Subdeel A – Algemeen Subpart A – General
11.1 Inwerkingtreding 11.1 Entry into force
a. Deze beleidsregel MLE-11 versie 3.0 treedt in werking met ingang van 31 maart 2015.
a. This ruling MLE-11 version 3.0 enters into force starting March 31th, 2015.
11.2 Toepassingsgebied 11.2 Applicability
a. Deze beleidsregel beschrijft de eisen ten aanzien van: 1. opzet en indeling van documentatie
uitgegeven door de Militaire Luchtvaart Autoriteit (MLA);
2. opstellen en uitgeven van nieuwe of gewijzigde (Speciale) Militaire Luchtvaarteisen ((S)MLE’s);
3. opstellen en uitgeven van richtlijnen – luchtwaardigheids-, operationele, veiligheids- en kwaliteitsrichtlijnen;
4. in behandeling nemen van verzoeken voor ontheffingen op eisen gepubliceerd als Luchtvaartwet, Wet luchtvaart of een (Speciale) Militaire Luchtvaarteis ((S)MLE);
5. uitgeven van beleidsdocumenten; 6. uitgeven van MLA advies; 7. beheren van publicatieregisters die
betrekking hebben op de documenten, genoemd in deze MLE-11 zoals uitgegeven door de MLA.
a. This ruling describes the requirements regarding: 1. format and structure of documents issued
by the Military Aviation Authority The Netherlands (MAA-NLD);
2. development and issuance of new or amended (Special) military aviation requirements ((S)MAR’s);
3. development and issuance of directives such as airworthiness, operational, safety and quality directives;
4. processing of petitions for exemptions from requirements published in the Aviation Act of the Netherlands or any (Special) military aviation requirement ((S)MAR);
5. issuance of policy papers; 6. issuance of MAA-NLD advice; 7. control of publication registers applicable
to the documents mentioned in this MAR-11 as published by the MAA-NLD.

h. Exemption – Grant of permission to deviate from a specific requirement or to comply with the requirement by means of special alternative provisions, conditions, or limitations.
11.10 Opzet en indeling van door de MLA

11.10 Format and structure of documents
issued by the MAA-NLD
a. Iedere (S)MLE dient tweetalig (Nederlands en Engels) en in twee kolommen formaat te worden uitgegeven met een standaard opzet die bestaat uit:
a. Each (S)MAR shall be published as a bilingual (Dutch and English) document having a two column format with a standard format containing the following:

(NPR) of gewijzigde eis (NPA) heeft de opzet als weergegeven in Aanhangsel 1 en dient de volgende inhoud te bevatten: 1. inleiding met uitleg en

b. A notice of publication of a new (NPR) or amended requirement (NPA) has the format as provided in Appendix 1 and shall have the following content: 1. introduction containing an explanation
and background information related to the issuance or amendment;
2. new or amended text of the (S)MAR.
c. Uit te geven richtlijnen dienen de volgende opbouw te hebben: 1. publicatiegegevens met
documentnummer, datum van uitgifte en toepasselijkheids-gegevens;
2. inhoudelijke gegevens waarop de richtlijn van toepassing is.
d. De MLA publiceert standaard forms voor het uitgeven van de verschillende richtlijnen.
c. Directives to be issued shall have the following format: 1. publication details including document
number, date of issue and applicability data;
2. detailed information relevant to the issue the directive applies to.
d. The MAA-NLD publishes standard forms for the issuance of the different types of directives.
e. Beleidsdocumenten (policy papers) dienen de volgende opbouw te hebben: 1. titelpagina vermeldt documentnummer en

11.15 Development and issuance of new or
amended MAR’s
a. De MLA is bevoegd op eigen initiatief militaire luchtvaarteisen uit te geven, te wijzigen en te herroepen op basis van het Subtaakbesluit dienstonderdeel SG 2008. Bij het ontwikkelen van deze eisen kan de MLA gebruikmaken van reeds bestaande publicaties van derden, waaronder andere autoriteiten, zowel civiel als militair.
a. Based on decision SG 2008 of the Secretary General of the Netherlands Ministry of Defence, the MAA-NLD is authorised on its own initiative to issue, amend and revoke military aviation requirements. When developing these requirements the MAA-NLD may make use of already existing publications of third parties, such as other civil and military authorities.
b. De MLA neemt het besluit om over te gaan tot het uitgeven van een nieuwe eis, het wijzigen of herroepen van een bestaande eis na evaluatie van de juridische consequenties van dit besluit conform een vastgestelde procedure. Bij deze evaluatie worden voorstellen van derden in overweging genomen.
b. The MAA-NLD decides to issue a new requirement, to amend or revoke an existing requirement after evaluation of the legal consequences of this decision in accordance with a standard procedure. Proposals of third parties are considered and form a part of this evaluation.
c. De MLA kan besluiten voor uitgifte van een definitieve nieuwe of gewijzigde eis een concepteis uit te geven met de mogelijkheid tot het geven van commentaar door middel van een NPR/NPA. Aanhangsel 1 geeft het formaat weer van een NPR/NPA.
c. Before issuing the definitive new or amended requirement, the MAA-NLD may decide to issue a concept requirement together with the possibility to give comments by means of a NPR/NPA. Appendix 1 provides the format of the NPR/NPA.
d. Naast de verwachte datum van inwerkingtreding van een MLE wordt in een NPR/NPA tevens aangegeven binnen welke termijn commentaar op de voorgestelde nieuwe of gewijzigde eis uiterlijk bij de MLA kan worden ingediend.
d. In addition to the proposed entry into force date of a MAR, each NPR/NPA will indicate the time frame for submitting comments to the MAA-NLD regarding a new or amended requirement.
e. Commentaren betreffende de voorgestelde nieuwe of gewijzigde eis dienen te worden ingediend binnen de door de MLA gestelde tijdslimieten met gebruikmaking van MAA-NLD Form 526 NPR/NPA Commentaarformulier.
e. Comments on the proposed new or amended requirement shall take place within the time periods dictated by the MAA-NLD by filling-out MAA-NLD Form 526 NPR/NPA Comment Response Document.
f. Uitgifte van deze eisen vindt plaats door middel van publicatie van Militaire Luchtvaarteisen (MLE’s).
f. Issuance of these requirements takes place by means of the publication of Military Aviation Requirements (MAR’s).
g. Publicatie van de uitgifte van een MLE wordt bekendgemaakt op de volgende wijze: 1. plaatsing op het defensie intranet;
2. belanghebbenden ontvangen een nota; 3. door middel van een melding in de
Staatscourant.
g. Publication of the issuance of a MAR takes place in the following manner: 1. placing the document on the defence
intranet; 2. interested parties receive a formal letter; 3. by means of an announcement in the
Dutch State Paper, the ‘Staatscourant’. h. Een maand voorafgaand aan de officiële
publicatie van een nieuwe of gewijzigde MLE, plaatst de MLA deze eis als NPR/NPA op het intranet. Deze NPR/NPA bevat de gehele MLE-tekst inclusief de bijgehouden wijzigingen.
h. One month before the official publication of a new or amended MAR, the MAA-NLD places this requirement on the intranet in the form of a NPR/NPA. This NPR/NPA contains the complete MAR text including all the actual amendments.
i. Inwerkingtreding van een nieuwe of gewijzigde eis vindt plaats op de volgende wijze:
i. The entry into force of a new or amended requirement takes place in the following manner:

1. formele publicatie met ondertekening door of namens de Directeur MLA;
2. vanaf het moment van publicatie geeft de MLA betrokken partijen een vooraf vastgestelde termijn om te voldoen aan de nieuwe of gewijzigde eis;
3. de paragraaf ‘Inwerkingtreding’ van elke MLE geeft aan vanaf welke datum de eis geldend is.
j. De uitgegeven MLE’s worden om de 5 jaar herzien tenzij een eerdere herziening noodzakelijk wordt geacht.
1. official publication signed by or on behalf of the Director MAA-NLD;
2. from the moment of publication the MAA-NLD offers affected parties a pre-determined period to comply with the new or amended requirement;
3. the paragraph ‘Entry into force’ of each MAR provides the compliance date.
j. Published MAR’s are reviewed every 5 years unless earlier review is considered necessary.
11.20 Opstellen en uitgeven van nieuwe of
gewijzigde Speciale Militaire
Luchtvaart Eisen (SMLE’s)
11.20 Development and issuance of new or
amended Special Military Aviation
Requirements (SMAR’s)
a. SMLE’s worden uitgegeven zodat de MLA de mogelijkheid heeft om: 1. een eis voor een bepaalde tijd uit te
geven; 2. een eis te richten tot een specifieke
groep; 3. een eis met een specifiek doel uit te
geven; 4. de MLA ervaring en kennis op te laten
doen gedurende de bepaalde tijd die is vastgesteld voor de specifieke SMLE.
a. SMAR’s are issued to provide the MAA-NLD with the possibility to: 1. issue a requirement for a specified period;
2. direct a requirement at a specific group;
3. issue a requirement for a specific purpose;
4. enable the MAA-NLD to gain experience or knowledge during the trial period of the specific SMAR.
b. Een SMLE is gelijkwaardig aan een MLE ten aanzien van: 1. ontwikkeling en uitgifte, inclusief
NPR/NPA-proces; 2. toepassing; 3. invoering; 4. nakoming.
b. A SMAR is equivalent to a MAR with regards to: 1. development and issuance, including
NPR/NPA process; 2. application; 3. implementation; 4. compliance.
c. Een SMLE wordt op gelijke wijze als een MLE gepubliceerd en bekendgemaakt.
c. A SMAR is published and made public in the same manner as a MAR.
11.25 Indienen en behandelen van
voorstellen
11.25 Submitting and handling of proposals
a. Iedere persoon of instantie van het Ministerie van Defensie is gerechtigd om voorstellen in te dienen die zouden kunnen leiden tot het door de MLA uitgeven van nieuwe eisen of wijzigingen op bestaande eisen.
a. Any person or body of the Netherlands Ministry of Defence is entitled to submit proposals that could lead to the publication by the MAA-NLD of new requirements or amendments to existing requirements.
b. Elk voorstel dient op schrift te worden gesteld en te zijn gericht aan de MLA. Minimaal dienen de volgende gegevens te zijn opgenomen in het verzoek: 1. naam indiener voorstel; 2. referentie naar de eis waarop het voorstel
van toepassing is; 3. duidelijke omschrijving van het voorstel
voor een nieuwe of wijziging op een bestaande eis;
4. reden(en) om dit verzoek in te dienen.
b. Each proposal shall be made in writing and addressed to the MAA-NLD. The petition shall contain at least the following information:
1. name of the submitter; 2. reference to the requirement applicable to
the proposal; 3. clear description of the proposal for a new
or amendment to an existing requirement;
4. reason(s) for submitting this proposal. c. Voorstellen dienen te worden ingediend met
gebruikmaking van MAA-NLD Form 527 – c. Proposals shall be submitted by filling-out a

Verzoek tot opstellen / wijzigen MLE. Rulemaking / -change. d. De MLA stuurt een ontvangstbevestiging van
het voorstel naar de indiener. d. The MAA-NLD sends a confirmation receipt of
the proposal to the submitter. e. Indien een voorstel niet wordt overgenomen,
zal de MLA de indiener hiervan op de hoogte stellen. Dit kan plaatsvinden door een individuele schriftelijke mededeling of door een algemene publicatie voor belanghebbenden.
e. When a proposal is not adopted, the MAA-NLD will inform the submitter accordingly. This may take the form of an individual written notification or through a general publication for interested parties.
f. De MLA hanteert voor een ingediend voorstel een standaard behandelingstermijn van acht (8) weken.
f. The MAA-NLD has a standard handling time of eight (8) weeks for each submitted proposal.
11.30 Opstellen en uitgeven van richtlijnen –
luchtwaardigheids-, operationele,
veiligheids- en kwaliteitsrichtlijnen
11.30 Development and issuance of
directives – airworthiness, operational,
safety and quality directives
a. Wanneer de Directeur MLA heeft vastgesteld dat een conditie in of met een luchtvaartuig een ernstig onveilige en niet-luchtwaardige situatie heeft opgeleverd en het aannemelijk wordt geacht dat deze conditie zich mogelijk ook voordoet in andere soortgelijke luchtvaartuigen of operationele omstandigheden, zal de MLA de noodzakelijke maatregelen treffen via het uitgeven van een richtlijn om zeker te stellen dat de onveilige situatie wordt opgeheven of voorkomen.
a. When the Director MAA-NLD has determined that a condition in or with an aircraft has resulted or could have resulted in a serious unsafe and un-airworthy situation and it seems that this condition is likely to exist or develop in other aircraft or operational circumstances, the MAA-NLD will take the necessary measures by using a directive to ensure that the unsafe condition is cancelled or prevented.
b. Wanneer een richtlijn van toepassing is op een vlucht, is het niet toegestaan af te wijken van deze richtlijn, tenzij anders overeengekomen met de MLA.
b. When a directive applies to a flight, it is not allowed to deviate from this directive, unless otherwise agreed with the MAA-NLD.
c. Richtlijnen: 1. worden ontwikkeld en uitgegeven conform
standaard procedures van de MLA met gebruikmaking van de volgende MLA forms: i MAA-NLD Form 530 Airworthiness
Directive;ii MAA-NLD Form 531 Operational
Directive;iii MAA-NLD Form 532 Safety Directive;iv MAA-NLD Form 533 Quality Directive;
2. worden opgesteld in de Engelse taal. d. Elke richtlijn dient ten minste de volgende
informatie te bevatten: 1. identificatie van de onveilige situatie; 2. identificatie van het betrokken systeem; 3. de te nemen maatregelen; 4. uiterste uitvoeringstijdstip van de
maatregelen; 5. de datum van inwerkingtreding.
c. Directives: 1. are developed and issued in accordance
with: the standard procedures of the MAA-NLD, using the following MAA-NLD forms: i MAA-NLD Form 530 Airworthiness
Directive; ii MAA-NLD Form 531 Operational
Directive; iii MAA-NLD Form 532 Safety Directive; iv MAA-NLD Form 533 Quality Directive;
2. are drawn up in the English language. d. Each directive shall contain as a minimum the
following information: 1. an identification of the unsafe condition; 2. an identification of the affected system; 3. the action(s) required; 4. the compliance time for the required
action(s); 5. the date of entry into force.

11.35 Adoptie en goedkeuring van door of

11.35 Adoption and approval of directives
issued by or on behalf of other
authorities
a. De MLA kan besluiten om richtlijnen, uitgegeven door een andere autoriteit, te adopteren en, indien noodzakelijk, uit te geven als een MLA-richtlijn.
a. The MAA-NLD can decide to adopt and, if necessary, issue as a MAA-NLD directive, any directive issued by another authority.
b. Dergelijke richtlijnen worden onverkort overgenomen door de MLA, indien de autoriteit door de MLA is erkend.
b. Such directives are fully adopted by the MAA-NLD when the particular authority is recognised by the MAA-NLD.
c. De MLA is bevoegd naar eigen inzicht af te wijken van de inhoud van de originele richtlijn. De afwijkingen dienen geregistreerd te worden in het dossier van de desbetreffende richtlijn.
c. The MAA-NLD is authorised, at its own discretion, to deviate from the content of the original directive. The deviations shall be recorded in the particular file.
d. De richtlijnen die conform deze eis door de MLA zijn overgenomen, worden bekrachtigd en uitgegeven op gelijke wijze als een door de MLA uitgegeven richtlijn.
d. The directives that are adopted by the MAA-NLD in accordance with this requirement are ratified and issued in the same manner as applicable to a directive issued by the MAA-NLD.

11.40 Indienen van verzoeken tot
ontheffingen
11.40 Submitting petitions for exemptions
a. Indien een persoon of instantie het noodzakelijk acht om af te wijken van een eis of van mening is dat een alternatieve invulling van een specifieke eis mogelijk is, dient een verzoek tot ontheffing van de desbetreffende eis bij de MLA te worden ingediend en dient goedkeuring te zijn verkregen voordat van de eis mag worden afgeweken.
a. When a person or organisation has a need to deviate from a requirement or is under the assumption that an alternative method of compliance to a specific requirement is possible, a petition for exemption from the specific requirement shall be submitted to the MAA-NLD and its approval obtained before any deviation from the requirement is allowed.
b. De aanvrager dient bij het verzoek ten minste de volgende gegevens schriftelijk te verstrekken: 1. naam indiener verzoek; 2. referentie naar de eis waarop het verzoek
van toepassing is; 3. duidelijke omschrijving van het verzoek
tot ontheffing van de eis; 4. reden(en) om dit verzoek in te dienen; 5. omschrijving van de condities waaronder
de aanvrager van mening is dat de ontheffing minimaal dezelfde basis voor veiligheid kan garanderen;
6. gewenste tijdsduur van de ontheffing; 7. informatie die het verzoek tot ontheffing
onderbouwt en rechtvaardigt; 8. de verklaring ‘No Technical Objection’
verstrekt door de MTC-houder in geval van ontheffingen op afwijkingen van het typecertificaat.
b. The petitioner shall submit at least the following information in writing:
1. name of petitioner; 2. reference to the requirement to which the
petition applies; 3. clear description of the petition for

c. Verzoeken dienen te worden ingediend met gebruikmaking van MAA-NLD Form 528 Verzoek tot Ontheffing & Permit to Fly.

g. Special conditions in the event of unforeseen urgent operational circumstances: 1. only in case of severe and possibly
threatening operational conditions it is permitted to deviate from airworthiness and operational requirements laid down in applicable MAR requirements without having obtained a prior exemption from the MAA-NLD;
2. the direct responsible commander shall ensure that a report is submitted as soon as possible after the event describing the conditions and the requirements that were deviated from.

Movement area Part of the aerodrome to be used for the take-off,

MTC documentation Approved documentation required to operate and
maintain the certified aeronautical product in an

Multi-crew co-operation The functioning of the crew as a team of co-

compliance with the applicable airworthiness
requirements, but not yet approved by or on behalf
of the MAA-NLD.
Visual approach An approach when either part or all of an instrument
approach procedure is not completed and the
approach is executed with visual reference to the
terrain.
Wet lease Transfer of aircraft in which case the aircraft is
operated under the MAOC or AOC of the lessor (the
owner of property that is leased).
Wet runway A runway is considered wet when the runway
surface is covered with water, or equivalent more
than as specified by the term contaminated runway
or when there is sufficient moisture on the runway
