During their search, they recovered 214 bot- tles of illicit country made liquor, he said. Hundreds of terrified people rushed out of their homes and buildings toppled as the 7.3-magnitude earthquake, centred 68km west of the town of Namche Bazaar near Mount Everest, sent ripples in India all the way from the border states of Bihar and West Bengal to Gujarat and Delhi. At least 17 people died in India in the fresh quake. “I was taking my afternoon nap after lunch and somehow managed to rush out with my baby. My house is safe but I am afraid to go inside,” said Bimala Magar, a resident of Kathmandu’s Dhumbarahi. More than 1,000 people were injured as the quake flattened buildings in Kathmandu and other parts of Nepal already weakened by the 7.9-magnitude April 25 earthquake. Eye-witnesses say the policeman did not run from the spot. He stopped the car, fol- lowing which a large crowd gathered. One of the women had died on the spot. The two injured women were taken to the hospital, where they died. In another outrage yesterday, a Delhi po- liceman, Head Consta- ble Satish Chandra, was caught on camera at- tacking a woman with a brick in broad daylight. The woman was driving home in a two wheel- er with her children. The police man, Satish Chand, had flagged her down after she alleged- ly jumped a traffic sig- nal. The women said she agreed to pay a fine later, since she was in a hurry, but the policemen demanded a bribe and when she refused to pay, kicked her two-wheeler. She retaliated, throwing a stone at his bike. A mo- bile phone clip record- ed by a passerby shows the woman picking up a brick and hurling it at the policeman’s bike. The policeman is seen striking right back with another brick, which hits the woman on her back. He allegedly also twist- ed her arm. Satish Chan- dra was later dismissed from service and a case was registered against him. Rahul attacks Modi govt on land bill, threatens street protests Agency : New Delhi An aggressive Rahul Gandhi tore into the government in Parliament over a contentious land acquisition bill on Tuesday, threatening to take the protests to the streets if the NDA didn’t listen to Opposition demands of scrapping the “anti-poor” legislation. The Congress vice-president attacked the Modi government for killing “farmer-friendly” clauses in an UPA-era bill, pointing out the finance ministry had admitted only eight out of 100 projects were stalled due to lack of land. “We will take to the streets if you go ahead with the new bill. This ‘suit-boot ka kaam’ will not go on. Govt blinks in tax tussle with foreign investors

The revenue department will not act on demands for minimum alternate tax (MAT) it has already slapped on foreign portfolio investors (FPIs) nor will it make any fresh MAT claims, the government said on Mon-day, offering relief to FPIs in an ongoing dispute that has rattled the markets. The embargo will pre-vail until a committee headed by Law Commission chairman A.P. Shah submits its report to the govern-ment on the applicability of MAT on foreign inves-tors, an official circular issued by the tax department said. Not only will this provide a respite to FPIs and long-term investors like private equity and venture capital funds, it also signals a climbdown by the rev-enue department. The instruction follows finance minister Arun Jaitley’s statement last week in the Rajya Sabha, where he announced the setting up of a committee under Shah, a former Delhi high court chief justice, to look into so-called legacy cases in-herited by the National Democratic Alliance govern-ment from its predecessor. The central board of di-rect taxes, in its circular, said the panel constituted by the finance minister is expected to submit its report expeditiously. “In the light of FM’s announcement, officers dealing with International Taxes have been advised that no coercive action be taken for recovery of demand already raised by invoking provisions of MAT in the cases for foreign companies. Issues of fresh notices for reopening of cases as also comple-tion of assessment should also be put on hold unless the case is getting barred by limitation,” the circular said. On Monday, the BSE Sensex jumped 1.5% to 27,507.30 at the close after gaining 1.9% on Friday, having earlier erased all its year-to-date gains over MAT worries and concerns about corporate earnings. “A lot of FIIs who have not received notices so far have been quite concerned and anxious to know if and when they will receive a notice and how they should approach the matter given the uncer-tainty on the MAT issue,” said Rajesh H. Gandhi, a partner at Deloitte Haskins and Sells Llp. “FIIs should therefore be relieved to know that no fur-ther notices will be issued till the committee issues its report,” he added. The income tax department had started issuing notices to foreign investors for levy of MAT on capital gains accruing to them from sale of shares, citing a August 2012 order by the Authority for Advance Rulings in the case of Castleton Investment Ltd that MAT is applicable on both domestic and foreign companies. MAT is a tax levied on profit-making entities that don’t pay corporate income tax because of exemptions and incentives. Foreign investors opposed these notic-es, arguing that MAT can be levied on book profits of companies and that they do not maintain book of profits in India.

Agency : New DelhiThe government’s aggres-sive stand during hearings in the Supreme Court on the constitutional validi-ty of the National Judicial Appointments Commis-sion (NJAC) will effec-tively ensure that even if the bench strikes down the law, the old collegium sys-tem will not be revived.The NJAC law, passed in 2014 by both Houses of Parliament almost with

dissent, and by 20 states assemblies subsequently, clearly represents the over-whelming will of the peo-ple of India. This does not mean the court can’t strike it down on grounds of un-constitutionality, but it will certainly make the collegi-um system of appointing judges impossible to de-fend or revive. The colle-gium system came into be-ing in the 1990s when the Supreme Court decided in

two cases that judges will appoint themselves — un-heard of in most parts of the world — and giving the executive almost no say in the business. This was not the mandate of the original Article 124 of the Consti-tution on the appointment of judges, which said that the President will appoint judges after consultations with the Chief Justice and any other judge he may want to. That the judicia-ry does not like the NJAC has been apparent from the start. First, the petitioners forced Justice AR Dave to recuse himself from the bench as he would have been part of the NJAC by law. This was followed by the CJI, HL Dattu, also re-fusing to join the commit-tee to pick eminent persons to join the NJAC.

The bank had posted a net profit of Rs 162.44 crore in the cor-responding period last year. Total income in the March quarter increased

to Rs 7,321.50 crore from Rs 6,961.67 crore in the quarter ended March 31, 2014, Central Bank of In-dia said in a filing to BSE today. On asset quality, bank’s gross non-per-forming assets (NPAs) or bad loans were trimmed to 6.09 per cent of gross advances in the fourth quarter, down from 6.27 per cent in previous fis-

cal. Net NPAs too came down to 3.61 per cent of net advances during the fourth quarter from 3.75 per cent year ago. For the full year, the bank earned a net profit of Rs 606.45 crore compared with a loss of Rs 1,262.84 crore in the previous fiscal. To-tal annual income in the period under review in-creased to Rs 28,303.01 crore from Rs 26,350.13 crore, it said. Central Bank of India shares trad-ed at Rs 110.60 apiece on the BSE, down 0.98 per cent.

Taking swift action, the Pydho-nie police had immedi-ately conducted a raid and rescued two mi-nor girls from a similar fate, and now, less than a month later, the cops have busted the entire racket with the arrest of the last absconding ac-cused. Beginnings On April 17, a 22-year-old girl approached the Py-dhonie police and told them that she had been tricked into going to Bakrana, a village near

Ahmedabad in Gujarat, where she was forced to marry a 45-year-old vil-lager. She alleged that she had been sold to the man for Rs 1 lakh and he had raped her and kept her confined until she managed to finally

escape. She gave the police details about the racket and the accused, with the help of which the cops immediately raided the village and rescued two minor girls who had been similarly abducted.

Hence, the court should permit identification of the accused from their photo-graphs taken during their arrest in 2008-09,” prose-cution has told the court. This problem hit home during a hearing on April 29 when a ‘panch’ witness could identify accused Za-hir Patel but failed to iden-tify Sajid Mansuri. Both were arrested in 2008 and were presented through video-conferencing from

Sabarmati central jail to be identified by the witness in the courtroom. Prose-cution requested special judge P C Rawal to per-mit the witness to identify Mansuri through his old photographs. However, the request was opposed by defence counsel Naina Bhatt, who argued that there is no provision to identify accused persons on the basis of their pho-tographs. Special prose-cutors put their foot down and cited a Supreme Court order allowing identifica-tion of a dead man through his photograph in the De-cember 13, 2001, Parlia-ment attack case. Defence lawyers, however, did not agree with applicability of this order in this situa-tion since the accused are all alive. The court had to adjourn the hearing when prosecutors sought time to file an application de-manding permission to put old photographs of 78-odd accused without their names and identities be-fore witnesses for the pur-pose of identification of a particular accused from the heap of pictures.
