Apakah Notaris akan terkenan disrupsi ? • Iya, jika hanya berkutat kepada pembuat akta

semata,

• Tidak, jika kembali kepada hakekat fungsi dan peranan notaris sebagai pengemban amanat kepercayaan public Trusted Third Party + Trust Services yang mencegah Fraud dan Forgery dalam suatu transaksi elektronik.

• Faktanya sekarang Notaris telah melakukan komunikasi secara elektronik: • N2G => SABH, OSS, Alegtron, dsb • N2B => sms, email, WA, cloud, dst. • N2C dan N2N => ibid

US Model Notary Law § 5-1 Powers of Notary . A notary is empowered to perform the following notarial acts: (1) acknowledgments; (2) oaths and affirmation; (3) jurats; (4) signature witnessings; (5) copy certifications; (6) verifications of fact; and (7) any other acts so authorized by the law of this [State]. § 17-1 Authorized Electronic Notarial Acts. The following notarial acts may be performed electronically: (1) acknowledgment; (2) jurat; (3) signature witnessing; (4) copy certification; and (5) verification of fact. UK Legal Services Act 2007 & NOTARIES PRACTICE RULES 2009 “notarial act” means any act that has validity by virtue only of its preparation, performance, authentication, attestation or verification by a notary, and includes any such act carried out by electronic means

Section 2 Dutch Notary Act 1. The office of notary confers the power to execute authentic

notarial acts in the cases in which he is entrusted with this by law or a party requires this and to perform other activities with which he is entrusted by law.

The law requires a notarial deed for a number of agreements and

legal transactions. The most important are: 1. conveying real property in the Netherlands; 2. creating and cancelling mortgages; 3. incorporating public and private limited liability companies (NVs

and BVs) and altering their articles of association; 4. establishing foundations and associations (including

cooperatives) and altering their constitution; 5. drawing up, altering and executing wills; 6. drawing up and altering marriage contracts (i.e. usually ante-

nuptial settlements) and registered domestic partnership agreements;

7. transferring registered shares; 8. legalising signatures; 9. providing for gifts and donations in a notarial deed. Section 53 1. Further rules concerning the data and declarations that should

be included in copies and execution copies of and extracts from notarial acts may be adopted by order in council.

2. Rules concerning the manner in which electronic copies of and electronic extracts from notarial acts are produced may be adopted by or pursuant to order in council.

Penutup • Kesiapan untuk Industry 4.0 secara teknis membutuhkan kepastian

keamanan informasi untuk memastikan informasi yang autentik + terpercaya

• Demi economic confidence maka diperlukan legal confidence => CyberNotary sebagai T3P sangat diperlukan untuk mendukung sistem keautentikan secara elektronik baik terhadap Identitas dan Dokumen, guna mencegah Penipuan (fraud), pemalsuan dokumen (forgery), dan akses public registry, serta kelancaran perizinan untuk Kemudahan Berusaha (Ease Doing of Busines) => Notaris dan OSS

• Menuju Industry 4.0 dan Society 5.0 tidak berarti melupakan kewaspadaan terhadap amanat konstitusi untuk menjaga kedaulatan negara, melindungi, mencerdaskan dan mensejahterakan bangsa. Oleh karena itu, Notaris sebagai Pejabat Umum yang mengerti TIK dan berperan sebagai T3P dalam Ekonomi Digital adalah keniscayaan utk ketahanan hukum dan ekonomi nasional.

terlihat adanya ancaman keamanan

• Ayu: Keabsahan pengakuan tanda tangan secara elektronik, kemungkinan penyanggahan tanda tangan secara elektronik. Apabila diajukan bgmn menjamin keautentikan akta tersebut.

• Putu: Untuk pembuatan akta autentik itu harus datang secara fisik dan tanda tangan basah. • 1320 sepakat secara elektronik, dan cukup umur nya (kecakapan bersikap

tindak).

• Sri: apakah ada konflik norma, jika perjanjian tsb dikecualikan dari suatu transaksi elektronik

• Kode unik/kunci => bagaimana proses pemberian kunci tersebut. Tdk semua melek teknologi, apakah nanti jadi harus terpaksa buat email. Kalau hilang konsekwensi nya terjadi bantahan, jadinya seperti apa.

• Pasal 18 Jabatan notaris punya Batasan wilayah jabatan. Bagaimana wilayah kewenangan pembuatan transaksi elektronik.
