oordeel uit te spreken. Ingeval van vorenbedoeld verschil van mening omtrent het laatste bod is de veilingmeester bevoegd de verkoop bij opbod te doen continueren.

55. Indien de veilingmeester de notaris verzoekt een oordeel te vellen, zal de notaris bindend en onherroepelijk voor alle partijen beslissen. De notaris is gedurende de veiling tevens bevoegd te oordelen over geschillen van andere aard dan ter zake van de biedingen en gunningen.

56. De rechtsverhoudingen tussen ETS, de bieder/koper en de verkoper worden uitsluitend beheerst door Nederlands recht, met algehele uitsluiting van het Weens Koopverdrag (CISG). Geschillen, anders dan die ingevolge het bepaalde sub 54 en 55 aan het oordeel van de veilingmeester of de notaris zijn onderworpen zullen uitsluitend worden beslecht door de bevoegde rechter te Amsterdam.

general conditions1. Expo Talent Sale BV (hereafter: ‘ETS’) is organizing, on

Wednesday December 4th 2013, the Expo Talent Sale (hereafter: ‘the auction’) in the Go Planet Expo Hall in Enschede. The auction will take place under the supervision of a notary.

2. The relationship between ETS and the vendor is an agreement by order.

3. These conditions of auction apply primarily to the relationship between ETS and the vendor and the relationship between ETS and the bidder/purchaser. By vendor and bidder/purchase is also meant any legal successor/procurer.

4. ETS is not bound to agreements between the vendor and the bidder/purchaser unless stated otherwise in these conditions of auction.

5. All stipulations in these conditions of auction are made for the benefit of all those who work for and have worked for, or work and have worked on the behalf of, ETS. The stipulations in these conditions of auction apply directly to these persons as if they were ETS.

6. Participation in the auction will be seen as acceptance of the conditions of auction, with the exception of contingent conditions to be handled by the participant him/herself.

the auction7. The horses will be sold outright, without proceedings or

recompense, in the state in which they were allotted.8. The auctioneer retains the right to change the order of sale

of the horses to be sold and, without giving reasons, to deny participation by persons as bidder/purchasers.

9. Bidder/purchasers are expected to be fully commercially competent and to be in full possession of their mental faculties. Each bidder/purchaser is expected to have bid for him/herself and will be held to his/her bid until a higher bid has been definitely accepted. A bidder/purchaser is, along with his/her eventual principal, fully responsible for non-fulfillment of his/her obligations. A vendor who appears to have bought his/her own horse back, will also be seen as bidder/purchaser and all conditions (under which is also meant all obligations of payment) of auction are considered applicable concerning bidder/purchasers for the meant vendor.

10. Registered horses will be, at bidding, sold with a minimum stake of €12,000.00 per horse. In the case where no opening bid is made, the auctioneer will drop the minimum stake to €10,000.00, in the case where still no bids are made, the horse will remain unsold.

11. Risks concerning the horses by which is meant among other things, yet not limited to, damage to and damages caused by horses, are transferred immediately from the vendor to the bidder/purchaser at the moment allotted. As long as ETS has not received full payment from the bidder/purchaser, the vendor remains owner of the horse.

12. Immediately after allotment, the bidder/purchaser shall, on production of identification, sign a written agreement of sale. If the agreement of sale is not immediately offered for signing to the bidder/purchaser, then he/she must, directly after the auction, report to the ETS administration office.

information13. ETS has strived to compile the catalogue as accurately as possible.

Pedigree information aims to give an impression of the quality of the horses without pretending to be exhaustive and therefore gives no guarantees.

14. It is the responsibility of the vendor to control the accuracy of the information in the catalogue that concerns the horse that he/she has put on offer and to write to ETS in good time before the auction in the event of any mistakes or inadequacies and bring to

the notice of such, thereby acquainting ETS, in as much detail as possible, with any changes or additions that are needed.

15. A duplicate of the veterinary report as well as X-rays can be seen, on request, seven days before the auction and on the day of the auction itself. The contents of the veterinary report, the X-rays and any other possible veterinary communications by the veterinary surgeon as appointed by ETS, is binding for ETS, the vendor and the bidder/purchaser.

16. The bidder/purchasers are obliged, if requested by ETS, to supply information concerning the adequacy of their financial circumstances, in which case they must show documentation proving the substance of their finances to ETS. By requesting participation in the auction, the bidder/purchasers authorize ETS in the obtaining of information concerning their financial circumstances from third parties.

registration, costs and payment17. ETS is, at all times, authorized to refuse either horses and/or

vendors for registration without having to state reasons. The registration fee shall be a commission of 8% (including VAT) of the purchase price excluding VAT at a minimum sum of € 2,000.00 including VAT. This minimum sum of € 2,000.00 is due to ETS by the vendor from the moment that a registered horse has been photographed or has been recorded on video or has been, at some time earlier, either verbally or in writing, assigned for sale by ETS by the vendor. The vendor must pay, at the auction, the remaining registration fee as related to the sales price, in cash, at the administration offices of ETS, in euros, without any discount or deduction.

18. At the moment when the vendor’s registration fee of the minimum sum (as corresponding to part 17) is due to ETS, he/she shall ensure that the aforesaid sum shall be deposited, within 14 days, on the bank account number 65.52.53.122 of ETS, and stating the registration number concerned. The vendor and his/her horse or horses will only be allowed entry to the auction after he/she has documentary proof to show that it is apparent that he/she has fully paid the aforesaid registration fee.

19. Only advisors that have been approved by ETS and who have made a written application to ETS before the commencement of the auction that they will represent one or more of the bidder/purchasers, can make a claim on the commission of the vendor. This commission amounts to a maximum sum of 4% (including VAT) of the purchase price excluding VAT. Only after the bidder/purchaser has fully completed his/her obligations of payment is the commission owed by the vendor. The vendor must pay the commission, including VAT, onto the bank account number (as mentioned in part 18) of ETS who will ensure the transferal to the adviser concerned after the bidder/purchase has fulfilled all his/her obligations of payment.

20. The bidder/purchaser must make cash payment to the administration office of ETS at the auction, that is; the purchase price augmented by 10% agio including VAT on the purchase price, excluding VAT, in euros, without any discount or deduction.

21. In the event where the bidder/purchaser is deficient herein, ETS has the right to immediately re-auction the horse, whereby the bid of the original bidder/purchaser may no longer be accepted. The original bidder/purchaser will be obliged to pay the difference between his/her bid and the final, lower purchase price, as well as the re-auctioning costs, to ETS. The bidder/purchaser will have no claims in the case where there is a higher purchase price after the re-auction.

22. Only with permission obtained from ETS prior to the auction has a bidder/purchaser the right to pay with a transfer account whereby he/she must transfer payment within 7 days after the

auction to the bank account number of ETS (as corresponding to part 18). ETS will, in such cases, oblige the bidder/purchaser to have the horse insured, which will take effect immediately and will be at the cost of the bidder/purchaser, with Hippo Zorg BV. This insurance must be for a period of a maximum of one week with a premium of 1.0% of the purchase price or for the maximum of one month with a premium of 1.5% of the purchase price whereby, in the case of damage, the bidder/purchaser will be also charged an annual premium of 4% of the purchase price. This short summary of the aforesaid insurance is not considered to be complete thus the bidder/purchaser cannot derive any legal rights from such. The bidder/purchaser can obtain a copy of the conditions of insurance on the day of the auction from the administration office of ETS.

23. ETS also has, amongst other things, the right to withhold the above-mentioned permission in the event that the bidder/purchaser’s financial circumstances, according to ETS’ judgment, by means of bank guarantees or suchlike, do not show, or fall short of, sufficient means. ETS has the right to withdraw its given permission at any time in case doubts arise, in their opinion, as to the financial adequacy of the bidder/purchaser or to the securities that have been supplied by him/her.

24. Payment to any other person other than ETS does not release the vendor or the bidder/purchaser from payment obligations toward ETS.

25. In the event that ETS has not received the payment in full from the bidder/purchaser within 7 days after the auction, the bidder/purchaser is, according to the law, in omission. The bidder/purchaser is then obliged to pay to ETS, as well as his/her other obligations of payment, an indemnity to the sum of 12% (including VAT) of the purchase price excluding VAT. The total sum that the bidder/purchaser is indebted from his/her obligation of payment will be augmented by an interest of 1.5% per month to be calculated from the time of auction until the time of full payment.

26. If ETS does not receive, from the bidder/purchaser, full payment within 7 days after the auction, ETS has the right, without notification of default, on behalf of the vendor and without his/her permission, to consider the sale as not binding. In such cases, the vendor and bidder/purchaser remain obliged to fulfill all their payment obligations toward ETS as laid out in the conditions of auction as far as these concern an indemnity on behalf of ETS.

27. If the bidder/purchaser is in default of fulfilling his/her payment obligations towards ETS, all judicial and extra judicial costs accrued by ETS by these circumstances will be charged to the bidder/purchaser with a minimum sum of € 1,000.00 including VAT.

28. When, and only when, all payment obligations towards ETS have been fulfilled by both the vendor and the bidder/purchaser, will ETS then complete payment of all money owed to the vendor within 30 days.

29. Settling of mutual claims by the vendor or the bidder/purchaser in regard to ETS is out of the question. ETS is, at all times, authorized to settle mutual claims.

selection and inspection of horses for the auction30. ETS will decide the criteria by which horses that are to be selected

for the auction must fulfill. 31. A selection committee compiled by ETS will examine and select

the horses considered to be likely candidates for participation in the auction. A decision by the selection committee concerned is binding. The selection committee is entitled to ask advice from third parties, notwithstanding that, at all times, they have the right to refuse a horse, without having to state reasons, on

grounds of being found physically or otherwise, defective, as well as other grounds determined by the selection committee, also in cases where a horse has already been selected for the auction. ETS (and the selection committee) is in no way beholden, on no matter what grounds, for the responsibility of any costs accrued by the vendor.

32. All horses are, three months before the auction, clinically tested as well as having X-rays made. Copies of the veterinary report, as well as the X-rays, are available for inspection seven days before the commencement of the auction.

horses absent at time of auction 33. A horse that has been selected must take part in the auction;

in default of such, the vendor must, as well as his/her other obligations of payment to ETS, pay an indemnity of € 15,000.00. The total sum that is indebted by the vendor from his/her obligations of payment, will be augmented by an interest of 1.5% per month over the total owed sum, to be calculated from the date of auction until the time of the payment in total.

34. In the event that a horse, in the opinion of the vendor, cannot participate in the auction because of health reasons, then he/she must explain in writing, in good time, the disorder to ETS, whereby after a veterinary surgeon that has been assigned by ETS will establish the nature of the disorder. The conclusion of the veterinary surgeon concerned will be binding.

35. In the case where the vendor, in the binding opinion of the veterinary surgeon, does not offer, or does not offer sufficient, opportunity to allow the horse to be examined in good time and therefore the horse, despite the veterinary surgeon’s approval, does not participate in the auction, the vendor owes the indemnity to ETS as mentioned in part 33, above. In the case where the horse does not participate in the auction, with or without an approval by the said veterinary surgeon, then the vendor must pay ETS the costs accrued by the said veterinary with a minimum sum of € 1,000.00 including VAT.

delivery and removal of horses36. The bidder/purchaser is responsible for the care of the horse

immediately after it has been allotted and liable for any damage to the horse, or caused by the horse.

37. The bidder/purchaser must remove, at his/her own cost, the horse from the grounds of the auction, at the latest, 2 hours after the auction has finished. If the bidder/purchaser has not removed the horse in good time, he/she is in default in the law. ETS then has the right to have the horse removed and stabled elsewhere, whereby the bidder/ purchaser will be charged for the costs accrued, as considered reasonable in the judgment of ETS. The bidder/purchaser remains responsible for the care of the horse and is liable for damage to the horse or caused by the horse.

38. When, and only when, the bidder/purchaser has fully complied with his/her obligations of payment, under which is meant obligations of payment concerning reimbursement to ETS, can the bidder/purchaser take delivery of the horse, whereby he/she will receive the necessary documents. ETS is not obliged to deliver the horse in the event that the bidder/purchaser has not fully complied with his/her payment obligations.

stall vices and deficiencies39. In the event where a bidder/purchaser detects stall vices in the

horse purchased, whether crib-biting, weaving or wind-sucking, the bidder/purchaser must, within 7 days after the auction, notify ETS in writing with a description in as much detail as possible of the nature of the stall vice. In such cases, ETS will remove the horse to a location of their choice with the aim to

having the horse examined by a veterinary surgeon assigned by them in order to have the stall vice, as described by the bidder/purchaser, examined. The veterinary surgeon’s conclusion of the nature of the stall vice is binding. In the event where, in the judgment of the veterinary surgeon, there is such a stall vice as described by the bidder/purchaser, then the vendor is obliged to pay the costs accrued to ETS, among which those concerning the stabling, the transport costs and the veterinary surgeon’s fee. The bidder/purchaser is obliged to pay the said costs accrued to ETS in the case where, in the judgment of the veterinary surgeon, there is no stall vice as described by the bidder/purchaser.

40. The specific part, part 39 as above, is also applicable, in the event where the bidder/purchaser detects defects in the horse purchased, other than the stall vices mentioned.

41. In the event that the bidder/purchaser, within the term of 7 days after the auction, does not notify ETS in the manner as mentioned above, of the stall vices in question or other defects, and/or in the event where the above-mentioned veterinary does not establish that there are stall vices or other defects, the bidder/purchaser does not have the right to annul the sale nor make a claim of absence of consensus ad idem.

annulment and quashing42. In the event where the legal sale is annulled or quashed by

the bidder/purchaser, the vendor and the bidder/purchaser will remain bound to all their obligations of payment toward ETS, as mentioned in the conditions of auction, as far as these concern indemnities to ETS. The sale can be annulled or quashed if the valid legal conditions concerned are taken into consideration, insomuch as they do not deviate in law from the conditions of auction.

liability43. ETS cannot be held liable for the accuracy of the information

in the catalogue, the information supplied at the auction grounds or any information made available during the auction. The vendor indemnifies ETS from all damages resulting from inadequacy in the obligations of checking and the obligations of statements made by the vendor concerning the catalogue as meant in part 14.

44. ETS cannot be held liable for the accuracy of the information contained in the veterinary report, the veterinary information supplied at the auction grounds or any information made available during the auction.

45. ETS cannot be held liable for any damage before, during or after the auction, sustained or perpetrated by any person, goods or horses.

46. ETS will not take out an insurance concerning horses or other matters, on behalf of the vendors and bidder/purchasers. As vendors and bidder/purchasers take part in the auction at their own cost and at their own risk, ETS advises that they take out the meant insurance themselves. In the event of the death of a horse on the day of the auction and while the vendor or bidder/purchaser concerned does not receive any compensation on grounds of any insurance he/she may have taken out for him/herself, then ETS will refund the registration fee of € 2,000.00 including VAT to the vendor concerned or will repay the agio to the bidder/purchaser concerned. The aforementioned refund is a service granted by ETS to vendors and bidder/purchasers without acknowledgement of any liability on the part of ETS, now or in the future.

47. ETS is not liable for the failings of third parties; under this is also classified the case of non-payment by the bidder/purchaser.

48. The ETS is not liable for anything whatsoever, except in cases of

willful intent or willful recklessness on the side of the ETS and/or those who work on behalf of, or have worked on behalf of the ETS.

49. Anyone who perpetrates damage to goods, or goods used by ETS, are liable for such damage.

50. Both vendors and bidder/purchasers are liable for any damage they may have perpetrated . Both vendors and bidder/purchasers indemnify ETS from any liability toward third parties by which is meant other vendors and/or bidder/purchasers or visitors concerning this matter.

other matters51. In the event where, in the business of transferring the auctioned

horses to another member state of the European Union, at the request of the bidder/purchaser an invoice is sent with zero VAT, the bidder/purchaser puts him/herself under obligation, in the member state of destination, to fulfill all necessary conditions demanded and in so doing to actualize an intra-community legal transaction.

52. If application of the VAT zero rating tariff, no matter the circumstances, appears to be impossible (subsequently), then the bidder/purchaser, at that time, is still obliged to pay a sum to the amount that would be owed in the case of a domestic delivery of the horse concerned. At the request of ETS the bidder/purchaser is required to pay the aforementioned sum to ETS immediately. In such cases, the refund will be reimbursed only when and not before, the bidder/purchaser has complied with the conditions of part 51. The bidder/purchaser indemnifies ETS in all cases from damages that result from the non-compliance of part 51. Therein the bidder/purchaser is liable for all judicial and extra judicial costs accrued by ETS with a minimum sum of € 1,000.00 including VAT.

conversion53. In the case where one or more of these conditions of auction

are not, or become, no longer lawful, the remaining conditions remain lawful. In such cases, a new lawful condition will come in the place of the no longer lawful condition; in which the new condition will resemble, concerning content, range and aim, as much as possible the old, no longer lawful, condition.

disputes54. If, at allotment, a difference of opinion arises to the question

as to whom had made the last bid, or in the event that other difficulties, confusions or disputes arise at the time of bidding and/or allotment, the auctioneer is authorized to have final say herein which is binding. In the case where the aforementioned difference of opinion concerns the last bid made, the auctioneer is authorized to continue the sale by way of bidding.

55. In the event that the auctioneer calls in the notary to make judgment, the notary shall, binding and irrevocably, decide for all parties. During the auction, the notary is also authorized to make judgment in disputes in other matters than those regarding that of bidding and allotment.

56. The legal relationship between ETS and the bidder/purchaser and the vendor are subject solely to Dutch law, with the complete exclusion of the Vienna Sales Treaty (CISG). Disputes, other than those specifically in pursuance of parts 54 and 55, which are subject to the judgment of the auctioneer and the notary, shall be settled exclusively by the qualified judge in Amsterdam.

These conditions are a translation from the Dutch language. In the case of dispute only the original Dutch version is binding.

By providing a bank guaranteeYou should ask your bank to supply docu-mentary evidence of your ‘financial means’. With such a bank guarantee, we can give you permission for a giro transfer. The sum should be paid to Expo Talent Sale BV ac-count within 7 days after the auction.

By partial payment in advanceDepending on the price that you are eventu-ally prepared to pay at the auction, you can transfer a sum to the account of Expo Talent Sale BV in advance of the auction. The sum should be a reasonable amount (as judged by Expo Talent Sale BV) in the light of the pos-sible final sum. In case you don’t buy a horse, the sum will be returned to your account after the auction.

By providing sound business references. You may provide sound business references where there is at least one that is willing to stand as your guarantor. You should notify the Expo Talent Sale office, in advance, of whom your guarantor is. If Expo Talent Sale BV is satisfied, you will then receive permis-sion to pay by giro transfer, in which case the sum should be paid to Expo Talent Sale BV account within 7 days after the auction.
