since 1998. They use ingredients grown on the farm and everything is 100% natural, with fragrances from real strawberries, raspberries and jasmine flowers. Matunas have created a

DECK SKIN/RAILSXPE (Used on our Bodyboards & Soft Surfboards)This is a cross linked Polyethylene material which

density has a shock absorbing feature. The XPE has a closed cell structure which means that it is very good at keeping the water out.

IXPE (Only used on our Bodyboards and Soft Surboards)A higher density material than XPE that still maintains its closed cell structure. The advantage of IXPE is that due to its high density it adds rigidity and enhances the overall strength of the bodyboard or surfboard. The other advantages of this material are that it provides superior water protection to the bodyboard or surfboard and gives the rider a smoother riding surface - although not as shock absorbing as XPE.

BOTTOM TYPESHDPE Slick (Used on our Bodyboards & Soft Surfboards)High Density Polyethylene ‘HDPE’ slick is used onthe bottom of the board to enhance the performance characteristics of the board. Not only does HDPE slick add strength to the bodyboard or surfboard it also gives a resistance free riding surface to enhance speed and manoeuvrability on the wave.

Artikel 1. Toepasselijkheid.1.1 Op alle aanbiedingen, bestellingen en overeenkomsten van Peak Distribution zijn bij uitsluiting van eventuele andere algemene voorwaarden deze Algemene Verkoop- en leveringsvoorwaarden van toepassing.1.2 Het accepteren van een aanbieding dan wel het doen van een bestelling houdt in dat u de toepasselijkheid van deze Voorwaarden aanvaardt.1.3 Van het in deze Voorwaarden bepaalde kan slechts schriftelijk worden afgeweken, in welk geval de overige bepalingen onverkort van kracht blijven.1.4 Alle rechten en aanspraken, zoals in deze Voorwaarden en in eventuele nadere overeenkomsten ten behoeve van Peak Distribution worden bedongen, worden evenzeer bedongen ten behoeve van door Peak Distribution in-geschakelde tussenpersonen en andere derden.

Artikel 2. Aanbiedingen/overeenkomsten2.1 Alle aanbiedingen van Peak Distribution zijn vrijblijvend en Peak Distribution behoudt zich uitdrukkelijk het recht voor om de prijzen te wijzigen, in het bijzonder wanneer dat op grond van (wettelijke) voorschriften of wi-jziging van calculatie of inkoopprijs voor Peak Distribution noodzakelijk is geworden.2.2 Een overeenkomst komt slechts tot stand na acceptatie van uw bestelling door Peak Distribution. Peak Distribution is gerechtigd bestellingen te weigeren dan wel bepaalde voorwaarden aan de levering te verbinden, tenzij uitdrukkelijk anders bepaald. Indien een bestelling niet wordt geaccepteerd, deelt Peak Distribution dit zo snel als dit voor Peak Distribution mogelijk is mee.2.3 Een aantal van de producten (zoals specifieke opdrachten, voor u op maat, kleur of naam gemaakt) wordt aangeboden onder de vermelding van een afnameverplichting. Door deze producten te bestellen, verklaart u dat u afstand doet van retourrecht.

Artikel 3. Prijzen en betalingen3.1 De vermelde prijzen voor de aangeboden producten en diensten zijn in euro’s, exclusief BTW en exclusief handeling- en verzendkosten. Exclusief eventuele belastingen of andere heffingen, tenzij anders vermeld of schriftelijk overeengekomen.3.2 Betaling dient te geschieden, tenzij schriftelijk anders is overeengekomen doch uiterlijk binnen dertig (30) dagen na factuur- of opdrachtdatum.3.3 Betaling kan geschieden onder vooruitbetaling. Bij betaling per bank of giro geldt als datum van betaling de datum van creditering van de giro-respectievelijk bankrekening van Peak Distribution.3.4 Indien men zich niet houdt aan de besproken betalingstermijn, zijn wij genoodzaakt om uw openstaande nota ter incasso aan te bieden. De eventuele bijkomende (buiten) gerechtelijke kosten zullen dan op u worden verhaald. Voor het invorderen van onze openstaande nota’s maken wij gebruik van de incassodienstverlening van het Centraal Invorderings Bureau te Rotterdam.3.5 Indien u met enige betaling in gebreke bent, is Peak Distribution gerechtigd (de uitvoering van) de betref-fende overeenkomst en daarmee samenhangende overeenkomsten op te schorten, dan wel te ontbinden.3.6 Indien de prijzen voor de aangeboden producten en diensten stijgen in de periode tussen de bestelling en de uitvoering daarvan, bent u gerechtigd de bestelling te annuleren dan wel de overeenkomst te ontbinden binnen tien (10) dagen na mededeling van de prijsverhoging door Peak Distribution.3.7 Niet betaalde goederen blijven eigendom van Peak Distribution. Deze mogen door besteller niet vervreemdt, gebruikt of anderszinds beschadigd worden en dienen verzekerd te worden tegen alle van buiten komende on-heilen. Niet betaalde goederen kunnen door Peak Distribution opgeïst worden als borgstelling voor betaling onver-minderd het recht van Peak Distribution om alle kosten hiervoor genoemd op opdrachtgever te verhalen.

Artikel 4. Levering4.1 De door Peak Distribution opgegeven levertijden zijn slechts indicatief. Overschrijding van enige levering-stermijn geeft u geen recht op schadevergoeding en evenmin het recht uw bestelling te annuleren als wel de overeenkomst te ontbinden, tenzij de overschrijding van de leveringstermijn zodanig is dat van u redelijkerwijs niet kan worden verlangd dat u de overeenkomst in stand laat. U bent in dat geval gerechtigd de bestelling te annuleren dan wel de overeenkomst te ontbinden voor zover dat noodzakelijk is.4.2 De levering van de producten geschiedt op de plaats en het tijdstip waarop de producten gereed zijn voor verzending aan u.

Artikel 5. Eigendomsvoorbehoud5.1 De eigendom van geleverde producten gaat pas over, indien u al hetgeen u op grond van enige overeenkomst aan Peak Distribution verschuldigd bent, heeft voldaan. Het risico ter zake van de producten gaat reeds op het moment van de aflevering op u over.

Artikel 6. Reclames en aansprakelijkheid6.1 U heeft de verplichting om bij aflevering te onderzoeken of de producten aan de overeenkomst beantwoorden. Indien dit niet het geval is, brengt u Peak Distribution daarvan zo spoedig mogelijk en in ieder geval binnen drie (3) dagen na de aflevering, althans nadat constatering redelijkerwijze mogelijk was, schriftelijk en gemotiveerd kennis te geven.6.2 Indien is aangetoond dat de producten niet aan de overeenkomst beantwoorden, heeft Peak Distribution de keuze de desbetreffende producten na retournering daarvan (zie ook artikel 6.4) te vervangen door nieuwe pro-ducten danwel de factuurwaarde daarvan te restitueren.6.3 Indien u een product om welke reden dan ook niet wenst af te nemen, heeft u het recht het product binnen veertien (14) dagen na aflevering aan Peak Distribution te retourneren. Retourzendingen worden in dit geval slechts geaccepteerd indien het product en de originele verpakking onbeschadigd zijn, waarbij tevens geldt dat de kosten voor retourzendingen voor uw rekening komen. Verder zijn ook alle voorwaarden genoemd in artikel 6.4 van toepassing.6.4 Indien na overleg met Peak Distribution wordt overgegaan tot een retourzending, dan moet deze in de origi-nele verpakking, voldoende gefrankeerd en voldoende ingepakt worden opgestuurd aan Peak Distribution. Indien niet aan deze voorwaarden is voldaan, dan zijn de eventueel gemaakte extra kosten voor u. Peak Distribution houdt zich het recht voor ongefrankeerde zendingen te weigeren.

Artikel 7. Bestellingen/communicatie7.1 Voor misverstaan, verminkingen, vertragingen of niet behoorlijk overkomen van bestellingen en mededelin-gen ten gevolge van het gebruik van internet of enig ander communicatiemiddel in het verkeer tussen u en Peak Distribution, of tussen Peak Distribution en derden, voor zover betrekking hebbend op de relatie tussen u en Peak Distribution, is Peak Distribution niet aansprakelijk, tenzij en voor zover sprake mocht zijn van opzet of grove schuld van Peak Distribution.

Artikel 8. Overmacht8.1 Onverminderd de overige aan haar toekomende rechten, heeft Peak Distribution ingeval van overmacht het recht om, naar eigen keuze, de uitvoering van uw bestelling op te schorten, dan wel de overeenkomst zonder rechterlijke tussenkomst te ontbinden, zulks door u dit schriftelijk mee te delen en zulks zonder dat Peak Distri-bution gehouden is tot enige schadevergoeding, tenzij dit in de gegeven omstandigheden naar maatstaven van redelijkheid en billijkheid onaanvaardbaar zou zijn.8.2 Onder overmacht wordt verstaan iedere tekortkoming welke niet aan Peak Distribution en de door haar ingeschakelde tussenpersonen en derden kan worden toegerekend, omdat zij niet te wijten is aan haar schuld en noch krachtens de wet, rechtshandeling of in het verkeer geldende opvattingen voor haar rekening komt.

Artikel 9. Diversen9.1 Indien één of meer van de bepalingen van deze Voorwaarden of enige andere overeenkomst met Peak Dis-tribution in strijd mochten zijn met enig toepasselijk rechtsvoorschrift, zal de betreffende bepaling komen te ver-vallen en zal deze worden vervangen door een door Peak Distribution vast te stellen nieuwe rechtens toelaatbare vergelijkbare bepaling.9.2 Peak Distribution is bevoegd om bij de uitvoering van uw bestelling(en) gebruik te maken van derden.

Artikel 10. Toepasselijk recht en bevoegde rechter10.1 Op alle rechten, verplichtingen, aanbiedingen, bestellingen en overeenkomsten waarop deze Voorwaarden van toepassing zijn, is uitsluitend Nederlands recht van toepassing.10.2 Alle geschillen tussen partijen zullen bij uitsluiting worden voorgelegd aan de daartoe bevoegde rechter in het arrondissement waarin Peak Distribution haar hoofdvestiging heeft.
